5237.102 Policy

The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for CATHOLIC AND PROTESTANT ACCOMPANIST via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil .

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil.

BASE ACCESS INSTRUCTIONS

1. In order to gain access to Marine Corps Air Station(MCAS)Beaufort and Laurel Bay Housing Area non-Federal Government and non-DoD issued ID cardholders require identity proofing and vetting to determine fitness and eligibility for access. Specifically, a check of records through the National Crime Information Center (NCIC) Interstate Identification Index (III) is the installation’s minimum background check for access to MCAS Beaufort and Laurel Bay Housing Area to include entrance of visitors.

2. MCAS Beaufort and Laurel Bay Housing Area apply the following non-Federal Government cardholder criteria to determine the authorized type of access control credentials:

a. Contractors: RAPIDGate or 30-Day Pass followed by 4-DayPass*

b. Sub-Contractors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

c. Vendors:

RAPIDGate or 30-Day Pass followed by 4-Day Pass*

d. Suppliers:

RAPIDGate or 30-Day Pass followed by 4-Day Pass*

e. Service Providers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

f. Delivery Personnel: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

g. Public-Private Venture (PPV) Housing and Installation Volunteers: Local Population Credential will be produced by the Security Manager Office. (The following are examples of Installation Volunteers: (Red Cross, Community College Instructors and Students, Family Readiness Volunteers, Wounded Warrior Volunteers, Commissary Baggers and any other organization approved by the Commanding Officer, MCAS Beaufort).

3. Contractor Common Access Card (CAC) Eligibility: Contractor personnel authorized CAC’s are exempt from RAPIDGate enrollment.

4. Contractor personnel who are ineligible for a CAC will be required to either obtain a 30-Day pass followed by a 4-Day pass* or enroll in the RAPIDGate Program. RAPIDGate is a voluntary program due to associated costs. For further information concerning contractor access, please contact the Security Manager Office at 843-228-7090. For information concerning enrolling in RAPIDGate please visit their website at www.rapidgate.com.

NOTE: The Government will not be responsible for any access delays. Delays that may result from inadequate planning are contractor responsibility.

Any and all costs associated with RAPIDGate are the sole responsibility of the contractor.

* Contractors will be issued a one-time pass for 30 days. Upon expiration of the 30 day pass, they will only be issued a 4 day pass every 4 days thereafter, for the duration of the contract.

WAGE RATE INFORMATION

No wage determination is being issued for this procurement. However, in accordance with Title 29 C.F.R. Part 4, Section 4.6(d), the contractor is requried to pay no less than Federal Minimum Wage.

STATEMENT OF WORK

STATEMENT OF WORK

The Marine Corps Air Station, Beaufort, SC has a requirement for a Catholic Accompanist and Protestant Music Director. It is the Government intention to award one firm fixed price contract. The Catholic Accompanist using chapel equipments shall provide the following:

(1) Services for the music program at Marine Corps Air Station Beaufort, South Carolina. An essential component of this requirement is the provision of a well organized and professionally executed liturgical music program, which promotes the full conscious and active participation of the assembly.

(2) Music compositions will be provided, in part, by the government “Book of Worship for U.S. Armed Forces,” 1974; “Breaking Bread” by Oregon Catholic Press; and the chapel music files. Additional music presented by the contractor will be based on compositions appropriate to the Catholic Church liturgical rites and calendar.

The Protestant Music Director shall provide the following:

(1) A music program at Marine Corps Air Station Beaufort, South Carolina. An essential component of this requirement is the provision of a well organized and professionally executed music program, which promotes the full conscious and active participation of the assembly.

(2) The provision of high quality worship opportunities for military and family members is an integral part of both the Roman Catholic and Protestant faith traditions.

REQUIREMENTS:

Qualifications for the position:

(a) Individual shall have at least two years experience playing in a church congregation.

(b) Individual must be able to effectively play the piano and organ.

(c) Individual must be able to sight read music

(d) Individual must be able to play traditional church hymns to contemporary church music in order to support all Catholic and Protestant services.

(e) Individual must be able to recruit, train, and coordiante volunteers for choir, praise team, cantatas, or other musical groups in support of chapel programs.

Duties include, but are not limited to, the following:

Organ/piano accompaniment and choral direction for rehearsals and worship services as listed.

1. Provide accompaniment (organ and piano) and direction for all congregational singing required during worship services listed in attachment B. Music composition will be provided, in part, by the government Book of Worship for U.S. Armed Forces, 1974; Hymns for the People of God by Paragon Associates, Inc.; and the chapel music files. Additional music presented by the contractor will be based on compositions appropriate to Protestant worship.

2. Submit applicable notices and announcements concerning choir activities; performances for review by the Protestant Chaplain at least ten days prior to inclusion in the Sunday bulletin or media release.

