2. Description of Action Being Approved.

Marine Corps Installation Pacific (MCIPAC) Communications & Information Systems Division (G6) partnered with the United States Air Force (USAF), United States Army (USA), and United States Navy (USN), to create a trunked land mobile radio (LMR) network in 2010 known as the Joint Japan Land Mobile Radio System (J2LMR). In 2018, the USAF and the USA decided to join their sites in Korea to the J2LMR network. The expanded network is now known as the Joint Japan and Korea Land Mobile Radio (J2KLMR). The network consists of one (1) master site on Kadena Air Base (AB), 24 radio frequency (RF) sites in Japan and Okinawa, and 18 RF sites in Korea. The entire network is a Motorola Solutions Integrated Voice and Data (IV&D) version 7.17 system. The joint LMR network supports all first responder critical radio communication. It also supports command and control, flight line operations, maintenance operations, and administrative radio communications across the Department of Defense in Japan and Korea. As the USAF and the USA transfer their sites over to the J2LMR network, the USMC must do the same in order to retain radio communications for previously mentioned vital functions. To do this MCIPAC G6 requires the upgrade and installation of Motorola Solutions land mobile radio (LMR) equipment, infrastructure, and assets at Camp Mujuk South Korea. The upgrade will be performed on the existing LMR site at Camp Mujuk. For the reasons described below, the MCIPAC Regional Contracting Office intends to award a sole-source contract to Motorola Solutions for the upgrade of LMR systems at Camp Mujuk.

3. Description of Supplies/Services.

The current services contract FA5270-19-P-A017, awarded April 1st, 2019, by the 18th Contracting Squadron on Kadena Air Base, for LMR maintenance within Korea and Japan utilizes the vendor Motorola Solutions, which provides LMR communication equipment and architectures that were fielded by the USMC, USA, USAF, and USN. The LMR network, known as the J2KLMR, uses critical components maintained and originally manufactured by Motorola Solutions using their proprietary communication protocols. The network provides operationally critical roaming communications capabilities required in MCIPAC’s geographically dispersed area of responsibility (AOR) diverse community. Using vendors other than Motorola Solutions would result an inability to utilize the J2KLMR network, and loss of radio communication capabilities that currently exist throughout Korea and Japan.

The following are the minimum Government requirements to upgrade and connect the LMR radio equipment to the J2KLMR system:

1. Depot-level maintenance capabilities resident in Korea.

2. Existing access to the Kadena AB master site, to ensure integration with the existing

J2KLMR system and roaming capabilities are maintained.

3. Utilize existing advanced encryption standards. LMRs in the U.S. Indio-Pacific

Command (USINDOPACOM) area of responsibility (AOR) use Advance Encryption Standard (AES) to encrypt Sensitive but Unclassified (SBU) information.

4. Employ existing Over the Air Programming technology that is compatible with Motorola end user devices.

5. Employ existing Over the Air Rekeying technology that is compatible with Motorola end user devices and the existing key management facility residing at the Kadena AB master site.

6. A testing facility, with the existing equipment architecture, that is capable of supporting pre and post integration efforts.

7. Credentials to engineer, reconfigure, connect, program, optimize, integrate, test, and migrate existing LMR equipment to meet original equipment manufacturers specifications.

8. Licensed and trained on existing equipment and upgrade equipment.

9. Re-utilization of existing equipment to the maximum extent.

The total estimated dollar value for this Contract action is approximately $350K. Fiscal Year 2019 Marine Corps Systems Command (MCSC) Program Funds will pay for this effort. U.S. Air Force and Army will utilize their own contracts separate from this action.

4. Statutory Authority Permitting Other Than Full and Open Competition.

This request is submitted pursuant to the authority of Title 10 U.S.C. 2304(c)(1) or 41 U.S.C.

253(c)(1), which provides that full and open competition need not be obtained where there is only one responsible source, and no other supplies or services will satisfy the agency’s requirements. FAR 6.302-1(a)(2)(iii) states that supplies are deemed available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, when it is likely that award to any other source will result in:

(A) Substantial duplication of cost to the Government not expected to be recovered through competition OR

(B) Unacceptable delays in fulfilling agency requirements

5. Rationale Justifying Use of Cited Statutory Authority.

In the past, the DoD and Service Components were unable to identify enterprise level solutions to address DoD LMR requirements as a whole, and subsequently Services were given the authority to pursue commercial off the shelf (COTS) capabilities to meet their LMR requirements. The inability to identify an enterprise solution was not due to a limitation of available COTS technologies; rather it was indicative of the complexity of finding common solutions to address a broad spectrum of interoperable requirements encountered by installation commanders. This complexity increases significantly in environments outside the continental United States (OCONUS) with the imposition of host-nation/bilateral agreements, izumi.kinjo.ja Sticky Note Accepted set by izumi.kinjo.ja political/military considerations and other challenges and constraints with obtaining spectrum authority and authority to operate equipment.

