Performance Work Statement

1. Purpose: Upon government notification, the purpose of this agreement is to replenish propane to meet maximum levels (80%), entitled Service Locations in response to service calls made by the Governement Representitive (GR).

1. On Agreement: Contractor shall perform visual inspections, pressure tests to ensure all tanks are in proper working order.

1. Hours of Operation: Replenishment services shall be performed between the hours of 0600 – 1630 Monday through Friday. Saturday, Sunday, and Holidays services are not included in this agreement. If emergency services are required outside the normal hours of operation, a separate order apart from this agreement will be issued.

1. Propane Delivery Requirements: Propane gas will be delivered to depleted tanks as indicated on issued Task Orders (TO) and the included propane request/delivery sheet. The Government will fill in columns entitled “Tank Reading (%)” and “Estimated Gallons Needed”. The contractor will fill in columns “Start”, “Stop” & “Actual Fill Amount” and upon completion of services, will return it to the Facilities Maintenance section (760) 932-1595 accompanied with their delivery tickets denoting their business name & address. Contractor will ensure that tanks do not exceed 80%.

1. Invoicing: One (1) Invoice shall be submitted per delivery into Wide Area Work Flow (WAWF) for all propane tanks refilled during the delivery period. Copies of the delivery tickets shall be provided to the GR at the end of each delivery. All tanks shall be identified by location, serial number and tank size.

1. Response Time: The contractor shall respond to service calls made by the Contracting Officer within three (3) business days. Due to the remote location of the installation and the severe weather conditions that may hinder delivery of propane every effort will be made to deliver propane in the most efficient and expedient way however it shall not to exceed two and one half weeks more than twice in one year. Emergency calls, which occur when a critical tank reads 20% or when current or forecasted inclement weather prevents delivery on base, requiring a 48 hour delivery service will be mutually agreed upon between the Government and the Contractor. Should the contractor NOT be able to meet the delivery requirement, the Government shall be free to seek services from another contractor apart from this agreement.

1. Requested Services: The contractor shall provide all labor, materials, tools, equipment, transportation, and supervision necessary to perform in performance of this PWS. Any services involving restrictive access must be approved in advance by the proper authority of MCMWTC.

1. Special and Required Tools: The contractor shall ensure that a hose of at least 30’ is used for delivery at the lower base camp tanks as there are underground nitrogen lines that may be broken inside the fenced area.

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (AUG 2020)

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-

(i) The Offeror and/or any of its Principals-

(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and

(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and

(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

The Government intends to evaluate proposals and award multiple agreements without requesting or accepting revised proposals. Therefore, the offerors will be advised that their initial offer should contain the most favorable terms and reflect its best possible performance potential. The Government does reserve the right to clarify aspects of the proposals and hold discussions.

All proposals are to be submitted electronically as a PDF document to kyle.greene@usmc.mil.

FAXED PROPOSALS WILL NOT BE ACCEPTED

For proposals delivered by hand, offerors are advised that entry to the installation is restricted, and offerors are directed to familiarize themselves with the entry control location and process. Entry processing time is unpredictable and can be lengthy. The addressee indicated above may be able to facilitate entry processing, but is not required to do so, and inability to gain access shall not excuse late delivery.

If proposals are submitted in different formats requiring different delivery methods, the proposal of record shall be the last complete version received prior to the deadline.

For email proposals, the Government office designated for receipt of the proposal is the email inbox of the addressee indicated above. Notwithstanding the provisions at FAR 52.212-1(f) or FAR 52.215-1(c)(3), delivery is not accomplished until the addressee can open the email; delivery to a server or an email inbox on a server is not considered delivery to the designated Government office and the quotation is not under the Government’s control until the addressee can open the email. The email shall not be considered to be delivered unless the entire content of the email and all attachments can be read by the addressee indicated above. Receipt of an electronic acknowledgment from the addressee establishes that a record was received but does not establish that the content sent corresponds to the content received. Email attachments are limited to no more than 2MB. Offerors are specifically warned that email may be subjected to spam filters or attachment stripping.

All transmissions must clearly state the solicitation number and the name of the contracting officer on the first page to ensure proper receipt.

(i) technical capability,

(ii) price,

(iii) past performance.

