PERFORMANCE OF WORK STATEMENT

Performance of Work Statement

1. General Description

This Performance of Work Statement (PWS) describes repair services for RTAMS, Operation and Training (O&T), MAGTFTC, Twentynine Palms, CA. The Contractor shall provide all labor, management, supervision, and non-furnished tools necessary to perform the repair of the items as identified in the attachment. The Contractor shall be guided in the performance of this contract as directed by the Contracting Officer. Service inspect and make repairs to electrical in 7 containers.

2 Contractor Requirements

The Contractor shall have adequate procedures for receiving and responding to service calls during regular working hours. A single local or toll-free telephone number shall be provided by the contractor for receipt of calls for services. All telephone calls shall be answered by an English-speaking representative fully familiar with the contractors work control procedures and the terms and conditions of this contract.

Perform inspection and repair electrical services for AC units and service panels accordance with this performance of work statement. All items identified for electrical repair services are located at MAGTFTC, RTAMS buildings 2155. The contractor will coordinate with the RTAMS representative to identify and schedule repair services. The contractor's employee(s) must be able to read and write English fluently in order articulate estimates of repairs to Government representatives. Only manufacturer authorized parts and material shall be used in the repair of the AC units and service panels.

The RTAMS representative shall provide the items for inspection and repair services to the contractor.

Inspection services shall begin within 48 hours of initial contact. The contractor shall provide a written estimate for each item requiring repair to the RTAMS representative for verification of cost effectiveness and authorization to proceed with the repair. Based on the written estimate, the RTAMS representative shall determine if the item is economical to repair before authorizing the repair services. The Contractor's written estimate shall include an estimated cost and repair lead time. The estimate shall include labor, material, a completion date, and the amount of time (in hours) spent on the service repairs for the estimate.

Any cost above the written estimate shall be approved by the RTAMS Representative prior to performing the services that exceed the pre-determined authorized amount. Completion of the repair shall not to exceed 30 days after the equipment is received by the contractor. All items shall be repaired in accordance with the original manufacturer's operational standard.

The contractors repair estimate shall include the cost of the service repairs. In the event that repairs are not ordered either because the equipment is beyond economical repair, or the repair cost is not considered fair and reasonable, the contractor will be paid for the service call under the appropriate CLIN for services. If the repair is ordered, the RTAMS Representative will initial the written estimate. A copy of the estimate shall be provided to the RTAMS Representative and retained for future reference.

The contractor shall inspect, pick up and deliver all items authorized for repair at buildings 2155 at no additional cost to the Government. The contractor is not authorized to exceed the cost of this contract during the applicable period of performance.

The contractor shall comply with Government fire and security regulations. In addition, the contractor shall ensure that their employees are properly trained, qualified, and equipped to comply with the terms and conditions of this contract.

3 Parts

Proposed material prices shall include the full price and show any discounts or premium off the manufacturer’s standard parts price. The Government reserves the right to request copies of the Contractor’s parts price list to ensure it’s attaining the parts at the Contractor’s cost including, if appropriate, material handling costs as part of material costs. In any case, no profit for materials is authorized under this contract and is subject to Government audit.

4 Warranty

All maintenance and repair work shall be warranted against defects in materials or workmanship for a minimum period of 6 months. Should the contractor’s standard commercial warranty be longer, the period of the standard warranty shall apply. Where the contractor is notified of such defects, the contractor shall make all repairs necessary to correct the defects at its sole expense.

5 Service Locations

All items authorized for repair shall be repaired at the RTAMS compound building 2155 or contractor's facility which is the best procedures to accomplish the job.

6 RTAMS Representative

The individual, as identified below, is designated by RTAMS to schedule services, and perform inspections and acceptance electronically via Wide Area Work-Flow (WAWF). The RTAMS Representative will also perform the functions of an on-site representative, ensure items are cost effective for repair, coordinate the repair of the items and act as Certifying Officer for WAWF.

7 Task Management

This PWS describes the requirements that are to be executed by the contractor for the stated period of time.

The Contractor shall be responsible for complying with all applicable terms and conditions as identified within this contract.

8 Permits

No permits are required for this contract.

9 Government Furnished Equipment

There is no government owned equipment to be furnished to the contractor for use under this contract.

10 Contract Authority

Not withstanding any other provision of this contract, the Contracting Officer shall be the only individual authorized to redirect the effort or otherwise amend any of the terms of this contract.

11 Work Hours

The scheduled work hours are Monday through Friday 0730-1600, excluding legal holidays.

12 Legal Holidays

(A) Deliveries accepted between the hours of 7:30 A.M. and 4:00 P.M. No deliveries will be accepted on Saturdays, Sundays, or legal holidays.

(B) In the event any of the above holidays occur on a Saturday or a Sunday, then the holiday shall be observed by the contractor in accordance with the practices as observed by the assigned government employees at the using activity. This includes the Friday after all holidays that are observed or occur on a Thursday (. i.e., Thanksgiving).

13 Security Requirements

a. The Contractor will call to inform of pickup and delivery of equipment coordinated through RTAMS Supply, Robert E. Moreno 830-3652, 6953.

b. All contractor personnel performing work under this contract who require access to military installations shall obtain personal entry and vehicle passes from the Provost Marshall’s Office (PMO) Bldg. 901 at main gate, phone number 830-6693.

c. The Commanding General of each base has broad authority to remove or exclude any person in fulfilling his responsibility to protect personnel and property, to maintain good order and discipline, and to ensure the successful and uninterrupted performance of the Marine Corps mission. In the exercise of this authority, the Commanding General may refuse to grant personal entry passes or may bar contractor employees, including employees who have been granted a personal entry pass. Refusal to grant an employee a personal entry pass or the barring of an employee from the base does not relieve the contractor of the responsibility to continue performance under this contract.

d. The contractor’s employees shall observe and comply with all base rules and regulations applicable to contract personnel, including those applicable to the safe operation of vehicles, and shall not be present in locations not required for the proper performance of this contract.

e. Contractor personnel performing work under this contract shall wear uniforms or other clothing that distinguishes them as an employee of the contractor.

f. Contractor personnel and equipment entering a military installation are subject to 100% security checks. Contractor personnel shall follow any direction given by Military Police or other security of safety personnel. In compliance with the above, the contractor must be prepared to provide proof of the following:

- A valid driver’s license

- Proof of Insurance

- Current Registration

- Knowledge of the contract # they are performing under

g. The contractor shall not employ any individual for the performance of this contraction in violation of DOD Joint Ethics Regulations (DOD Directive 5500.7-r) or if such employment would create a conflict of interest or an appearance of a conflict of interest.

14 Invoices and Payment

All invoices shall be submitted electronically via Wide-Area Work Flow (WAWF) for payment by Defense Finance and Accounting Service (DFAS) Columbus as identified on page 1, block 18a.

14 Completion of Services

The RTAMS representative is required to furnish an electronic Report of Property Received (RPR) in Wide Area Work-Flow within 7-days of receipt or completion of services. All items shall be inspected and accepted within the 7-day RPR period.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(MAR 2023)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition--

(1) Is set aside for small business and has a value above the simplified acquisition threshold;

(2) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or

(3) Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) technical capability of the item offered to meet the Government requirement;

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.