Because of this, the MCIPAC G6 partnered with Kadena Air Base to leverage their existing Motorola LMR solution1. MCIPAC also partnered with others and continues to do so based upon U.S. Indo-Pacific Command (USINDOPACOM) Chief Information Officer (CIO) policy2 for LMR systems. This Policy and Guidance Memorandum includes definitions, concepts and guidance for LMR systems and equipment, including all planned improvements, expansions, and/or system replacements. The long term goal of thispolicy is to further consolidate LMR networks into one USINDOPACOM-wide network.

The minimum specific requirements and characteristics of the updated J2KLMR system to which the Camp Mujuk LMR site must migrate and the expertise requirements previously mentioned limit the availability to a single source, Motorola Solutions. This is justified for the following reasons:

1. The existing equipment located throughout Korea and Japan is authorized for use on J2KLMR network. At this time, only Motorola Systems is authorized to operate on this network due to existing maintenance contract FA5270-19-P-A017. Motorola Systems is the original equipment manufacturer of the J2KLMR network, critical components of which are highly specialized, and are manufactured and maintained by Motorola using their proprietary communication protocols. Because of this, only Motorola manufactured parts and accessories are compatible with the J2KLMR system. Motorola has been maintaining the J2KLMR network at a level that has met or exceeded U.S Government standards since 2008, therefore this acquisition is for a continued performance of a highly specialized service.

2. J2KLMR is a joint communication solution between the USAF, USA, USMC, and USN.

The existing equipment is based upon Motorola Solutions technology and any integration efforts must coordinate, connect, and comply with the existing solution.

Because only Motorola equipment is permitted on the system, using another vendor or manufacturer would cause additional expenses for all Services, or could force the USMC to identify and operate a different LMR system. The loss of access to a master site, radio site, inability to accurately vet subscriber assets, or inability to monitor the network presents significant risks to security and day to day MCIPAC and Camp Mujuk operations. Using anything other than Motorola Solutions equipment would require modification to the Kadena AB master site, as well as upgrading all sites and consoles that could cost up to $67M (see Basis of Estimate for further details). An expense of this magnitude is not anticipated to be offset via competition. Such modification would cause a significant delay in service, in return affecting mission for all Services across military installations throughout Japan and Korea.

The upgrade of the J2KLMR site at Camp Mujuk must be performed by personnel certified by Motorola Solutions and with the required access to add this equipment to the Kadena AB Master Site. Based on the above, only Motorola Solutions can provide the unique knowledge, resources, expertise, and facilities for the upgrade of the J2KLMR network. Changing vendors would result in the current system being rendered unusable/obsolete, or it Camp Mujuk losing

1 Memorandum of Understanding between MCIPAC G6 and 18th Communication Squadron dated 8 January 2010 2 USPACOM Land Moblie Radio (LMR) System Policy dated 13 Jul 2010 access to J2KLMR. To avoid unnecessary duplication of efforts and costs, a sole source award to Motorola Solutions for this effort is necessary and in the Government’s best interests.

4. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible.

This effort will be synopsized in FedBizOps in accordance with the requirements for FAR Part

5.2. The Contracting Office shall evaluate all responses received to determine if any other company can provide the required supplies/services. Market research in accordance with FAR Part 10 has been conducted and there are several vendors that can supply similar supplies/services however, the supplies/services are not compatible with the current J2KLMR system.

5. Determination of Fair and Reasonable Cost.

The Contracting Officer will determine that the price for this acquisition is fair and reasonable in accordance with FAR 13.106-2 and 13.106-3, and, to the extent deemed necessary by the Contracting Officer, using price analysis technique in FAR 15.404-1 (a) and (b).

7. Actions to Remove Barriers to Future Competition.

It is anticipated that the sole source requirement for LMR operations and maintenance will continue to be required for future contract actions related to J2KLMR. Until U.S. DoD assets in Japan and Korea elect to change the entire LMR infrastructure, competition for J2KLMR-related requirements will likely remain limited because the equipment and technology is proprietary to Motorola Solutions. In the future, when warranties are not an issue and the items need to be replaced, some of these individual items may be able to be procured on a competitive basis.
