C. SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

TECHNICAL ASSISTANCE TO SUPPORT ENVIRONMENTAL DATA AS PART OF THE KOSOVO

THRESHOLD PROGRAM

C.1 INTRODUCTION

The Millennium Challenge Corporation (MCC) is working with the Government of Kosovo (GOK) on the development of a Threshold Program. MCC requires consultancy services to support the due diligence of projects and activities that will effectively address transparent and accountable governance constraints to economic growth in Kosovo. Technical advisory support to MCC will be required for a period of 5 years. Once the threshold program enters into force – expected during 2017 – the GOK entity accountable for Threshold implementation will use MCC Threshold funds to select implementing partners. Implementing partners can be government ministries, individual consultants and consulting firms.

Note: Offerors on this present MCC procurement, when issued, are advised that the firm awarded a contract by MCC for these due diligence services will not be eligible to bid for services for the same or related activities on subsequent procurements by the eventual GOK entity responsible for actual implementation of Threshold program using MCC funds.

The Millennium Challenge Corporation (MCC) Investment Committee has recommended to the MCC Board of Directors to provide assistance for a proposed Threshold Program with the Republic of Kosovo. If the Board approves the Program, MCC will initiate negotiations with the Government of Kosovo to sign a grant agreement. Implementation of the Program is planned for four years and is expected to begin in late 2017.

The Program would support the Government of Kosovo (GoK) to implement policy and institutional reforms in two areas critical to economic growth and poverty reduction: reliable electricity; and transparent and accountable governance. The

Program aims to support the GoK’s efforts to implement policies that lower energy consumption and costs for households by encouraging investments in energy efficiency and promoting the adoption of cleaner and cheaper sources of heating.

These policies are consistent with the GoK’s commitment to investing in the health and well-being of its citizens and would foster a more market-driven approach to energy consumption, as well as help the GoK fulfill its policy commitments as part of the EU accession process.

The Program also seeks to help Kosovo address problems regarding the transparency and accountability of government, which negatively affect the reality and perception of rule of law and control of corruption in the country. The Program will support key institutions in the judiciary and the environmental sector to collect data and communicate information in order to improve decision-making and foster a more collaborative relationship between the government and its citizens.

The projects supported in the Program are as follows:

Reliable Energy Landscape Project: The objective of the Reliable Energy Landscape Project is to pilot methods to lower household energy use by incentivizing investments in energy efficiency and switching to non-electric and cleaner sources of heating. The project will pilot various types of incentives and modalities for households, which account for 60 - 70% of all energy use in Kosovo (of which 80% is for space and water heating), to invest in cost-effective, energy saving measures (e.g. insulation, weatherproofing, etc.). The project will also pilot the metering of district heating systems in order to test the cost-effectiveness of charging households for the energy they use, which could allow for the expansion of such systems and more households switching to non-electric sources of heating.

Transparent and Accountable Governance Project: The objective of this project is to improve the analytical use of publically available judicial and environmental data by civil society and NGOs through data transparency activities. This could potentially lead to improved government decision-making and accountability and foster collaborative problem-solving relationships between government and civil society. In particular, the project will support development of a public portal for judicial decisions. This transparency will encourage greater accountability of the judicial system and provide key institutions with an additional lever of influence. The project will also support an environmental data collection activity and an open data challenge grant facility to support the collection, analysis, and utilization of data to foster collaborative relationships between government and civil society. Finally, the project will support analysis of gender-specific data needs and through a sex-disaggregated lens, to help Kosovo address gender barriers in access to justice, as well as to employment and entrepreneurship, particularly in sectors like energy.

The technical assistance required of the Contractor and described in this TOR shall support MCC due diligence of proposed design and implementation of: The Environmental Data Collection activity of the Transparent and Accountable

Governance Project.

C2. GENERAL PROJECT OBJECTIVE

The objective of this requirement is to provide expert skills to MCC for the due diligence technical services for the

Kosovo Threshold Program.

C3. SPECIFIC PROJECT OBJECTIVES

The specific objective of this requirement is to provide support to MCC for due diligence activity design and implementation of the Environmental Data Activity – this activity will provide support to GoK institutions involved in environmental protection and health promotion to effectively monitor and report on select environmental indicators to a variety of stakeholders, including the public.

