WSTIFICATION AND APPROVAL (J&A)

IN REPLY REFER TO:

Code: CT-2.5 J&A Number: 19-028.1

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

Marine Corps Systems Command (MARCORSYSCOM) Program Manager, Supply and Maintenance Systems 2200 Lester Street Quantico, VA 22134-6050

2. Description of the Action Being Approved

The use of other than full and open competition to procure systems to fully test and analyze lubricants and hydraulic fluids for contamination, degradation, and ferrous debris. Specifically, this action is for negotiation and subsequent award of an Indefinite Delivery, Indefinite Quantity (IDIQ) firm-fixed price contract for an Expeditionary Fluid Analysis System (EFAS) to

3. Description of Supplies/Services

The proposed contract action is to procure systems to fully test and analyze lubricants and hydraulic fluids for contamination, degradation, and ferrous debris. The EF AS system possesses two echelons, or tiers, of capabilities. EF AS Tier I performs basic fluid analysis while EF AS Tier II perfmms comprehensive analyses and can detect potential machine wear and degradation.

This contract will procure all Tier I and II analyzer sets and ancillary items required to meet the EFAS materiel requirement. The EFAS AAO is 119 (Tier I) and 20 (Tier II) analyzers. This contract will also procure all logistical support items for the operation and maintenance of the EF AS to include technical manuals, training and training materials.

The estimated dollar value for this procurement is approximately utilizing PMC funding as detailed below:

FY19 FY20

FY21 FY22

FY23 TOTAL

The contract will have five one-year ordering periods from date of contract award.

Code: CT-2.5 J&A Number: 19-028.1

4. Statutory Authority Pe1mitting Other Than Full and Open Competition

The statutory authority pe1mitting the use of other than full and open competition is 10 U.S.C. § 2304( c )(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements".

5. Rationale Justifying Use of Cited Statutory Authority

Based on market research, the Government has concluded that is the only known responsible vendor that possesses the full technical capability to meet the Government's requirement for EFAS. The details of the market research are contained in the EFAS Market Research Rep01i of 4 May 18.

Market research has shown that although there are various vendors capable of manufacturing commercial fluid testers, only ; (1) makes products that can be readily operated in a field environment to enable fluid analyses on the vehicle (i.e., at the platform level); (2) are battery powered, and (3) can be transp01ied in hardened, man-portable transit cases. Commercial products made by other manufacturers are primarily large floor model analyzers for use in laboratories or workshops and are neither ruggedized nor man-portable. A man-p01iable, ruggedized, and battery powered fluid analysis system that can operate in a field environment is a key Government requirement.

The alternative to pursuing the commercial analyzers offered by would require a comprehensive developmental eff01i, adding 48 months to the program schedule while adding to the overall cost.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

In an effort to solicit offers from as many offerors as possible, the Government posted a Request for Info1mation (RFI) no. M67854-18-I-5116) on Federal Business Opportunities (FedBizOpps) on March 7, 2018 with the purpose of not only seeking potential sources, but also looking for best practice information regarding p01iable systems to supp01i at-platform fluid testing.

The RFI was also forwarded via email to multiple vendors who specialize in manufacturing and/or distributing fluid analysis hardware. was the lone respondent to the RFI. A subsequent industry day was held in on April 4, 2018.

was the only participating company at the industry day.

No additional market research was conducted because it is not practicable for the reasons discussed in paragraph 5 above.

Additionally, this requirement was synopsized on FedBizOpps on October 10, 2018. This announcement expressed the Government's intent to award a contract on a sole-source basis to

. No interest or responses have been received to date.

Code: CT-2.5 J&A Number: 19-028.1

7. Determination of Fair and Reasonable Cost

The Contracting Officer with the assistance of the Program Manager, Supply and Maintenance Systems, will ensure all supplies and services ordered under this contract are procured at a fair and reasonable cost in accordance with FAR 15 .404-1. The Government Cost Estimate will also serve as a cost comparison point for negotiations with the vendor.

8. Actions to Remove Baniers to Future Competition

For the reasons set forth in Paragraph 5 above, MARCORSYSCOM has no plans at this time to compete future contracts for the types of supplies/services covered by this document. As future requirements are further refined, competitive procurements will be considered.
