About this file

This document is a Justification and Approval (J&A) for other than full and open competition for a sole source contract award to MSI for the sustainment of the VESTA emergency response system.

The J&A explains that replacing the existing VESTA system would result in substantial duplication of costs of over $, including delays of over 2 years to obtain a new cybersecurity authorization. MSI is the only vendor able to fully support the VESTA system sustainment, maintenance, and configuration control. Introducing a new contractor would jeopardize interoperability and functionality, degrading emergency response capabilities. The total estimated cost to replace the VESTA system is $, which is not expected to be recovered through competition. As a result, the Marine Corps is justifying a sole source award to MSI for VESTA-Sustainment Contract M67854-24-C-4908.

Text version

Code-2.4 J&A No. 23,353 cyber, operations, sustainment, and maintenance support costs averaging annually (or over a four-year period of performance).

Replacement of the entire system at 13 installations would result in the Government incurring a substantial duplication of cost that would not be recovered through competition. In addition to the estimated E911 system replacement cost , award to any other source would also result in a substantial duplication of costs associated with delays and rework estimated at more than as follows:

a. Replacement of the current system would result in unacceptable delays because replacing the hardware and software provided by MSI would cause a deviation in the approved cybersecurity baseline, thus invalidating the Authority to Operate (ATO). The estimated time required to obtain a new cybersecurity baseline and ATO is projected to take more than two years. Additional funding would also be required to account for cybersecurity testing in support of a new ATO. Qualifying a new baseline would require the Government to complete additional Functional Verification Testing, a System Verification Review, a Non-developmental Item Integration Review, a Test Readiness Review, a System Qualification Test, and Cyber Certification and Accreditation (producing a new ATO to the US Navy Public Safety Network). This new baseline and new ATO would contribute duplicative costs of at least that will not be recovered through competition.

b. The continuity of connection and maintenance for all VESTA components ensures

Emergency Response Services and missions will not be compromised. MSI is the current maintainer of the VESTA system. In August 2023, the Government conducted market research via a Request for Information (RFI). Based on the responses received, MSI was the only vendor who provided a solution that could fulfill the Government’s requirement. No other vendor provided a solution indicating that they could solely and fully support VESTA Sustainment, to include delivery of the necessary maintenance, support, and sustainment of the equipment and components for the Marine Corps. Introduction of another contractor would jeopardize interoperability and functionality, resulting in degraded life-safety capabilities, further increasing the cost to the Government of for life cycle sustainability, maintenance, configuration control, and engineering support.

Overall, the current system replacement cost is estimated to be in quantifiable costs and in duplicative costs. The total cost to replace the existing E911 system is , not expected to be recouped via competition. Additional costs associated with system downtime, degradation of response dispatching and communications abilities, and decreased effectiveness of first responders, while not quantifiable, increase the cost of system replacement to an unacceptable level.