C4. BACKGROUND AND PROGRAM DESCRIPTION

A. Threshold Program Activity Descriptions

This SOW is directed at procuring technical services for one of the three Activities under the Kosovo Transparent and

Accountable Governance Project, namely the Environmental Data Activity. The SOW for the Public Access to Judicial

Information Activity and Open Data Challenge Activity will be offered through a separate procurement or USG interagency agreement.

DESCRIPTION OF TRANSPARENT AND ACCOUNTABLE GOVERNANCE PROJECT

The Transparent and Accountable Governance Project will consist of three Main Activities:

1. The Public Access to Judicial Information Activity

2. Environmental Data Collection Activity (this RFQ is for this activity only)

3. Open Data Challenge Activity

Overall Project Objective

This solicitation is only for the Environmental Data collection activity 2.

The objective of this project is to improve the analytical use of publically available judicial and environmental data by civil society and NGOs through data transparency activities. This may logically help address the lack of constructive engagement between civil society and the government on questions of government effectiveness, particularly in the judiciary and the Kosovo Environmental Protection Agency. The project aims to facilitate this engagement by providing transparency and data to ensure that information about the performance and ongoing reforms in the public sector are available to the public and can reinforce these efforts. Combining improved transparency with communication and outreach can also help build investor confidence and address excessively negative perception of Kosovo’s business environment, which persists in the absence of information about a more accurate narrative.

The figure below illustrates the inter-connection from reform, to evidence, to perception, and back to reform through making civil society more effective at providing accountability, with application to the judicial sector as an example.

In the context of using environmental data for greater government accountability and engaging with citizens to encourage progress, the U.S. Embassy in Kosovo has provided a useful example for air quality. Donors have spent millions of dollars supporting the GoK’s efforts toward environmental monitoring, but the data had not been made accessible or packaged for public consumption. The U.S. Embassy, however, connected air quality data to an easy to use smartphone app that gives users a simple color-coded way to monitor the air quality and compare it to international benchmark cities. Going this

‘last mile’ to make data consumable by Kosovo’s public has led to significant media coverage, public discourse, and momentum for change. Despite the Embassy’s success, it is only capable of publishing a limited set of environmental measurements. MCC’s objective will be to ensure production of a robust set of environmental monitoring statistics, and ensure these are accessible and consumable by the public.

To further encourage constructive engagement by civil society and the private sector around both the judiciary and environmental monitoring (as well as key labor force questions), an open data challenge will help get data into the hands of the public in a way that facilitates its use. The open data mechanism can also target questions policy makers would like answered and thus facilitate constructive dialogue with the public sector.

ACTIVITY 1: PUBLIC ACCESS TO JUDICIAL INFORMATION

As noted above, technical assistance for this Activity is being supplied through a separate procurement.

ACTIVITY 2. ENVIRONMENTAL DATA COLLECTION

Under this activity, the Threshold Program will provide support to GoK institutions involved in environmental protection and health to improve their overall performance and specifically to effectively monitor and report on select environmental indicators to a variety of stakeholders, including the public. The activity would also strengthen the ability of civil society to interpret the data in order to engage more productively with the GoK on environmental and health issues.

By law, the Kosovo Environmental Protection Agency (KEPA) is the only GoK agency that collects and reports data on environmental quality. The Kosovo Hydro Meteorological Institute (KHMI), which is the department within KEPA tasked to collect environmental data, is limited by the fact that its air quality sensors are in disrepair, not regularly calibrated, in some cases sited poorly, and require manual data downloads. KHMI currently transmits the limited air, water, and land quality data they collect to KEPA and KEPA reports, at least annually, the data to other ministries in their annual report.

The Kosovo Institute of Public Health (KIPH) should receive the environmental data from KEPA and, based on analysis of the data, recommend actions to improve health outcomes for the population of Kosovo.

There may be other factors that drive KEPA and KHMI’s ability to report data and use data for decision making, including incentives (both within the organization and in the environment in which KEPA operates), organizational structures, organizational processes, staff knowledge, etc. The activity will discern the root causes of performance gaps as http://mmph-rks.org/en-us/Kosova-Environmental-Protection-Agency-well as the assets and strengths that target organizations can leverage to improve performance. It will analyze cultural issues and other factors that prevent data from being shared and used for decision-making. The activity will address the cultural constraints, working at the organizational level to deal with organizational processes and decision making structures that create openings for data-driven decision making.

Support to KEPA would likely include the following elements:

• Root cause analysis to determine the factors that drive KEPA ability to report and use data for decision-making.

