PERFORMANCE WORK STATEMENT
Performance Work Statement for
Stryker EMS Prevent and EMS Prevent NB Maintenance Programs
1.0 Background: The Fire and Emergency Services Division (FESD) located at Marine Corps Logistics Base Albany, GA has a mission to provide pre-hospital emergency medical treatment and transport to the sick and injured. The FESD ambulances currently utilize Stryker Power Pro 6506 patient cots to facilitate moving and transporting patients. The FESD ambulances are equipped with Stryker Power-Load Systems; these systems raise and lower the cots out of the ambulance, thus reducing the possibilities for lifting injuries suffered by FESD personnel. Stryker Stair Chairs are used to evacuate patients from barracks and reduces risk of injury to FESD personnel. LifePak 15 and LifePak 1000 defibrillators are used in the event patients need to be treated for cardiac arrest and provide continuous cardiac monitoring capabilities. This equipment needs to be maintained on a regular basis to remain in proper working order. FESD personnel provide daily checks of the equipment but are not authorized to make any repairs to the complex systems involved. These cots, Power Load Systems, stair chairs, defibrillators and monitors are vital to the EMS mission that FESD provides.
2.0 Scope/Objectives: The contractor shall provide services in support of Marine Corps Logistics Base Albany Fire & Emergency Services Division and shall include all items listed below. All work shall be performed on site (Marine Corps Logistic Base Albany) by original equipment manufacturer (OEM) certified technicians.
3.0 Tasks: Contractor shall provide LP15 Prevent Onsite, LP 1000 Prevent Onsite, EMS Prevent NB and EMS Prevent OEM approved maintenance program that provides the agency with a comprehensive repair and preventative maintenance services that allow for continual operation of the Government owned Stryker equipment.
This contractor shall provide the following services:
3.1 EMS Prevent NB: Provide EMS Prevent NB maintenance program for one (1) Stryker Manual Cots without the Power-Pro equipment and two (2) Stryker Stair Chairs.
3.1.1 Includes Parts, Labor, and Travel. Note: Replacement parts do not include mattresses, batteries, and other disposable or expendable parts.
3.1.2 Includes one (1) annual preventive maintenance inspection.
3.1.3 Includes unscheduled services and product equipment checklists.
3.2.1 Includes Parts, Labor, and Travel. Note: Replacement parts do not include mattresses and other disposable or expendable parts.
3.2.2 Includes one (1) annual preventive maintenance inspection.
3.2.3 Includes unscheduled services.
3.2.4 Includes battery replacement.
3.2.5 Includes product equipment checklist.
3.2 EMS Prevent: Provide EMS Prevent maintenance program for one (1) Stryker Power Load and two (2) Stryker Power Cots.
3.3 LP15 Prevent Onsite: Provide ProCare LIFEPAK 15 Prevent Service for two (2) life pack monitors/defibrators.
3.3.1 Includes annual onsite preventative maintenance inspection and unlimited repairs including parts, labor, and travel with battery coverage.
3.4 LP1000 Prevent Onsite: Provide ProCare LIFEPAK 1000 Prevent Service for three (3) life pack monitors/defibrators.
3.4.1 Includes annual onsite preventative maintenance inspection and unlimited repairs including parts, labor, and travel with battery coverage.
3.5 LUCAS EMS Prevent Service: Provide ProCare LUCAS EMS Prevent Service for one (1) Lucas Device.
3.5.1 Includes annual onsite preventative maintenance inspection and unlimited repairs including parts, labor, and travel.