3. Work in cooperation with the Catholic chapel community to provide appropriate musical accompaniment and choral direction for the rehearsal and performance of a Christmas Cantata and an ecumenical Thanksgiving Day Service.

4. Actively work to improve the Protestant worship music program.

5. Select, teach and lead the Protestant chapel community in contemporary worship using contemporary praise choruses.

6. Recruit, schedule and coordinate special music performances to enhance the quality of the worship service.

7. Meet monthly with the Protestant Chaplain to coordinate musical support and liturgy planning.

8. Provide accompaniment and direction for a children’s choir during Children’s church.

SCHEDULE OF WORSHIP SERVICES

(1) The hours of performance for Sunday Worship Service are as follows:

Catholic Service – 9:30 – 10:45

Protestant Service – 11:00 – 12:15

(2) Hours of Practice are flexible to support the ministry.

TERMINATION

This contract can be terminated upon thirty days written notice by either party if terms of the contract are not fulfilled in the following ways:

1) Not providing written notice to Command Chaplain (or his/her representative) and concurrence of absence and assigned qualified and approved substitute.

2) Inability to work peacefully with others, both volunteers and chapel staff.

3) Inability to work in a pluralistic environment. This includes respect for denominational/faith group differences, and tolerance for diversity in a military setting.

EQUIPMENT

The contractor shall notify the Command Chaplain of any recommendations and requirements for the maintenance, repair and improvement of government owned organs, pianos and related equipment in the chapel center.

BILLING AND PAYMENT INFORMATION

Invoices for services performed shall be submitted by the contractor monthly, after completion of such services. Each invoice will include the number of services performed, the total amount of the invoice, the period covered and the purchase order number.

ABSENCES

When a substitute is needed, arrangement shall be made by the contractor. Substitutes must demonstrate proficiency in organ/keyboard/piano through audition prior to the event substituted. This proficiency must be demonstrated to the Command Chaplain at least two weeks in advance, except for emergencies. Payment of substitutes shall be the sole responsibility of the contractor. Absent without an adequate susbstitute may be cause for breach of contract and termination for cause.

INSTRUCTIONS TO VENDORS

INSTRUCTIONS TO VENDORS:

BACKGROUND: This is an acquisition for a non-personal service contract for a Catholic Accompanist/ Protestant Music Director. The Government anticipates to award of one firm fixed Price contract..

EVALUATION. Vendors responding to this announcement shall submit their quote in accordance with FAR 52.212-1. Submission of quote shall include the following: (1) Technical acceptability: to include a resume that meets the requirements of the Statement of Work; (2) Delivery: Period of Performance: 3 January 2016 – 2 January 2017 (3) Successful Audition Performance (4) Past Performance (5) Price:

BASIS OF AWARD. Award will be made to the lowest price technically acceptable (LPTA) quote that meets or exceeds the acceptability standards for non-cost factors.

TECHNICAL ACCEPTABILITY: To ensure technical acceptability, the quote shall:

a. Provide a resume that shows they meet the qualifications as stated in the Statement of Work.

b. Successful completion of an audition. (see below paragraph regarding audition),

c. Past Performance references. References should include agency or business name, phone number and email address, point of contact.

b. Clearly state that they can meet the required Period of Performance

AUDITION:

a. Perform a piece on the piano (classical/light classical inature) from printed music suitable for a church worship prelude, postlude, or offertory (3-5 minutes in length).

b. Sight reading: play on the piano a hymn from the hymnal

c. Accompany from the piano, a musical on a hymn from the hymnal

d. Praise Song: Play one of the following praise & worship songs from the piano (from memory or lead sheet (melody & chord symbols only) in a manner (key, tempo, rhythm) suitable for congregational singing.

Auditions will be scheduled by the MCAS Chaplain.

Quotes will be evaluated and ranked according to price, from lowest to highest. The Government reserves the right to evaluate only the lowest priced quote. Other technical quotes may not be evaluated unless the

Government determines the lowest price quoter to be unacceptable or non-responsive. In the event the Government determines the lowest price quote to be unacceptable, the technical quote of the next lowest price will be evaluated .This process will continue until a technical quote is determined to be acceptable.

52.204-17 Ownership of Control of Offeror (Nov 2014)

(a) Definitions. As used in this provision-- Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Contractor and Government Entity (CAGE) Branch to identify a commercial or government entity, or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Contractor and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as an NCAGE code.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAR 2015)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.

(a) Definitions. As used in this provision --

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

Veteran-owned small business concern means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

"Women-owned small business concern" means a small business concern--

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or

(2) Whose management and daily business operations are controlled by one or more women.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127)”, means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

(b) (1) Annual Representations and Certifications. Any changes provided by the offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications posted electronically on the SAM website.

(2) The offeror has completed the annual representations and certifications electronically via the SAM website accessed through https://www.acquisition.gov. (B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
