UNITED STATES MARINE CORPS
MARINE CORPS SYSTEMS COMMAND
2200 LESTER STREET
QUANTICO, VIRGINIA 22134-6050
Code: CT-2.7
J&A Number: 16,315.1
JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity.
Marine Corps Systems Command
Other Supported Systems (OSS)
2200 Lester Street
Quantico, VA 22134-6050
2. Description of the Action Being Approved.
The use of other than full and open competition to award a sole source, Firm-Fixed Price (FFP) bridge contract to Corps
Solutions, 42 Masters Mill Ct, Stafford, VA 22556 to maintain mission critical Range and Training Area Management (RTAM)
Program support.
3. Description of Supplies/Services.
The proposed contracting action is to procure non-personal support services for Training & Education Command (TECOM) for the RTAM Program. The RTAM program is responsible for the development and implementation of programs to sustain, upgrade, and modernize Marine Corps training ranges that support the achievement and maintenance of combat readiness.
The RTAM program provides programmatic and training implementation support at various Marine Corps Range Control
Facilities (RCFs), as well as program management support.
On-site contractor support is required at MCAS Cherry Point, NC; MCB Quantico, VA; MCB Camp Pendleton, CA; MCMWTC
Bridgeport, CA; MCB Hawaii, HI; MCRD Parris Island, SC; MCB
Camp Butler, Okinawa, Japan; and MCB 29 Palms, CA. Key facets of support include system fielding support, sustainment, training, and current operations support at locations where
Range Control systems are deployed.
The current task order for these services, N00178-12-D-6828, MU62, was awarded by the Marine Corps Systems Command (MCSC)
Acquisition Center for Support Services (ACSS) office, and completes on 2 September 2016. Approval of this J&A will allow time for a competitive source selection and contract award process. The FFP bridge contract will have a 6-month base period of performance, from 3 September 2016 through 2 February
2017, and three one-month option periods providing three months of additional support for an overall total of 9 months if all options are exercised. Shorter option periods are not possible due to the significant potential for gaps in services and to minimize risk to the Marine Corps range program. The Base and
Option Periods are as indicated in the following table:

4. Statutory Authority Permitting Other Than Full and Open
Competition.
The statutory authority permitting use of other than full and open competition is 10 U.S.C. 2304(d)(1)(B) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(B), award to any other source would result in unacceptable delays in fulfilling the agency’s requirements.
5. Rationale Justifying Use of Cited Statutory Authority
The current task order expires on 2 September 2016. The previous task order for this effort was awarded by the MCSC ACSS office. Upon the closure of ACSS, all service contracts were distributed to various Program Offices. During this transition, acquisition planning for the follow-on effort lapsed. Once it was determined that a follow-on contract was required, acquisition planning began in earnest. The current follow-on
Procurement Execution Plan has an award date of 20 February
2017.
Any gap in service would create unacceptable training delays that would have an immediate negative impact on Marine Corps operational readiness in that an entire series of planned/scheduled title 10 training events, service level exercises, and pre-deployment workup should have to be cancelled, or greatly reduced due to the absence of sufficient trained and certified range control personnel. A gap in services as currently projected would significantly diminish capacity to support training operations aboard all supported
Marine Corps Installations. Service disruption would not only limit Marine Corps training opportunities but also would adversely affect other DOD services along with other Federal, State and local enforcement agencies that train aboard Marine
Corps Bases. Awarding an interim contract to anyone other than the incumbent will also result in unacceptable delays, as a new contractor would require time to staff qualified individuals and certify those range safety personnel in the existing positions.
Awarding a bridge contract to Corps Solutions will prevent a gap in services and will provide the follow-on contractor adequate time to hire, train and certify personnel. Additionally, a new contractor would not have the required familiarity, nor the time to train new personnel, on the existing Marine Corps Range
Facility Management Support System (RFMSS) and the Integrated
Range Status System (IRSS) as required in the day to day operation of the ranges.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable.
Market research was conducted for the solicitation of the follow-on contract, N00024-16-R-3330. The Government expects adequate competition from small businesses within the SeaPort-e platform for the follow-on procurement. The predecessor contract (N00178-12-D-6828, Task Order MU62) was competitively awarded through SeaPort-e to Corps Solutions, LLC. The
Government received three awardable proposals from small businesses. Neither the requirement nor the marketplace has significantly changed since that competition. Additional market research within GSA and in the open commercial environment outside of the Government was conducted to help verify capabilities exist in the marketplace should the SeaPort-e acquisition process not yield enough viable competition. The
Government reviewed information obtained via previously provided vendor capability statements, the commercial marketplace via a
Google search, a review of GSA eLibrary, a review of data from previous contracts for like services, and the web sites of vendors who are known to have previously performed like services. The results of this market research indicated that there are more than two small businesses capable of fulfilling the Government’s requirement. As such, the follow-on contract will be an order reserved exclusively for small businesses, using the SeaPort-e acquisition platform. Because the market research for the follow-on contract is relevant and appropriate to the circumstances of this bridge effort, no further market research was conducted for the reasons indicated in Section 5, above.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
A follow-on contracting action using competitive procedures is being conducted in parallel to the bridge contract. The
Procuring Contracting Officer is currently preparing the solicitation for SeaPort-e. The follow-on contract will be an order reserved exclusively for small businesses, placed against the SeaPort-e multiple award contract. The order is anticipated to be awarded on 20 February 2017 and will provide uninterrupted range control facilities support for a five-year period.
