About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition in a federal procurement.
The United States Marine Corps, Regional Contracting Office-East at Marine Corps Installation East-Marine Corps Base in Camp Lejeune, North Carolina, is seeking to award a sole source, firm-fixed price commercial contract to L3Harris Technologies, Inc. for infrastructure and cybersecurity support services for the Enterprise Land Mobile Radio (ELMR) system. The contract will cover warranty, sustainment, cybersecurity, and maintenance services supporting radio frequency wireless communications equipment required for the Concept of Operations for Emergency Management Command and Coordination (EMC2) capability. The total estimated contract value is $5,331,557, consisting of a base period of ten months and three twelve-month option periods, with annual Operations and Maintenance costs ranging from $1,010,420 in FY 2027 to $1,747,308 in FY 2029. The sole source justification is based on 10 U.S.C. 3204(a)(1), citing that L3Harris is the sole proprietor and original equipment manufacturer authorized to provide hardware, software, warranty, maintenance, and managed services (Technical Assistance Center) for the ELMR system. This is a follow-on contract to the original competitively awarded contract M6785412C4950 issued March 29, 2013, for $16,749,000.36. Market research was conducted under FAR Part 10 and mandatory source reviews under FAR Part 8, yielding no alternative sources capable of meeting requirements. The system exit date is scheduled for FY29, at which time the Government may reassess competition feasibility for future requirements. The contracting officer will determine fair and reasonable pricing prior to contract award.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Regional Contracting Office-East, Marine Corps Installation East-Marine Corps Base, Camp Lejeune, North Carolina.
2. Description of the Action Being Approved.
Award of a commercial firm-fixed price contract on a sole source basis to L3Harris Technologies, Inc for infrastructure and cybersecurity support services for the Enterprise Land Mobile Radio (ELMR) system.
3. Description of Supplies/Services.
This justification authorizes and approves the award of a firm-fixed price contract, using FAR part 12 procedures, for the purchase of warranty, sustainment, cybersecurity, and maintenance for the ELMR system. Services will support infrastructure which provides radio frequency (RF) wireless communications equipment required to support the Concept of Operations for Emergency Management Command and Coordination (EMC2) capability. The total estimated value of the procurement is $5,331,557 and includes a base period of ten months and three twelve-month option periods.
Estimated Dollar Value
FY 2027 FY 2028 FY2029 FY 2030
O&M $1,010,420.00 1,248,885.00 $1,747,308.00 1,324,944.00
4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
L3Harris Technologies, Inc is the sole proprietor, original equipment Manufacturer, and the only authorized provider of hardware, software, warranty, maintenance, and managed services (Technical Assistance Center) to the ELMR system for the Marine Corps. This is a follow-on contract for warranty and maintenance service for highly specialized equipment. The original contract M6785412C4950, for this system was based on competition and awarded to Harris Corporation on 29 March 2013 for a base period and four twelve-month option periods with an aggregate amount of $16,749,000.36 for the design and installation of an entirely new system with equipment, warranty, and maintenance service. The cost of soliciting and awarding a new contract to any other source would result in a substantial duplication of costs to the Government that is not to be recovered through competition as the entire system would have to be replaced.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted in accordance with FAR Part 10, including review of mandatory sources under FAR Part 8, and internet search. No other sources were identified that can meet the requirements. A pre-solicitation notice will be posted to SAM.gov to determine whether to conduct a competitive procurement.
7. Determination of Fair and Reasonable Cost.
Prior to contract award the Contracting Officer will determine the cost to the Government of the supplies/services covered by this J&A to be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
In accordance with Marine Corps System Command’s Life Cycle Plan dated 2014, the system Exit Date for the customer’s ELMR’s system is scheduled for FY29. For reasons set forth in paragraph 5, the Government has no plans, at this time to compete with a future contract for the types of supply and services covered by this requirement until FY29 If another potential source emerges, Government will assess whether competition for future requirements is feasible.
