Contractor’s Unauthorized Work Performance. The Contractor shall not perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without approval of the CONTRACT ADMINISTRATOR/OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.

PERFORMANCE WORK STATEMENT (PWS)

PORTABLE TOILET SUPPORT SERVICES for

IAMS NORTHWEST ANNEX CHESAPEAKE

1. Scope. The Marine Corps Security Force Regiment requires portable toilet lease and support services for a site in IAMS Northwest Annex Chesapeake VA.

2. Requirement. The Contractor shall provide all management, labor, equipment, tools, materials, supplies, and services necessary to provide IAMS Northwest Annex Chesapeake, VA ten (10) portable chemical toilets for a period of (12) months.

2.1 Portable Toilets. Portable toilets provided shall be clean, in excellent condition, free of defects, and without graffiti. Units shall be constructed so that the occupant will be protected against the weather. All cracks shall be sealed and the door shall be tight fitting, self-closing, and able to be latched from the inside. Each unit shall be vented to the outside. Units shall be constructed so that the interior receives adequate lighting and all windows/vents shall be screened.

2.2 Maintenance. The contractor shall ensure all units are maintained in a clean, sanitary and fully operational condition at all times consistent with commercial health standards. The contractor shall provide weekly service on Tuesdays between the hours of 7:30 AM and 4:30 PM for all leased units at the locations identified in Section 2.3 below. Service shall include, but is not limited to:

1. Removal and disposal of all waste and trash in and around units in accordance with federal, state, and local laws regarding the handling of potential hazardous substances. Handling and disposal shall be in accordance with the Occupational Safety and Health Act. The Contractor shall immediately notify the Government point of contact and Contracting Officer of any spills, and thoroughly clean the contaminated area.

1. Cleaning and disinfection of unit inside and out, to include removal of graffiti.

1. Repair or replace damaged units within 24 hours of notification by the Government.

1. Refilling waste storage area to proper levels with chemical solution.

1. Stocking of toilet paper.

f. Maintaining a record of service by date utilizing a label affixed inside each unit.

2.3 Delivery and Service Locations. The contractor shall ensure the units are stabilized and easily accessible when delivered.

The Government Point of Contact has no authority to add or remove portable toilets with service. No additions or deletions shall be made to this contract without approval from the contract specialist.

3.0 Site Access. The contractor shall obtain the necessary passes and/or identification for entry onto Marine/Navy Bases for all employees prior to commencement of work. The Government reserves the right to refuse to issue a pass to any employee of the contractor for any reason deemed valid by the Government.

4.0 Quality of Performance. The Contractor shall adhere to quality standards throughout performance. The Government’s location point of contact shall assess the quality status of performance monthly.

5.0 Period of Performance. The period of performance for this service will be from 15 Nov 2018 through 14 Nov 2019.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) “TAILORED”

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

This procurement is 100% SMALL BUSINESS SET ASIDE. All responsible small business sources may submit a response which, if received in a timely manner, will be considered by the agency.

Quotes will be evaluated and ranks according to price, from lowest to highest. The Government reserves the right to evaluate only the technical proposal of the lowest price offeror. Other technical proposals may not be evaluated unless the Government determines the lowest price offeror to be unacceptable or non-responsive. In the event that Government determines the lowest price offeror to be unacceptable, the technical proposal of the next lowest price offeror will be evaluated. This process will continue until a technical proposal is determined to be acceptable.

Technical acceptability will be based on the demonstrated ability to meet the technical requirements, including the delivery requirement. A mere statement that the vendor “will meet the Government’s requirements” is insufficient; the vendor must demonstrate how it will meet the requirement. Lowest Price Technically Acceptable (LPTA) will be evaluated on: (1) price; (2) technical; and (3) delivery.

To ensure technical compliance with the requirements, vendor quotes shall include the following information:

1. Vendor Specifications. The manufacturer’s name and manufacturer’s complete part numbers of items shall be submitted in the quote.

1. Vendor’s quote shall include an active Cage Code and Federal Tax Identification number. Vendors are required to be registered with SAM database and have an active cage code at the time of award.

1. Delivery Information. Clearly state if the quoter can meet the requested delivery as stated in each CLIN. If not, then state the best delivery date.

Past performance will be verified via the Past Performance Information Retrieval System (PPIRS).

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

252.232-7010 LEVIES ON CONTRACT PAYMENTS (DEC 2006)

(a) 26 U.S.C. 6331(h) authorizes the Internal Revenue Service (IRS) to continuously levy up to 100 percent of contract payments, up to the amount of tax debt.

(b) When a levy is imposed on a payment under this contract and the Contractor believes that the levy may result in an inability to perform the contract, the Contractor shall promptly notify the Procuring Contracting Officer in writing, with a copy to the Administrative Contracting Officer, and shall provide--

(1) The total dollar amount of the levy;

(2) A statement that the Contractor believes that the levy may result in an inability to perform the contract, including rationale and adequate supporting documentation; and

(3) Advice as to whether the inability to perform may adversely affect national security, including rationale and adequate supporting documentation.

(c) DoD shall promptly review the Contractor's assessment, and the Procuring Contracting Officer shall provide a written notification to the Contractor including--

(1) A statement as to whether DoD agrees that the levy may result in an inability to perform the contract; and

(2)(i) If the levy may result in an inability to perform the contract and the lack of performance will adversely affect national security, the total amount of the monies collected that should be returned to the Contractor; or

(ii) If the levy may result in an inability to perform the contract but will not impact national security, a recommendation that the Contractor promptly notify the IRS to attempt to resolve the tax situation.

(d) Any DoD determination under this clause is not subject to appeal under the Contract Disputes Act.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)

(a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall--

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order:

(1) Document type. The Contractor shall use the following document type(s).

5237.102(90) The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for aircraft maintenance via a secure data collection site.

Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