• Needs assessment of KEPA’s and KHMI’s current monitoring, data collection and data quality, reporting capacity for air, land and water, gaps in target indicators, and assessment of where other institutions are collecting environmental data, which may need to establish MOUs with KHMI on collection and management of that data;

• Reconcile all of the assets that currently monitor air quality, ensuring all equipment is well placed, functional and communicating data automatically on the indicators of air quality that they currently measure, and ensure that

KHMI is able to keep those assets properly maintained and calibrated;

• Sustainably improve KEPA and KHMI performance through change management

• Improve KEPA’s environmental data management platform and reporting ability, ensuring data is shared regularly and publically in a machine readable format.

Support to KIPH would likely include the following elements:

• Root cause analysis to determine the factors that drive KIPH’s data analysis and communication capacity;

• Sustainably improve KIPH performance through change management

• Greater communication and coordination between KIPH and KEPA/KHMI about data needs, and improving

KIPH’s capacity to use environmental data to identify risks, prevent disease and the health consequences of environmental hazards. This may include identifying data sets within KIPH and the Ministry of Health that may be directly connected to environmental pollution, such as hospitalization rates for pulmonary related problems on days when air pollution levels are hazardous. When possible this data will be disaggregated by sex and different population subgroups.

In addition, in order to foster a constructive, collaborative relationship with civil society, media representatives (digital, paper, television and radio), educational, or civil society organizations, the project will organize trainings on how to interpret, analyze, and present data about environmental pollution. Efforts will be made to ensure participation of women’s civil society organizations and those of social minority groups.

ACTIVITY 3: OPEN DATA CHALLENGE

As noted above, technical assistance for this Activity is being supplied through a separate procurement.

It should be noted that this activity is expected to engage civil society with data sets made available through the judicial information and environmental data activities. The aim is for civil society to influence and build the culture of data sharing and data driven decision-making in GoK institutions.

B. KEY IMPLEMENTING PARTNERS AND STAKEHOLDERS

Various ministries, independent agencies and other entities are envisioned as beneficiary institutions and program partners, each contributing to design and implementation of the Activity addressed in this TOR. Below is a list of the primary institutional participants, which may grow as root cause analysis identify influencing stakeholders or as data sets unlock opportunities for others to be involved.

The Kosovo Environmental Protection Agency, will be a primary recipient of overall performance support and program technical assistance to effectively monitor and report on environmental indicators to stakeholders. Within KEPA, the

KHMI will be strengthened to collect this data, and expand collection to include all air quality indicators in all geographies, through assessments and support to maintaining and calibrating monitoring equipment. The program will improve KEPA’s environmental data management platform and reporting ability, ensuring data is shared regularly and publically in a machine readable format.

The Ministry of Environment and Spatial Planning, under which KEPA and KHMI sit, will be involved on a policy and decision-making level. The program will also support greater coordination between KEPA and the Kosovo Institute of

Public Health, which collects some data related to environmental pollution. The program will work closely with the

Municipality of Pristina, and potentially other municipalities that have the necessary equipment, to collect data that can feed into their energy efficiency plans and periodic reports to KEEA.

The Kosovo Open Data Challenge activity will fund creative ideas about how to use, analyze, and present data to support government’s analytical and public communication needs, thus promoting constructive relationships between the government and civil society. The activity will benefit the institutions mentioned above, and potentially other relevant ministries, with improved quality and availability of judicial, environmental, and labor force data. The recipient individuals and organizations will help the government share existing data and formulate additional needs.

C. Threshold Transparent and Accountable Government Project Logic

The CT has identified the problem as the fact that civil society and NGOs cannot engage constructively with the GoK due to lack of publically available data and adequate outreach. This leads to a perception of poor government performance, part of which is based on reality, and undermines investor confidence. The objective of this project is to improve the analytical use of publically available judicial and environmental data by civil society and NGOs through data transparency activities. This may logically address the inability of civil society to constructively engage with the government. As a first step, public perception must align with the reality of public performance.

The creation of a public judicial portal will support improved quality and readiness of judicial decisions for publication on the internet, and allow judicial accountability to the public. Regularly produced, machine readable Environmental Data on the internet as well as the open data challenge activity will make data available to the civil society and NGOs. This will support critical analyses and use of key statistics of judiciary performance by users of the public system (journalists, NGOs). There may be an opportunity for government officials to use these analyses in policy related decision-making.