(b) A written notice of agreement or acceptance of a proposal, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the proposal, shall result in a binding agreement without further action by either party. 52.212-2 ADDENDUM

52.212-2 EVALUATION--COMMERCIAL ITEMS--ADDENDUM

Basis for agreement- This acquisition is being conducted under FAR Parts 12 and 13. Quotes will be evaluated using the factors identified in FAR 52.212-2, Evaluation – Commercial items and this Addendum. Award will be made utilizing a Lowest Price Technically Acceptable (LPTA) source selection method.

Specifically, the evaluation process shall proceed as follows:

First, the quotes will be ranked in order from lowest to highest based on the price. The lowest priced quote will then be evaluated and receive a rating of Acceptable or Unacceptable based on the criteria below. In order to be rated as Acceptable, the Technical quote must meet the government's minimum requirements as described in the schedule, the 52.212-1 provision, and this 52.212-2 Addendum provision. Quotes deemed Unacceptable are those that fail to meet the Government's minimum requirements.

Past performance will then be evaluated and assigned a rating of Acceptable or Unacceptable. In order to be rated as Acceptable, the past performance must present either a reasonable expectation that the quoter will successfully perform the required effort or that the quoter’s performance record is unknown.

If the lowest priced quoter’s Technical Capability and past performance are rated acceptable, the government will then evaluate pricing to determine fair and reasonableness per FAR sbupart 13.5.

If the lowest priced quote is evaluated to have an acceptable technical quote, acceptable past performance, and fair and reasonable prices, per FAR Subpart 8.4, the Government will complete a responsibility determination IAW the criteria specified in FAR 9.104-1. If found responsible, the Government may stop the evaluation process at this point as that quote represents the best value to the Government. Award shall be made to that quoter without further consideration of any other quote.

If the lowest priced quote is assigned an unacceptable rating (either technical or past performance), or if the price is determined not fair and reasonable or if the quoter is found to be non-responsible, the next lowest priced quote will be evaluated. This process will continue (in ascending order) until a quoter is evaluated to have an acceptable technical rating, an acceptable past performance rating, fair and reasonable prices and the quoter is deemed responsible or until all quotes have been evaluated.

The Government reserves the right to evaluate all quotes.

Factor 1: Technical Capability

Each quoter’s technical capability will be evaluated as Acceptable or Unacceptable as defined below:

Technical Acceptable/Unacceptable Ratings

Rating
Description
Acceptable
Quote meets the minimum

requirements of the solicitation.

Unacceptable
Quote does not meet the minimum

requirements of the solicitation.

To be rated Technically Acceptable, the quoter must provide a technical approach which clearly describes how the oquoter will achieve the PWS objectives.

Factor 2: Price

In order to be considered for award, price must be determined fair and reasonable and balanced (or if unbalanced pricing exists that it does not pose an unacceptable risk to the government) using one or more techniques set forth in FAR subpart 13.5

Quoters are advised that the Option to Extend Services Clause at 52.217-8 is included in the solicitation and will be included in the agreement. When proposing prices for base and option years, quoters should consider that the Government may choose to exercise the option to extend services at the end of any period of performance (base or option periods), utilizing the rates in effect during the period of performance in which the option is exercised. For purposes of evaluation, the Government will take the proposed price for the final option period, divide it by two and add it to the overall proposed price.

Factor 3: Past Performance

The Government will conduct a performance risk assessment the quoter’s record of past and current performance, as well as that of its proposed subcontractors and team member as it relates to the probability of successfully performing the requirements of the solicitation. The past performance evaluation will consider the quoter's demonstrated recent (within the past three years) and relevant (similar in size and scope to the services identified in the schedule) record of performance in supplying services that meet the solicitation’s requirements. Quoters are advised that, in conducting the past performance assessment, the Government may use data provided in the quote and data obtained from other sources.

Past performance will be rated on an “acceptable” or “unacceptable” basis.

Past Performance Evaluation Ratings

Rating
Description
Acceptable
Based on the quoter’s performance record, the

Government has a reasonable expectation that the quoter will successfully perform the required effort, or the quoter’s performance record is unknown. (See note below.)

Unacceptable
Based on the quoter’s performance record, the

Government has no reasonable expectation that the quoter will be able to successfully perform the required effort.

Note: In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance. Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

The Government reserves the right to award no agreement at all depending on the quality of the quotes submitted and availability of funds for the requirement. The Government intends to evaluate quotes and award multiple agreements without requesting or accepting revised quotes. Therefore, the quoters will be advised that their initial quote should contain the most favorable terms and reflect its best possible performance potential. The Government does reserve the right to clarify aspects of the quotes and hold discussions.
