The total estimated value for this requirement is $97,420 for NetApp annual subscriptions. Operations and

Maintenance (O&M) funds will be used.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS

BASED ON THE FOLLOWING (select all that apply):

1. ___ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

a) ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

b) ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the

Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

c) ___ OTHER REASONS.

2. _X_ BRAND NAME. Item required must be a brand name, product, or feature of a product, particular to one manufacturer.

All DON organizations and program offices are mandated to use the Department of the Navy’s (DON)

Enterprise Software Licensing (ESL) Agreements in accordance with the DON memo, “Mandatory Use of

DON Enterprise Licensing Agreement,” dated 22 FEB 2012. A DON ESL Agreement for NetApp was established with NASA Solutions for Enterprise-Wide Procurement (SEWP) on 27 MAR 2019. NetApp support is available from multiple small business sources under SEWP, which is a multiple-award

Government-Wide Acquisition Contract (GWAC) vehicle that focuses on commercial Information

Technology (IT) products and product based services.

In accordance with FAR 16.505(a)(4)(i), a brand-name specification is required because the NetApp products are essential to the Government’s requirements and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs. NetApp is currently in use by FSB and is the required solution to meet the Marine Corps’ cloud storage and data management needs.

Based on FSB’s research, it is less costly in terms of product cost and man hours to procure continuing support than it would be to replace the current system and retrain engineering personnel to use it effectively. Specifically, the original contract to obtain the NetApp hardware had a total contract value of

$2,476,208.81 over a four (4) year period ($619,052.20 per year). The estimated replacement costs for a new storage and data management system would be around the same price; however, it would also require additional expenses to cover support and training. For training, up to ten (10) engineers would need to take up to 40 courses per year at $3,000.00 per course, which is a total of $1,200,000.00 annually. Additionally, specialized engineering services would need to be procured on a yearly basis at about $150,000.00. Thus, the annual cost to remove, install, and support a new system could exceed $1.9 million per year.

Continued support from NetApp would include replacements for any equipment failures and would greatly assist Marine Corps engineers in resolving unfamiliar issues. Without the continued NetApp storage solution, the existing equipment will degrade, which would negate any cost savings realized by investing in this system.

3. ___URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
