JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

1. Contracting Activity

Marine Corps Systems Command 2200 Lester Street Quantico, VA 22134-6050

2. Description of the Action Being Approved

This Limitation to Fair Opportunity is to acquire additional effort under the existing task order for expertise and management support for the Marine Corps Warfighting Laboratory (MCWL) Wargaming Division (WGD) Program Manager (PM) Engineering and Scientific (E&S) under Contract M67854-02-A-9015 Order 0039 with BAE Systems Technology, Redland Corporate Center, 520 Gaither Road, Rockville, MD 20850.

3. Description of Supplies/Services

This proposed contract action is to procure additional subject matter expertise and management to support development and execution of additional wargames for the Marine Corps Warfighting Laboratory (MCWL) Wargaming Division (WGD). The current task order, awarded in October 2010, provides for support to the Marine Corps’ annual Title X and JCDE Wargaming Programs through November 2013. Specifically, this refers to Expeditionary Warrior and Joint Irregular Warrior. This additional subject matter expertise and management support is for the following wargames: Iron Crucible (IC), Fly-In Command Element (FICE), and Expeditionary Logistics 2013. These additional, unforeseen, wargames were directed by a myriad of sources to include the Chairman of the Joint Chiefs of Staff (CJCS), Deputy Commandants of the Marine Corps, and the Commanding General MCWL. These wargames examine emerging real-world threats, identify deficiencies, and recommend immediate changes to improve current and future warfighting capabilities and are in direct response to, and will provide near-term military utility to, exigent operational force requirements.

This additional support will be incorporated, via modification, to the existing task order, which ends November 3, 2013 and is estimated to increase the total value of the Order by $225,536.00. This effort is for 4th Qtr FY 13.

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority permitting other than and full and open competition is 10 U.S.C. Section 2304 (c) (1) in accordance with the Federal Acquisition Regulation (FAR) 6.302-1(2)(iii), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

The initial support requirement was solicited under the Marine Corps Systems Command’s (CEOss) business model. Eligible CEOss holders were provided a fair opportunity to compete for the required support. Based on this competition, the Order was awarded to BAE Systems to provide technical, administrative and programmatic support to PM MCWL WGD E&S and its programs.

BAE Systems has the highly specialized and resident knowledge from recently supported efforts which will be the baseline for the additional efforts. These include planning, conducting, and accessing the multifaceted dimensions of the United States Marine Corps’ (USMC) Service Wargaming Program and the management of its responsibilities regarding execution and participation in Naval and Joint Concept doctrine development, POM development and contingency planning wargaming and related shaping and supporting activities.

The additional effort is directly related to the support services being provided by BAE Systems. Award to any other source would result in unacceptable delays fulfilling the agency's requirements. A new contractor would not possess the required intimate knowledge of previous related efforts within the USMC Wargaming Program conducted in FY13. Award to a source other than BAE Systems would result in delays of approximately 4 to 5 months in fulfilling the Government’s requirements. This estimated time delay is determined as follows: Seaport posting of solicitation 30 days + source selection (5 days) + contract award (10 days) + awardees orientation period (2 weeks) + 12 weeks to get familiar with WGD programs. This entire process would take an estimated 21 weeks and would prevent the Government from meeting its mission and completion date of November 2013. This contract modification will ensure minimum delay of the production timeline and products desired by MCWL.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The original MCWL WGD E&S order was synopsized in the ACSS EP2 system, competed in 3rd QTR CY2010, and awarded in October 2010 with a period of performance of twelve months with two (2) one-year options. CEOss BPA holders were given a fair opportunity to compete for the original Order.

7. Determination of Fair and Reasonable Cost

The Contracting Officer shall ensure the services and supplies are fair and reasonable based on the contractor’s current labor rates as compared to the other primes in the ES domain and the government estimate. In addition, the order was placed on a GSA schedule and the prices have already been determined to be fair and reasonable.

8. Actions to Remove Barriers to Future Competition

This is the last option year and the follow on contract will be competed.
