ADDENDUM TO 52.212-1

1. SUMMARY: This is a request for quotations (RFQ) utilizing the procedures of FAR Parts 12 and 13.5.

Responses to this solicitation are considered quotations or quotes and not offers. In this instance where the words offer, offeror, and proposal are used, the reader should understand that the use of such words does not change the nature of this request for quotations. The resulting award will be a Single award, Indefinite Delivery, Indefinite Quantity (IDIQ) service contract with task orders issued containing Firm-Fixed Price (FFP) contract line items. The period of performance shall be a one-year base period with four (4) possible one-year option periods and the option to extend services up to six months in accordance with (IAW) FAR 52.217-8.

2. SUBMISSION OF PROPOSAL: Quotes must be received no later than the date and time specified in block

#8, page #1 – Pacific Time (PT). Quotes shall be submitted via electronic form. The USMC email system does not accept email messages larger than 25MB and therefore multiple emails may be required if the quote package email (to include attachments) exceeds 25MB. Please ensure that each email attachment is limited to no more than 2MB. If multiple emails are submitted, please number the email. For example, “email 1 of 3”, “2 of 3”, and “3 of 3”. Please send quotes to both Alex Budai at alex.budai@usmc.mil and Patrick Baughman at patrick.baughman@usmc.mil.

Notwithstanding the provisions at FAR 52.212-1(f), delivery is not accomplished until the addressees can open the email; delivery to a server or an email inbox on a server is not considered delivery to the designated Government office and the quote is not under the Government’s control until the addressees can open the email. The email shall not be considered to be delivered unless the entire content of the email and all attachments can be read by the addressees indicated above. Email attachments are limited to no more than 25MB total. Offerors are specifically warned that email may be subjected to spam filters or attachment stripping.

Attention is directed to FAR 52.212-1(f), concerning late submissions. Offerors are responsible for allowing adequate time for electronic submissions to be completed. The offeror bears the risk of ensuring that all pages of the quote (and any authorized modifications) and receipt of attachments have been received by the designated office before the deadline indicated. Any pages of the quote or receipt of attachments that arrive after the deadline will not be considered.

The Government may make award based solely on the quotes received. However, pursuant to FAR 52.212-1, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

(End of Addendum)

52.212-2 Evaluation - Commercial Items NOV 2021

CLAUSE(S) 52.212-2 - 52.212-2 ADDENDUM

52.212-2 ADDENDUM

Regional Contracting Office, Camp Pendleton, CA, is issuing Request For Quotation (RFQ) to procure sufficient quantities and types of trained, qualified, or certified Contractor personnel as requested by the Government to perform the required tasks for each service type described in this Performance Work Statement (PWS) for Marine Corps Base Camp Pendleton, California. The D8T Bulldozer, MC500093, is a Camp Pendleton Landfill asset. This is one of only two Bulldozers that are exclusive to the landfill.

This procurement is conducted in accordance with FAR Part 12 (Acquisition of Commercial Items) utilizing FAR Part 13 (Simplified Acquistion Procedures).

Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-03, effective 02/23/2024 and DFARS Change Notice (DCN) 02/15/2024, effective 02/15/2024.

BASIS FOR AWARD. Award will be on the capability of the quoter to meet or exceed the specifications and pricing determined to be fair and reasonable. The resulting award will be a Firm-Fixed Priced purchase order, all or none, to provide repair and maintenance services to service a Caterpillar D8 Bulldozer, MC500093.

EVALUATION. The Government intends to make a single Firm Fixed Price award to satisfy this requirement.

Award will be made on the initial evaluation of quotes received in response to this RFQ. Therefore, quoters are cautioned to ensure that initial quotes contain your best terms from a technical and price standpoint. The following factors will be used to evaluate quotes:

Factor # 1 – Technical Capability – Each quoter’s technical quote shall be evaluated as Acceptable or Unacceptable as defined below:

Technical Acceptable/Unacceptable Ratings

Rating Description

Acceptable Quote meets the requirements of the Performance Work Statement.