With additional support to the communication capabilities of select ministries and agencies to conduct outreach with civil society, as well as each other, greater trust and collaboration is expected to be fostered between civil society and government stakeholders to produce creative solutions to respond to government needs. This should contribute to an improvement in the perception of government function and improved investor confidence. This theory of change is contingent upon the scale and adoption of the data transparency culture, and therefore the higher order outcomes may be modest. Note that this project logic is expected to evolve, with much greater detail about expected results, as part of the

Contractors’ work during project design. The specific results expected to be achieved by the implementing entities, and how they are expected to be achieved, should be clearly specified in their TORs.

D. Monitoring and Evaluation Requirements

As the Contractor engages in project design for the above activity, the Contractor will be expected to document this design and the information on which design decisions are based: this forms the foundation for the Threshold’s Monitoring

& Evaluation (M&E), and drives the description of the potential tasks below.

Ultimately, the M&E strategy for the Threshold program will be developed by MCC to support two objectives derived from MCC’s core principles: accountability and learning. Accountability refers to MCC’s obligation to report on their activities and attributable outcomes, accept responsibility for them, and disclose these findings in a public and transparent manner. Learning refers to improving the understanding of the causal relationships between interventions and changes in poverty and incomes.

Possible tasks that may be requested of the Contractor in regards to M&E may include:

1. Based on the problem the project is meant to solve (detailed above) and the rationale behind the proposed project design, document the project logic linking each proposed MCC investment activity or sub-activity to the main objective of the project, (detailed above) and the ultimate MCC goal of “Poverty Reduction through Economic

Growth”. This should include an articulation of risks and assumptions, and, should certain risks materialize, possible alternative pathways the MCC activity could take to still achieve its results. This SOW lays out the

Country Team’s current thinking on the project logic, but this is expected to evolve into much greater detail as part of the project design, through the work in this SOW. Such evolutions must be documented by the Contractor.

(Possible Deliverable: Project Logic diagram and narrative).

2. Identify meaningful process, output and outcome indicators to track the progress of activities and the achievement of results along the progression of the project logic1. Each result in the project logic must have an operational definition as an indicator. Indicators should be useful to the project implementers, for tracking their progress towards results. Determine the baseline values for these indicators. If using country-provided baseline metrics, validate the values. Include any historical data, if available. Provide annual targets for these indicators for the four years of the Threshold. For results expected to manifest after the Threshold period (higher level indicators), provide annual target values post-Threshold for as long as relevant, up to 20 years. These post-

Threshold targets will serve as the basis for MCC’s independent evaluation work. (Possible Deliverable:

Indicators Table, including for each indicator: name, unit of measurement, definition with any additional notes or guidance, disaggregation, proposed source of data, proposed reporting frequency, baseline value, annual target

(for the 4 years of the Threshold, and post-Threshold if relevant)

3. Assess the quality and availability of existing data from the relevant utilities or institutions in Kosovo to track all indicators. Where gaps exist, provide actionable and cost-effective recommendations to either newly collect data that does not exist or improve the quality of data this is already collected. The goal is to collect timely, reliable and quality data both throughout the Threshold (to track project implementation) and post-Threshold (in order to assess results). As the tracking will likely continue post-Threshold for purposes of project evaluation, after MCC has left the country, is important that these systems are built to be self-sustaining within the relevant

Kosovar institutions. These recommendations should include any infrastructure or equipment, associated works or institutional capacity building that will be necessary components of the MCC investment in order to track progress of the indicators. In such cases, estimate the cost, and provide technical specifications to be included in the implementation entities’ TOR. (Possible Deliverable: Narrative assessment of the quality and availability of existing data, followed by recommendations to newly collect or improve collection of the necessary data to track the indicators both during and after the Threshold.)

C5. REQUIRED RESOURCES

MCC’s Human and Community Development (HCD) Practice Group includes experts in behavior change, education, health and WASH programming and is the MCC practice group procuring the services requested in this SOW. The MCC

Kosovo team includes specialist from MCC Practice Groups including: Monitoring and Evaluation, Gender and Social

Inclusion (GSI), Environment and Social Protection (ESP), Finance and Administration, Procurement, Finance, Industry and Trade (FIT), and Energy. Contractors should consider, as they propose their team that both MCC and the Kosovo

Country team will have expertise in the areas mentioned above and their proposed team should be focused on the specific skill requirements listed below. Practice Groups in MCC, such as GSI, ESP and Energy will also be procuring oversight and due diligence technical assistance to support the Kosovo Country Team to design and implement the Threshold program and resources need not be duplicated.

