Justification for Other than Full and Open Competition – FAR Part 13 Acquisitions under the SAT
V 1.3 (28 June 2018)
MEMORANDUM TO THE FILE
Subj: JUSTIFICATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION FOR A FAR PART 13 ACQUISITION UNDER THE SIMPLIFIED
ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

B. _X_ BRAND NAME
This requirement is for the acquisition of (1) Shoot House Pro Kit to provide a training platform for MCPD officers.
The Marine Corps Police Department Training Program will utilize these portable walls to create dynamic training scenarios in a CQB environment.
The Trango-Systems Shoot-house is ready for setup and use upon delivery. The wall modules use a simple twist lock “T key’s” to attach to each other, no training is required for set up or use. Once setup on site the shoot house will allow immediate use with no major infrastructure changes needed.
These wall kits are modular so layouts can be reconfigured in a matter of minutes.
The Shoot House Pro kit is a package of 200 walls, each weighing 27 pounds and measure 1M Long X 2M high X 6 inches thick, these walls require no special tools for assembly. Other like products have a much higher weight per wall making transportation and assembly of the units more difficult. The all-weather system that can be set up and left in place for long periods of time, unlike other kits that cannot withstand the wet and windy environment of North Florida.
One like product available is a “soft” house, built with PVC hanging walls. The soft walls don’t adequately stand up to the outdoor environments with wind and rain so they have to be replaced more frequently, increasing cost to the Federal
Government.
The Kontek System modular shoot house is and an example of the soft house. It is portable and lightweight, however unlike the Trango-system, the Kontek is made of thin unsteady metal piping and thin PVC panels for walls. This option will not holdup in our Florida environment, causing us to replace panels more frequently raising the overall cost.
The Simtek modular system is designed using plywood increasing the system weight significantly, making setup, storage, and transportation harder than the Trango-system. The plywood panels are vulnerable to the wet weather of Florida, causing us to replace the panels more frequently, raising the cost of the system.
The other available options are stick-built fixed structures (buildings) that are built on site and can’t be reconfigured or moved. This requires major infrastructure changes to the base, increasing the cost of the training facility. The purpose of the modular system is to allow the instructors to create a complex, everchanging training environment, to challenge the officers in a CQB setting.
The cost of the Trango-Systems product is comparable to the original cost of the fabric tarpaulin shoot houses. Trango-System houses don’t have consumable parts that wear out, nor do they require any special maintenance, so purchase is the only cost, and it’s a single expense.
The Police Department will no longer have to travel to an offsite location to conduct
CQB and active threat training. This adds vital training time and allows the instructors to increase the number of repetitions in a training day. Currently the
Police Department is utilizing a JSO training facility on Cecil Field for its CQB training facility. This facility is 37 miles from Blount Island this reduces training time and adds cost for fuel and loss of manpower in travel time. Also, this facility must be reserved several months in advance due to the high demand for this type of training space. If allowed to purchase a modular shoot house the Police Department would have an on-site ever changing training facility to increase the Officers and
Marines skills and abilities.
Lastly, this Trango-System shoot house is already approved and in use at several
USMC installations, providing critical training to Police Officers and Marines. This includes the Marine Corp Police Academy at FT Leonardwood, MO, the Marine
Corps Security Force Training Company – Chesapeake, VA and the Marine Corps
Security Force Regiment - Yorktown, VA
C. ___URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