Unacceptable Quote does not meet the requirements of the Performance Work Statement

To be rated Acceptable, the quoter must provide a detailed narrative which clearly describes and demonstrates how the quoter will accomplish the stated requirements of the PWS. When evaluating the quoter’s technical quote, the Government will determine if the quoter has met the following minimum requirements:

1. Quoter’s ability to meet all requirements in accordance with PWS Sections 3, 4, 5, 6, 8, and 9.

2. Quoter’s ability to provide a Mission Essential Contractor Services Plan IAW DFARS Provision 252.237-

7024.

3. Quoter’s ability to provide evidence that they own, or can acquire and provide the equipment listed in the

PWS.

IMPORTANT: If the quoter simply restates the requirements in the sections of the PWS, the quoter’s proposal will receive a technical rating of Unacceptable. A capabilities statement is not an acceptable technical proposal.

Factor #2 – Past Performance

The Government will conduct a performance risk assessment of the quoter’s record of past and current performance, as well as that of its subcontractors and team members, as it relates to the probability of successfully performing the requirements of the solicitation. The past performance evaluation will consider the quoter's demonstrated recent (within the past three years) experience on contracts of similar size, scope, and complexity, either with a Government agency or commercial entity, which demonstrate the quoter’s ability to perform the requirement.

Quoters are advised that in conducting the past performance assessment, the Government may use data provided in the vendor’s quote and data obtained from other sources. The Government may contact customers identified by the vendor to obtain follow-up of Past Performance Information as needed.

Past performance will be evaluated as Acceptable or Unacceptable as defined below:

RATING DESCRIPTION

ACCEPTABLE

Based on the quoter’s performance record, the Government has a reasonable expectation that the quoter will successfully perform the required effort, or the quoter’s performance record is unknown (See note below).

UNACCEPTABLE

Based on the quoter’s performance record, the Government has no reasonable expectation that the quoter will be able to successfully perform the required effort.

Note: In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance. Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Factor #3 – Price

The price quote shall be submitted separately from the technical quote. The Government will use one or more techniques set forth in FAR 13.106-3 to evaluate the price reasonableness of each quote determined to be acceptable for both technical and past performance criteria. To determine the overall lowest price offer, the Government will review the quoted prices for each CLIN in the SF1449 Schedule of Supplies and Services.

4. EVALUATION PROCESS: The evaluation will proceed as follows:

Step 1 – The Contracting Officer will review offers to determine if each offeror has submitted a responsive quote. To be responsive, quoters must submit all the documentation identified above, by the RFQ close date/time shown in block 8 of the SF1449. A quote may be eliminated from the competition without further consideration if it does not meet the responsiveness requirements.

Step 2 – Quotes that have been determined responsive will then be evaluated and receive a rating of

Acceptable or Unacceptable based on the technical acceptability criteria above. Offerors must receive an “Acceptable” rating on each technical element to be determined technically “Acceptable”.

Step 3 – Remaining technically acceptable quotes will be ranked in in order from lowest to highest based on submitted CLIN prices. All CLIN prices will be evaluated and determined to be fair and reasonable using one or more of the techniques set forth in FAR 15.404-1(b)(2). The assessment of price will consider the overall quoted price. Quotes containing only partial pricing will not be evaluated.

Step 4 – The three lowest price, technically acceptable quotes will be reviewed for delivery acceptability in accordance with terms specified above. Those Offerors that do not quote delivery as requested will not be evaluated.

Step 5 – If the three lowest price, technically acceptable quotes are judged to have an “acceptable” delivery, those quotes represent the best value for the government and the evaluation process stops at this point. Award shall be made to the lowest quoter without further consideration of any other quotes.

If the Government cannot assess acceptable delivery among the initial three lowest price, technically acceptable quotes, it may (at the Contracting Officer’s discretion) conduct an assessment on the next higher priced quotes until one or more selections can be made.

The Government reserves the right to award no contract, depending on the quality of the quotes submitted and availability of funds for the requirement. The Government intends to evaluate quotes and award a single contract without requesting or accepting revised quotes. Therefore, the Offerors will be advised that their initial quote should contain the most favorable terms and reflect its best possible performance potential. The Government does reserve the right to clarify aspects of the quotes and hold discussions.
