Total by FY $9,285,964 $9,582,422 $9,889,258 $10,206,831 $10,535,525 $49,500,000
4. Statutory Authority Permitting Other Than Full and Open
Competition
The statutory authority permitting use of other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented in Federal
Acquisition Regulation (FAR) 6.302-1(b)(1)(i), “Only One Responsible
Source and No Other Supplies or Services Will Satisfy the Agency
Requirements.”
5. Rationale Justifying Use of Cited Statutory Authority
The prior BOA for Testing and Engineering Technical Support Services
M67854-12-G-0202 was awarded on a sole-source basis to NATC on 01
March 2012. NATC offers an extensive range of automotive engineering and testing services for both commercial and military vehicles and component manufacturers, to include ballistic testing and rapid prototyping. NATC’s automotive, heavy-truck, and military vehicle testing facilities encompass virtually all driving conditions found in the world and maintain access to 85% of the world’s soil types and terrain features within a 150 mile radius. NATC’s facilities also include a dedicated winter test facility at West Yellowstone, MT, and that is the only known facility to offer test ranges which replicate the severity of the Marine Corps Operational Mission profile.
Based on the Market Research report dated 31 January 2017, the
Government has determined that NATC is the only commercial engineering and testing facility with the capability to provide the Marine Corps with all-inclusive services to assist in designing, modeling, fabricating, building and testing prototype vehicles or upgrades to legacy vehicles. In addition, NATC is the only commercial test facility that can perform automotive and durability testing over naturally occurring terrain with the severe roughness that is representative of the Marine Corps Operational Mission Profile with
Root Mean Square values of .1 to 4.8 coinciding with the upper design limits that Marine Corps Ground Vehicles are designed to perform to.
To obtain the same level of capabilities and support, the Marine Corps would be required to parcel out the design, modeling and simulation, and prototype build to a Government facility/activity or to private industry and then rely on another Government or commercial test facility to conduct the actual testing. The testing at these other facilities, either Government or contractor owned, would be limited to their established test courses and not fully representative of the extreme conditions required of the Marine Corps Operational Mission
Profile.
NATC is the only known responsible source that can satisfy the
Agency’s requirement for testing legacy and prototype upgrades over the entire Marine Corps mission profile. Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The costs associated with conducting these efforts at separate locations would increase task order costs by a range of 15% to 77% with an average of
48% and would add risk to accomplish these efforts within the desired schedule parameters, unreasonably leading to unacceptable delays in fulfilling Marine Corps requirements.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
In accordance with FAR 5.201, the proposed action was synopsized on the FEDBIZOPPS website on 13 March 2017, describing the Government’s intent to issue a Basic Ordering Agreement to NATC on a sole source basis. No potential Offerors or sources responded to this announcement expressing an interest that can meet the Government’s requirement.
PEO LS has also reviewed technical publications and contacted knowledgeable individuals in the Government and industry regarding companies in the market with the capabilities to meet these requirements. It has been determined that there is no existing DoD contract that will satisfy this requirement nor are the required services available under an existing non-DoD contract.
7. Determination of Fair and Reasonable Cost
In accordance with FAR 15.402, Pricing Policy, the Contracting Officer will ensure that the services covered by this (C)J&A are procured at a fair and reasonable price using Independent Government Cost Estimates
(IGCE), cost and price analysis, prior similar contracts, historical pricing data, audits, and other means as deemed necessary. In accordance with FAR 15.404-1, the Contracting Officer will perform a price analysis at the task order level to evaluate the reasonableness of the offered price or cost analysis to evaluate the reasonableness of the individual cost elements of the Contractor’s proposal.
8. Actions to Remove Barriers to Future Competition
For reasons set forth in paragraph 5, PEO LS has no plans to compete future requirements for the services covered by this document. If another potential source emerges, PEO LS will assess whether competition for future requirements is feasible. Any future actions will be reviewed by PEO LS to offer competition to the greatest extent possible.