5.0 Government Responsibilities:
5.1 The government will ensure the covered equipment is available for services at scheduled times.
5.2 Assume complete responsibility for the loaner equipment and shall return the loaner in the same condition as received, upon the return of the removed covered equipment.
6.0 Contractor Responsibilities:
6.1 Provide highly trained and authorized representatives with detailed technical knowledge and diagnostic capabilities to quickly identify problems and provide onsite maintenance. Where possible, repairs are made at the government facility, with original equipment manufacturer parts.
6.2 Onsite Services are performed between 8 a.m. to 5 p.m. local time, Monday through Friday, excluding holidays. When repairs cannot take place onsite, the contractor shall be responsible for covering all costs associated with travel and/or round-trip freight for equipment that must be sent to a designated facility for repair.
6.3 Provide loaner equipment to the government if Covered Equipment must be removed from use to complete repairs. The contractor shall provide the government with a similar loaner device until the Covered Equipment is returned.
6.4 Preventative maintenance ensures the agency’s powered stretchers remain fully functional and in optimum condition. The contractor shall provide the preventative maintenance service, including required replacement parts at no additional cost.
7.0 Government Points of Contact: The Government points of contact are not warranted Contracting Officers and do not have the authority to take any action, either directly or indirectly, that would change the pricing, quantity, place of performance, delivery schedule, or any other terms and conditions of the contract.
7.1 Contract Administrator: Provided at time of award.
7.2 Government Technical Representative: Provided at time of award.
8.0 Contractor Unauthorized Work Performance. The contractor shall not perform work that deviates from contract requirements and specifications. If the contractor deviates from contract requirements and specifications without approval of the Contract Officer, such deviation shall be at the risk of the contractor and any cost related thereto shall be borne by the contractor.
9.0 BASE ACCESS INSTRUCTIONS FOR MARINE CORPS LOGSITICS BASE ALBANY.
-Contractors and/or Delivery drivers must have in their possession: their contract number, delivery address, and sponsor’s contact information in order to gain initial access to the base. For services the Contracting Officer’s Representative (COR) is the sponsor, for supply deliveries the customer/delivery point of contact is the sponsor.

-Contractors must be registered in the Defense Biometrics Identification System (DBIDS). It is the Contractor’s responsibility to ensure all their employees and or subcontractors are properly registered within DBIDS.
-DBIDS credentials will be valid for the duration of your contract, not to exceed three years; however, re- vetting of individuals' information will occur each year.
-Contractors requiring access for over 60 days will receive a credential valid for up to one year.
-Contractors requiring access for less than 60 days will receive a temporary paper pass.
-Contractor Common Access Card (CAC) Eligibility: Contractor personnel authorized CAC's are exempt from DBIDS enrollment.

**The Government will not be responsible for any contractor access delays. Delays that may result from inadequate planning are strictly the responsibility of the contractor.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. (a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (OCT

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(c) Representations.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
BASIS OF AWARD: Quotes will be evaluated based on (1) technical capability of the item offered to meet the Government’s requirement; (2) delivery, (3) past performance, and (4) price.
This acquisition will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items and FAR Part 13, Simplified Acquisition Procedures, FAR Part 13.5, Simplified Procedures for Certain Commercial Items .
The Government intends to award a single contract on an “all or none basis” to the Vendor that is the best value to the Governement. In order to be technically acceptable. The quote must meet all requirements, with a satisfactory past performance history. Award will be made on all or nothing basis for all required Stryker maintenance.
The Government intends to evaluate quotes and award a contract without discussions with vendors. Vendors should not expect request for clarificatory or additional information from the Government. Therefore, the vendor’s initial quote should contain the vendor’s best terms from a price and technical standpoint. The Government may reject any or all quotes if such action is in the public interest; and may waiver informalities and minor irregularities in quotes received.
Technical Capability, Quotes will be deemed acceptable or unacceptable based on a review of the following factors.

UNACCEPTABLE TECHNICAL FACTOR: A finding of unacceptable in one technical factor or subfactor shall result in the entire quote being evaluated as unacceptable.
FACTOR 1- TECHNICAL ASPECTS/Quality of Stryker ProCare Service:
Subfactor A- Stryker Pro Care Services. Quoter shall submit the preventative maintenance documentation to customer on a timely basis.
FACTOR 2- DELIVERY, Quoter shall state they have the ability to meet the delivery times and location requirements show in the delivery section of the statement of work.
FACTOR 3- PAST PERFORMANCE, The Supplier Performance Risk (SPRS) for Supplies or CPARS for Services will be used to obtain Past Performance on quoters. The Government may consider other past performance data from a wide variety of sources both inside and outside of the Federal Government.
FACTOR 4- PRICE, Price will be a factor, but not the deciding factor, Quoter shall submit pricing, using the SF 1449, on all items to be eligible for award. The quoter shall provide prices for the base year with two one year option periods. Award will be made on an all or nothing basis for all required Stryker equipment maintenance.

"Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
"Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

"Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
"Predecessor" means an entity that is replaced by a successor and includes any predecessors of the predecessor.
"Reasonable inquiry" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
"Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
"Service-disabled veteran-owned small business (SDVOSB) concern" means a small business concern—
(1)(i) Not less than 51 percent of which is owned and controlled by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran; or

"Successor" means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
"Veteran-owned small business concern" means a small business concern--
(1) Not less than 51 percent of which is owned and controlled by one or more veterans (as defined at 38 U.S.C.
