About this file

This pre-solicitation notice describes a sole-source contract opportunity for Contractor Engineering Technical Services (CETS) support for the Kuwait Low Altitude Surveillance System (KLASS). The U.S. Marine Corps Program Executive Officer Land Systems intends to award a 5-month contract to TCOM, Limited Partnership in the third quarter of fiscal year 2025, with an estimated award date of 14 May 2025. The contract requires a specialized team providing 24/7 support with specific technical roles including Flight Directors, Logistics Specialists, Electronics/Radar Specialists, Aerostat/Mechanical Specialists, and a Training Specialist.

The government is pursuing a sole-source acquisition because TCOM L.P. is deemed the only company capable of providing CETS support, based on their proprietary intellectual property rights for the 71M® aerostat system. The contract's unique requirements include highly specialized training, access to technical data, and the need for comprehensive technical expertise that other vendors cannot replicate. The acquisition will be executed under the statutory authority of 10 U.S.C. 3204Ac(a)(1), with inquiries to be submitted to Sheila McCreery and Richard Danyliw at their USMC email addresses.

PRE-SOLICITATION NOTICE

29 April 2025

Contracting Office: M67854: 2200 Lester Street, Quantico VA 22134

Classification Code: R -- Professional, administrative, and management support services

Subject: Kuwait Low Altitude Surveillance System (KLASS)

Solicitation Number: M67854-18-C-2018-P00055

Closing Date: 14 May 2025

Point of Contract: Sheila McCreery, sheila.mccreery@usmc.mil

Description:

THIS SYNOPSIS IS FOR INFORMATIONAL PURPOSES ONLY. The Program Executive Officer Land Systems (PEO LS), Marine Corps, Quantico, VA 22134 intends to enter into sole source negotiations and subsequently award a contract to TCOM, Limited Partnership (TCOM L.P.) – 7115 Thomas Edison Drive, Columbia, Maryland, 21046-2116 (CAGE Code: 0J6J5). This effort is estimated for award in the third quarter of fiscal year 2025 with an approximate period of performance of 5 months.

The anticipated contract is for the procurement of Contractor Engineering Technical Services (CETS) support for the Kuwait Low Altitude Surveillance System (KLASS).

The contract will provide the support necessary for operation and maintenance of the KLASS by providing a team of specialized personnel, with extensive subject matter experience, providing 24-hour, 365 days per year support. The Letter of Offer and Acceptance (LOA) under which this effort will be executed, KU-P-GHZ, identifies the requirement for a CETS team with the following capabilities: Flight Directors certified in 71M® aerostat flight operations; Logistics Specialist responsible for site logistic support activities; must also be winch-certified to conduct aerostat in-haul and out-haul operations; Electronics/Radar Specialists responsible for maintaining all aerostat payload electronics, including the TPS-63 Solid State Radar, and the flight operations center, weather radar, wind profiler, and other electronic ancillary equipment; Aerostat/Mechanical Specialists responsible for maintaining the aerostat flex structure, mooring station, helium storage and purification equipment, motor generators, maintenance support equipment, and other ground support equipment;

and, Training Specialist responsible for all formal and informal on-site training for aerostat operations and maintenance.

The Government has determined that TCOM L.P. is the only company capable of providing CETS support for the KLASS. The ability to provide CETS support for the KLASS systems requires highly specialized training and experience and is dependent on access to the technical data resulting from TCOM L.P.’s intellectual property rights for the 71M® aerostat and its associated subsystems. As the original equipment manufacturer (OEM), the KLASS 71M® aerostat is a proprietary design held by TCOM L.P. All design, maintenance, and supporting documentation are the intellectual property of TCOM L.P. The Government possesses insufficient data rights for those materials to support a competition. For a contractor other than TCOM L.P. to provide CETS support for the KLASS, the Government would be required to procure and provide the selected vendor with a comprehensive Technical Data Package (TDP). TCOM L.P. possesses sole proprietary rights to the KLASS TDP and will not allow access to third party vendors; therefore, PEO LS is unable to provide the associated technical data necessary to foster a competitive procurement.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C. 3204Ac(a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(A) “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement.” Unless stated herein, no additional information is available. Requests for the same will be disregarded. A sources sought request for information for this requirement was previously issued on SAM.gov under Notice ID M67854-25-I-0112.

GENERAL INFORMATION: The information provided herein is subject to change and is not binding on the USG. The USG has not made a commitment to procure any of the supplies or services discussed. This notice should not be construed as a commitment or as authorization to incur cost for which reimbursement would be required or sought.

Any inquiries to this notice shall be submitted to both Sheila McCreery at sheila.mccreery@usmc.mil and Richard Danyliw at richard.danyliw@usmc.mil .

Please reference the announcement number on all correspondence. Telephone calls will not be honored.
