About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for the U.S. Coast Guard to procure waterjet propulsion parts from Marine Jet Power as the sole source vendor. The procurement supports multiple 26' Over-The-Horizon (OTH) IV vessels, with the parts being critical for vessel safety and operational capability. The justification cites 10 U.S.C. § 3204(a)(1) as the authority, specifically noting that Marine Jet Power is the only responsible source capable of providing these specialized parts due to their exclusive possession of technical drawings, manufacturing specifications, and proprietary design information.

The document details that alternative vendors cannot provide equivalent parts without potentially requiring fabrication, which could compromise vessel performance and safety. Marine Jet Power is identified as the Original Equipment Manufacturer (OEM) with sole access to critical technical data necessary for proper part reproduction. The Contracting Officer's Representative (COR) will continue conducting market research to potentially identify alternative vendors for future acquisitions, but currently, Marine Jet Power remains the only viable source for these specific waterjet propulsion parts supporting Coast Guard vessels.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT

WILL MEET THE GOVERNMENT’S REQUIREMENT.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE. The brand name purchase of various waterjet propulsion parts. The parts are in support of the 26’ OTH IV. Vessel: Multi. (See Enclosure 1). The various waterjet propulsion parts are provided by Marine Jet Power, the Original Equipment Manufacturer (OEM)

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. The technical data for the various waterjet propulsion parts required to make an accurate assessment of equal or alternate equipment meeting the Coast Guard’s performance, fit, form and function requirements for this procurement is unavailable. The proper operation of the above parts is critical for the safety of both crew and vessel alike, especially during underway operations, where propulsion is of the utmost importance. Failure of the various waterjet propulsion parts would place a unit in a hazardous situation with the loss of maneuverability, possibly placing the vessel in a flooding situation. Any attempt to manufacture this item without the proper (OEM) parts and access to OEM reproduction manufacturing drawings, spec, tolerances/parameters, test procedures and other relevant information, could lead to major mission degradation. Therefore, all replacement parts offered shall be only “official brand” (OEM) parts.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). Researched the Internet for vendors available to provide the various waterjet propulsion parts, Marine Jet Power, is the suggested source that can provide the various waterjet propulsion parts installed. Searched for other vendors capable of supplying the various waterjet propulsion parts.

While other vendors produce various waterjet propulsion parts, to deviate from the installed brand may require fabrication upon installation.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

Marine Jet Power is the suggested source that can provide the various waterjet propulsion parts to support the installed equipment.

Marine Jet Power is the sole possessor of the drawings and other technical information required to properly manufacture the various waterjet propulsion parts. Another vendor’s parts may not contain the same fit, form and function. The installation of Marine Jet Power parts will ensure the continuity and configuration of the various waterjet propulsion parts installed at Coast Guard units. The Coast Guard does not have any technical information to deviate from the parts installed; another vendor’s offer may lead to fabrication being necessary for installation.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. This is a proprietary commercial item of the proposed contractor. The reproduction of manufacturing drawings, specifications and other technical data related to this item were never purchased by the U.S. Coast Guard and therefore are controlled by and remain the sole property of the OEM.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. COR will continue to conduct market research in the attempt to locate vendors that can satisfy the needs of the Coast Guard including a requirement for manufacturer’s engineering drawings, detailed parts lists, design or testing procedures, and other relevant information concerning this item.
