JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. Marine Corps Field Contracting System, Marine Corps Installation
East-Marine Corps Base, Camp Lejeune, North Carolina.
2. Description of the Action Being Approved. Award of a commercial firm-fixed price contract on a sole source basis to L3Harris Technologies, Inc. for infrastructure support services for the
Enterprise Land Mobile Radio (ELMR) system.
3. Description of Supplies/Services. This justification authorizes and approves the award of a firm-fixed price contract, using FAR part 13.5 procedures, for the purchase of warranty, sustainment, and maintenance for the ELMR system. Services will support infrastructure which provides the radio frequency (RF) wireless communications equipment required to support the
Concept of Operations for Emergency Management Command and Coordination (EMC2) capability. The total estimated value of this procurement is $2,053,174 and includes a base period of twelve months and two twelve-month option periods.
4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority. L3Harris Technologies, Inc. is the sole proprietor, original equipment manufacturer, and the only authorized provider of hardware, software, warranty, maintenance, and managed services (Technical Assistance Center) to the
ELMR system for the Marine Corps. This is a follow-on contract for warranty and maintenance service for highly specialized equipment. The cost of soliciting and awarding a new contract to any other source would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition as the entire system would have to be replaced.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. Market research was conducted in accordance with FAR Part 10, including review of mandatory sources under FAR Part 8, and internet search. No other sources were identified that can meet the requirement. A presolicitation notice will be posted to SAM.gov to determine whether to conduct a competitive procurement.
7. Determination of Fair and Reasonable Cost. Prior to contract award, the Contracting Officer will determine the cost to the Government of the supplies/services covered by this J&A to be fair and reasonable.
8. Actions to Remove Barriers to Future Competition. In accordance with Marine Corps System
Command’s Life Cycle Plan dated 2014, the system Exit Date for the customer’s ELMR’s system is scheduled for FY29. For reasons set forth in paragraph 5, the Government has no plans, at this time to compete future contract for the types of supply and services covered by this requirement until FY29. If another potential source emerges, Government will assess whether competition for future requirements is feasible.
