Sole Source Justification and Approval (J&A)
Under FAR 13.501(a)
1. Contracting Activity: ARPA-H Acquisition Management Office (AMO)
2. Description of Action: This J&A supports exercise of Federal Acquisition Regulation (FAR) Clause 52.217-8 for a period of six months for Purchase Order # 75N99223P00001. Although the FAR 52.217-8 clause was incorporated into the contract at the time of award the price was not evaluated during the pre-award phase, thus necessitating this J&A.
3. Description of Supplies/Services: The Advanced Research Projects Agency for Health (ARPA-H) seeks to obtain flexible and scalable on- demand office space for collaborative interaction. The location must be capable of providing move-in ready capability (to include chairs, desks, and storage), access to scheduled open meeting spaces, access to private and collaborative meeting spaces, and access to shared open workspace.
4. Authority Cited: 41 United States Code 1901 as implemented in FAR 13.501(a)(1), sole source under the authority of the simplified procedures for certain commercial items.
5. Reason for Authority Cited: This is to provide a gap measure with the current contractor, WeWork Commons LLC, to continue services after the end of the current contract that concludes on 30 June 2023. The extended coverage, six-month period, will begin on 01 July 2023 and conclude on 31 December 2023. The gap measure is needed to allow ARPA-H adequate time to secure a longer-term space in the Washington, DC metropolitan area.
6. Efforts to Obtain Competition: This action was synopsized on sam.gov, however the effort did not result in viable alternatives that would meet agency needs. There are no subcontracting opportunities under this action.
7. Actions to Increase Competition: No specific actions to increase competition have been taken in support of this FAR 52.217-8 option exercise, however extensive Market Research to identify commercial service providers as well as leased space options available through GSA is ongoing.
8. Market Research: Market research conducted to support the current contract is recent, completed in December 2022, and in alignment with current Agency needs.
Market Research to support the follow-on procurement or lease is ongoing.

Additionally, I approve this justification to limit competition provided that the services or supplies herein described have otherwise been authorized for acquisition. I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
Based on the foregoing justification, I hereby approve the procurement of commercial co-working space as a service from WeWork Commons, LLC in the amount of $275,300.00 on another than full and open competition basis pursuant to the authority of 41 U.S.C. 1901 as implemented by FAR 13.501.
