PERFORMANCE WORK STATEMENT
SCOPE OF WORK (SOW): The contractor shall provide all materials, tools, parts, labor, equipment and supervision required to accomplish the following:
General description: The contractor shall transport Gyro-Trac (GT) number 1 (serial # BCT08031123C) from Camp Lejeune, NC to the contractor’s maintenance facility, install a new 700HF Gyro-Trac cutting head and perform a trunnion upgrade and return the machine to Camp Lejeune, NC.
1. Detailed requirements and specifications:
a. The contractor shall transport GT-1 from building T73 off Lyman Road at Camp Lejeune, NC and bring it to the contractor’s maintenance facility.
b. The contractor shall remove the old unserviceable cutting head from GT-1 and dispose of it properly.
The old cutting head becomes the property of the contractor.
c. The contractor shall install a new 700HF cutting head with Sabre-Tooth cutting technology on GT-1 according to the manufacturer’s specifications, directions or recommendations. See attached Specification sheet for the Sabre-Tooth cutting technology to be installed on GT-1.
d. The contractor shall also upgrade the trunnions on the government’s machine.
e. The contractor shall use genuine Gyro-Trac Brand OEM parts, assemblies and or sub-assemblies being installed on to the Government’s model GT-18XP.
f. The contractor shall use the parts in the below table for the install:

g. DELIVERABLE: At the end of the installation, GT-1 shall operate properly and without malfunction and be able to mulch whole trees, parts of trees, tree trunks, tree stumps, heavy vegetation, roots, vines and other vegetation not mentioned here.
h. Deliver the government’s GT-18XP to building T73 off Lyman Road, Camp Lejeune, NC.
2. Special Instructions:
a. The contractor shall coordinate the pickup and delivery of the government’s equipment with the Government Point of Contact (POC), William Van Pelt, 910 -451-8799.
b. The pickup and delivery will be at building T73 located off Lyman Road, Camp Lejeune, NC.
c. The contractor shall only pick up or deliver the equipment during working hours. Working hours are
Monday through Friday 8AM to 3PM. No pick up or delivery is authorized on weekends or Federal Holidays.
d. The contractor shall record and provide to the government any mechanical and or safety issues with the equipment not related to the trunnion upgrade or the new cutting head installation.
e. The contractor is responsible for the machine once it leaves building T73 at Camp Lejeune, NC until it is returned to building T73 at Camp Lejeune, NC. The contractor shall keep the machine secure from vandalism, theft etc. and is responsible for anything that happens to the equipment while under control of the contractor.
CONTRACTOR UNAUTHORIZED WORK PERFORMANCE. The Contractor shall not perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without written approval of the CONTRACTING OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.
WAGE DETERMINATION. The contractor is required to completely fill in all required data fields using the following web address: https://www.ecmra.mil.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at httsp://www.ecmra.mil.
(a) The contractor is advised that this procurement is subject to the requirements of the Service
Contract Labor Standards.
(b) The contractor agrees to furnish the Contracting Officer a copy of any collective bargaining agreement applicable to employees under this contract.
(c) The labor category and wage rate applicable to this requirement is: Occupational Title(s) and hourly rate – To be determined by vendor. Salaries paid to employees must be in compliance with this labor category and wage determination or collectiving bargaining agreement.
(d) Wage Determination No. 2015-4389 Revision No. 14 dated 6/2/2020 can be found at https://www.beta.sam.gov.

The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the moving service via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
(1) W, Lease/Rental of Equipment;
(2) X, Lease/Rental of Facilities;
(3) Y, Construction of Structures and Facilities;
(4) D, Automatic Data Processing and Telecommunications, IT and Telecom- Telecommunications Transmission (D304) and Internet (D322) ONLY;
(5) S, Utilities ONLY;
(6) V, Freight and Shipping ONLY.

BASE ACCESS. DBIDS PROGRAM. Marine Corps Installations East - Marine Corps Base Camp Lejeune and Marine Corps Air Station New River have implemented new DBIDS (Defense Biometric Identification System) Program intended to enhance Installation access control. In order to gain access to Marine Corps Base (MCB), Camp Lejeune and/or Marine Corps Air Station (MCAS), New River, non-Federal Government and non-DOD issued ID cardholders require identity proofing and vetting to determine eligibility for access. Specifically, a check of records through National Crime Information Center (NCIC) Interstate Identification Index (III) is Installation's minimum background check for access to MCB, Camp Lejeune and/or MCAS, New River for non-Common Access Card holders, to include access of visitors.
MCB, Camp Lejeune and MCAS, New River applies following non-Federal Government cardholder criteria to determine authorized type of access control credentials: a. Contractors:

CONTRACTOR COMMON ACCESS CARD (CAC) ELIGIBILITY. Contractor personnel authorized CAC’s are exempt from DBIDS enrollment.
Contractor personnel who are ineligible for a CAC shall be required to either obtain a 120-Day pass or enroll in DBIDS Program. Recommend pre-register on the DBID’s website before attempting to obtain a pass. Complete the requisite website form and applicable documents and provide to the Contracting Vetting Office.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019)
The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications--Commercial Items.
(a) Definitions. As used in this provision--
Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing--
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will'' provide covered telecommunications equipment or services”, the Offeror shall provide the following information as part of the offer-
(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);
(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;
(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and
(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2019)
(a) Definitions. As used in this clause--
Covered foreign country means The People's Republic of China.
Covered telecommunications equipment or services means--
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means--
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in Federal Acquisition Regulation 4.2104.
(c) Exceptions. This clause does not prohibit contractors from providing--
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:
(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) “TAILORED”
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
This is a Brand Name procurement.
This procurement is a 100% Small Business Set-Aside. All responsible business sources that are in this category may submit a response which, if received in a timely manner, will be considered by the agency.
This procurement is subject to the Buy American Act. If the product you are quoting is not American made, you must identify the country in which it is made.
An award will be made on the basis of best value, price and other factors considered. The Government intends to make an award to the vendor whose proposal represents the best value to the Government based on (1) vendor’s ability to meet the technical specifications, (2) delivery, (3) price and (4) past performance
Technical acceptability will be based on the demonstrated ability to meet the technical requirements. A mere statement that the vendor “will meet the Government’s requirements” is insufficient; the vendor must demonstrate how it will meet the requirement.
To ensure technical compliance with the requirements, vendor quotes shall also include the following information:
a. Vendor Specifications. The manufacturer’s name and manufacturer’s complete part numbers of items shall be submitted in the quote.
b. Vendor’s quote shall include an active Cage Code and Federal Tax Identification number. Vendors are required to be registered with SAM database and have an active cage code at the time of submission of quote.
c. Delivery Information. Clearly state if the quoter can meet the requested delivery/period of performance as stated in each CLIN. If not, then state the best delivery date.
Past performance will be verified via the Supplier Performance Risk System (SPRS).
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
