About this file
This is a Justification and Approval (J&A) document for a non-competitive multiple award contract action issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD).
The contracting activity seeks to award Firm Fixed Price contracts to three responsible sources: Atlantic Diving Supply, Inc. (Small Business), Point Blank Enterprises, Inc. (Large Business), and Integris Composites, Inc. (Small Business) for the procurement of Maritime Buoyant Plates (MBPs) in four sizes (Small, Medium, Large, and X-Large) for use by U.S. Navy Afloat Forces in support of Antiterrorism Force Protection and Visit, Board, Search and Seizure missions. The estimated delivery date is 120 days after award. The procurement utilizes FY25 Other Procurement Navy (OPN) funds.
The J&A invokes 10 U.S.C. 3204(a)(1) and FAR 6.302-1(a)(2)(ii)(A)(B) (only one responsible source) to justify limiting competition to these three vendors. The rationale centers on NSWC PCD's designation as the in-service engineering agent for the USN MBP and the three contractors' prior successful completion of first article testing under 2020 indefinite delivery/indefinite quantity contracts (N61331-20-D-0015, N61331-20-D-0013, and N61331-20-D-0011). The document estimates that duplicating testing and competitive efforts would incur substantial costs and cause approximately two years of unacceptable schedule delays. A Sources Sought notice (N61331-25-SN-Q24) was published April 2-15, 2025, and a synopsis ran April 18-May 2, 2025. Two additional vendors responded but were deemed not capable due to insufficient technical capabilities and lack of first article test approval. The Contracting Officer has determined anticipated costs to be fair and reasonable.

4. Statutory Authority Permitting Other than Full and Open Competition.
10 U.S.C. 3204(a)(1) FAR 6.302-1(a)(2)(ii)(A)(B) – Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The Maritime Buoyant Plate (MBP) is a critical safety item
NSWC
PCD is designated as the in-service engineering agent for the USN MBP by NAVSEA PMS 408.
In 2020, NSCW PCD competitively awarded the following indefinite delivery, indefinite quantity contracts under a multiple award contract:
Atlantic Diving Supply, Inc. – N61331-20-D-0015
Point Blank Enterprises, Inc. – N61331-20-D-0013 Integris Composites, Inc. – N61331-20-D-0011
. The duplication of costs and unacceptable delays to the schedule are estimated to be and 2 years. These costs and time consumption are not expected to be recovered through duplicating the testing and competitive efforts.
Therefore, it is more advantageous to the Government to competitively award multiple contracts from a limited number of responsible sources.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Sources sought notice number N61331-25-SN-Q24 was published on 2 April 2025 through 15 April 2025 on the Government Point of Entry, SAM.gov, per DFARS PGI 206.302-1. In addition, the proposed contract action was synopsized from 18 April 2025 through 2 May 2025, per FAR 5.203(a). The four sources listed under paragraph two responded to these announcements. Two additional business entities responded ( but were deemed not capable based on assessed technical capabilities not meeting the minimum requirements and lack of first article test approval for the USN MBP in additional to the substantial duplication of costs and unacceptable delay discussed above. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than the four businesses listed in paragraph two to provide the required equipment.
7. Determination of Fair and Reasonable Costs.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NSWC PCD has no plans at this time to solicit future contracts solely for first article test production for the USN MBP but does plan to make available for competition future requirements amongst the specified sources in paragraph two.
