PdM-ICE

J&A #16,313 (CT 2.1)

SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS

1. The component parts and service required for the Non-Destructive Test Equipment- Armor Inspection System (NDTE-AIS) are available from only one (1) source and competition is precluded for reasons indicated below. There are no substitutes available.

2. This acquisition is restricted to the following source:

Manufacturer: Varian Medical Systems Manufacturer POC and Phone Number: Chuck Blouir / (440)543-1882 Manufacturer Address: 1678 South Pioneer Road, Salt Lake City, UT 84104

3. Description of the NDTE-AIS component parts and service required, the estimated cost, and required delivery date.

The NDTE-AIS is government-owned equipment used to conduct non-destructive testing of hard armor plates. The hard armor plates provide protection against a range of ballistic threats. Component parts and service of existing panels is required in order to maintain the serviceability of the protective equipment. These parts are custom designed and manufactured by Varian Medical Systems.

Parts required: PaxScan 4030E Flat Panel Detector.

The PaxScan 4030E Flat Panel Detector is a digital x-ray imaging system designed for high-speed radiographic imaging. The images are displayed instantaneously on a user-supplied computer running Varian ViVATM application software. X-rays undergo a two-stage collimation that limits illumination to the area subtended by the x-ray imager.

X-ray impinging on the face of the x-ray imager is converted to visible light photons in the scintillating face of the imager.

In addition to the purchase of the spare panel, the pre-existing panels need to be evaluated for service. This service has to be accomplished by Varian, due to the propriatary nature of the panel.

The estimated dollar value for this procurement is $41,750.00, and is based on Varian Medical System’s quotes dated 11 MAY 2016, 01 SEP 2016, and 10 SEP 2016. The estimated delivery date for the panel is ninety days after award and the evaluation report is

TBD.

4. Specific Characteristics that limit availability to sole source, e.g., unique features, function of the item, etc. Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources.

Varian Medical Systems custom designs and manufactures components necessary for the serviceability of the NDTE-AIS. In accordance with FAR 13.106-1(b), Varian Medical Systems is deemed the only source reasonably available to supply this component due to the proprietary nature of the NDTE-AIS equipment.

5. Check and fill in all that are applicable:

The material or service must be compatible in all aspects (form, fit, and function) with existing systems previously installed. Describe the equipment you have now and how the new item/service must coordinate, connect, or interface with the existing system:

Varian Medical Systems manufactures and designs the current x-ray imager.

A patent, copyright, or proprietary data limits competition. The proprietary data are as follows:

JDLL was the original equipment manufacturer of the NDTE AIS. However, JDLL is exiting the market at the end of FY16. Component parts have to be procured from their original partners. Varian Medical Systems is the only entity available with the expertise, technical data, equipment, and experienced personnel to provide the equipment to the US Government.

These are “direct replacement” parts/components for existing equipment.

The following components are direct replacement parts for the NDTE-AIS:

-X-ray Imager

6. Description of Efforts Made to Solicit Offer from as Many Offerors as possible

N/A

7. Determination of Fair and Reasonable Cost

A price comparison was conducted on the most recent contract for similar items (W15QKN-11-D-0154), which expired on 09 MAR 2016. The price (CLIN 0035) on this contract was escalated at 3% per annum from the date of contract award yielding a FY15 price of $62,707, which is $23,297 greater than the $39,500 quoted by Varian Medical Systems. Based on the results of the price comparison the price contained in quote # 201605102016-1CB is considered fair and reasonable.

A separate determination was conducted on the Out of Warrenty Return of the three (3) existing panels. A standard commercial rate is charged for each of the panels ($750), for a total of $2,250 for the service. Since this is their standard published rate for this service, the price is considered fair and reasonable.

CERTIFICATION

I certify that statements checked and information provided above are complete and correct to the best of my knowledge. I understand that the processing of this Sole- Source Justification precludes the use of full and open competition.
