LIMITED SOURCES JUSTIFICATION AND APPROVAL

1. Contracting Activity

Marine Corps Systems Command

Information Systems and Infrastructure (ISI), Contracts

Information Technology Strategic Sourcing (ITSS) Product

Management Office (PdMO)

2200 Lester Street

Quantico, VA 22134-6050

2. Nature and/or Description of the Action Being Approved

This acquisition is conducted under the authority of the

Multiple Award Schedule Program under Title III of the Federal

Property and Administrative Services Act of 1949. This justification is to seek approval of the use of limited sources under FAR Part 8.405-6(b). The proposed action is for the use of a brand name specification in the procurement of subscription entitlements for brand name Red Hat Linux Enterprise Operating

System (O/S).

3. Description of Supplies/Services

The proposed contract action is to procure 140 Red Hat

Enterprise Linux for Datacenter subscriptions and 26 Red Hat

Enterprise Linux subscriptions for Marine Corps Enterprise

Information Technology Services (MCEITS). Red Hat Enterprise

Linux subscriptions are mandated by paragraph 3.A.1.D of

USCYBERCOM TASKORD 12-0603.

Red Hat is an open source O/S that is free to use, but requires a support subscription entitlement in order to maintain and update the O/S. Paragraph 3.A.1.D of USCYBERCOM TASKORD 12-0603 requires that all DoD services procure Red Hat subscription entitlements for each MCEITS server used in the enterprise deployment of the tool. These subscriptions provide maintenance that includes security patches, certifications, accreditations, and technical support. Failure to maintain Red Hat with the required subscriptions will ultimately result in the loss of the ability to use MCEITS, which in turn will result in an inability to identify configuration vulnerabilities creating an unacceptable risk to the security of DoD computer systems.

The estimated dollar value for this procurement is $699,282.00 and two option years. The period of performance required is for one (1) year from date of contract award. FY14 PMC funds will be used to fund the base year.

4. Identification of the Justification Rationale

The authority permitting the limitation of sources to items peculiar to one manufacturer is FAR 8.405-6(b).

In order to comply with MARADMIN 426/13 and SECNAVINST 5230.15, 140 Red Hat Enterprise Linux for Datacenter subscription and 26

Red Hat Enterprise Linux subscriptions must be acquired. The subscriptions required to maintain the Red Hat O/S are sold by multiple third-party resellers and in accordance with the requirements of DFARS 208.74, will be procured via the DoD

Enterprise Software Initiative (ESI) Blanket Purchase Agreements

(BPAs).

The one (1) year base and two (2) option year supports are needed to ensure the vendor support necessary to maintain network services in operational status.

5. Determination of Best Value

The Contracting Officer will ensure that the order represents the best value to the Government, in accordance with FAR

8.404(d). Quoted prices provided by authorized resellers will be compared to other price quotes received in response to the solicitation, and all quotes will be compared against the

Government’s Independent Government Cost Estimate. Further, the

Contracting Officer will seek additional discounts where possible.

6. Description of Market Research Conducted

In accordance with the Better Buying Power 3.0 memo, “Promote

Effective Competition,” market research was conducted by the

Marine Corps Enterprise Information Technology Services (MCEITS)

Project Officer using the DoD ESI website. Further, market research indicates that the required subscriptions are available from multiple resellers via the DoD ESI program where DoD has pre-negotiated BPAs with favorable terms and pricing. In accordance with DFARS 208.74, DFARS PGI 208.7403, and associated ordering procedures, the required subscriptions will be obtained via the DoD ESI BPAs.

7. Other Facts Supporting the Justification

Department of Defense Instruction (DoDI) 8500.2 requires hardware and associated software support and maintenance to sustain compliancy in an Information Assurance (IA) accredited environment. Red Hat software support is required to sustain compliancy.

The Red Hat Linux Server Standard Support is required for the deployment of MCEITS. The subscription services are required to maintain and update the O/S which is why the Standard Support subscription entitlement is required.

There are no alternatives to the Red Hat Linux Standard Support, but the required subscriptions can be obtained from multiple resellers.

A decision not to purchase the Red Hat Linux Server Standard

Support subscription entitlement will result in the inability to maintain the current MCEITS environment, leaving the Marine

Corps without an enterprise vulnerability solution.

8. Actions to Remove Barriers to Future Competition

In accordance with FAR 8.405-6(b) (3) (i) (B), the justification will be posted along with the solicitation. Any responses to the Limited-Sources Justification will be noted and considered for use in future procurements similar to this one. Although no present vendor has the capability to provide these capabilities, recurring market research will continue to be conducted throughout the lifecycle to examine suitability of emerging software technologies and products. If new software is capable and compatible, full and open competition will be sought to the maximum extent possible.