The contractor will be requested to mobilize on a very short notice – MCC requires a rapid mobilization for this contract.

Proposed key personnel must be available to start working on the contract implementation from the time of award.

The team should include at a minimum the following illustrative list of key personnel members:

1) Environmental Data Team Leader

2) Environmental Policy, Monitoring Systems and Information Management Specialist

3) IT Specialist - web design and user-friendly interface design and upkeep

4) Air monitoring systems and equipment specialist

5) Environmental Health Specialist

6) Behavior Change, Communication Outreach, Adult Education and Training Specialist

All positions do not require full term employment, they are intermittent and focused based on the SOW requirements.

MCC requires consultants, expatriate or locally recruited in-country personnel, to carry out the activities described above.

The contractor can use the above illustrative list of consultant titles and qualifications or propose alternative titles and qualifications, considering that a maximum of six key technical staff is permitted. Applicants are encouraged to identify consultants with multiple areas of expertise. For example if the applicant can identify an Environmental

Institutional Policy Specialist who is also an expert in the Health Effects of Environmental Pollution, they are encouraged to combine the positions. To the extent that additional personnel representing other disciplines are needed to carry out any of the tasks outlined above, the Contractor must present for MCC’s approval both the qualifications and billing rates for such new personnel. For each position proposed, responses should include a description of the professional and technical qualifications necessary for satisfactory performance of required services, specialized experience and technical competence in the type of work outlined in the SOW. Contractor may also propose more than one person for the position, a combination of two people, to enhance the professional skills, however the LOE in this case is limited to this particular position.

The Environmental Data Team as a whole should have the following experience or skills:

Experience with organizational assessment, coaching, facilitation, and change management

Experience with environmental institutional and policy reforms, focusing on dissemination of environmental quality information and use of data to drive decision making.

Experience in strengthening institutional capacity to interact transparently with civil society – especially in government ministries. This includes institutional assessment, job descriptions, training using adult learning methodologies.

Knowledge of challenges faced by ministries of environment, public health and others in developing countries, such as institutional capacity building, information management and dissemination, fact-based decision-making and cost analysis.

Experience developing and/or implementing environmental quality monitoring systems in developing countries – preferably in the European context.

Practical technical experience (on-the-ground experience) in setting up air quality monitoring systems – including equipment selection, procurement, installation, operation, maintenance – with a focus on wireless data transfer capabilities.

Practical technical experience with water and land quality monitoring systems is desirable, but not required.

Experience developing, designing, assessing and implementing projects and activities related to environmental quality monitoring and management and dissemination of environmental data, analysis and reports to institutional and civil society audiences.

Experience with information technology and web design, preferably with water and air quality monitoring data, analysis and reports.

Specific experience in strengthening environmental information management systems that interface with government and civil society.

Experience in facilitating government and civil society interactions around fact based environmental and public health decision-making.

Knowledge of how to organize trainings and develop content on environmental pollution data interpretation, analysis and presentation. Experience managing trainings for media representatives desirable.

Experience assessing hazardous environmental agents and recommending protective interventions, guidelines, laws and/or regulations that control hazards to health. Experience supporting the design of environmental data project monitoring and evaluation technical assistance, including development of detailed project logics, associated operational indicators to track results, data collection, data analysis and reporting. Ability to assess the quality of reported environmental data.

Experience with participatory methodologies, with designing communications strategies and campaigns, and capacity building programs targeting particular demographic groups like women is desirable.

Experience analyzing and addressing gender inequalities in the environmental sector desirable.

All team members should be fluent in English. Proficiency in Albanian or Serbian is desirable.

The contractor should take into consideration the following international trips to Kosovo. MCC anticipates this travel schedule as outlined in the table below, but does not guarantee the above travel schedule as it may increase or decrease. The Contractor should propose the trips required to meet the objectives of this SOW.

C7. CONFLICT OF INTEREST

In accordance with the principles of FAR Subpart 9.5 and MCC policy, the Contractor shall be ineligible to furnish, as a prime or subcontractor or otherwise, implementation services which result in response(s) to findings, proposals, or recommendations written by the Contractor, unless this provision is expressly waived by MCC.

The contractor and its subcontractors would be precluded from bidding on work and services to be procured by the local

Accountable Entity or using funds advanced under a Compact in the relevant country, unless the contractor submits a mitigation plan sufficient to ameliorate any conflict of interest pursuant to the rules applicable to the procurement process.
