Statement of Work (SOW)
1.0 Background: Motor Transport Maintenance Company, 1st Maintenance Bn does not have the appropriately training personnel to accomplish the assembly /installation task. For safety reasons, it would be most preferred for the contractor conduct the assembly of the cranes.
2.0 Scope: Motor Transport Maintenance Company, 1st Maintenance Bn will be purchasing three (3) adjustable height gantry cranes for overhead lift capability. Once the materials have been received, an assembly team will be required to assemble the three (3) cranes.
3.0 Tasks:
3.1 Contractor shall provide own tools & equipment to assemble/install the cranes that were purchased.
3.2 Contractor shall perform the manufacture load test.
3.3 Contractor shall coordinate the date and time for assemble/install with the Technical Point of Contact.
3.4 Contractor shall remove and dispose of properly all packing, package material upon completion of assembly.
4.0 Government Technical Point of Contact. The Contracting Officer shall designate a Government Technical Point of Contact (TPOC) during the term of this contract. The TPOC will provide assistance in identification and resolution of problems, conflicts in priority, subtask requirement definitions, and other operations type problems within the scope of this Statement of Work. The TPOC will provide technical clarification and assistance in support of the contract requirements. The TPOC DOES NOT have the authority to make changes and/or give direction under this contract. The only authority under this contract authorized to make changes, give direction, and/or provide monetary adjustments is the Contracting Officer from the Regional Contracting Office MCI-WEST, Camp Pendleton CA.

5.0 Contracting Officer Authority. The Contracting Officer is the only person authorized to direct changes in any of the requirements under this contract, and, notwithstanding any provisions contained elsewhere in this contract, said authority remains solely in the Contracting Officer (Reference Block 31 on the SF1449). In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and solely at the risk of the contractor.
Enterprise-wide Contractor Manpower Reporting Application (ECMRA) Reporting The contractor shall report labor hours (including subcontractor hours) required for performance of services recycling equipment maintenance provided under this contract via secure data collection site. The contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal Year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil
Submissions must be received by the Government no later than Wednesday, September 20, 2017 5:00 PM (PST). Offerors that fail to provide all required information due to a transmission error may be rejected as non-responsive
6.0 eCMRA The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Service Wheeled Equipment via a secure data collection site.
Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
(1) W, Lease/Rental of Equipment;
(2) X, Lease/Rental of Facilities;
(3) Y, Construction of Structures and Facilities;
(4) D, Automatic Data Processing and Telecommunications, IT and Telecom- Telecommunications Transmission (D304) and Internet (D322) ONLY;
(5) S, Utilities ONLY;
(6) V, Freight and Shipping ONLY.
The contractor is required to completely fill in all required data fields using the following web address: https://sam.gov/SAM/.

**To allow users additional time to transition from the former ECMRA to SAM, DOD is allowing a one-time only extension of the FY20 Service Contract Reporting (SCR) submission from 31 October 2020 to 31 January 2021.
**Contractors may submit and correct reports in SAM through this date on eligible service contracts performed during FY 2020 (Oct. 1, 2019 – Sep. 30, 2020).
**To assist DOD users and contractors with the transition, the DOD Guidebook for Service Contract Reporting in the SAM is available on the DOD Procurement Toolbox (https://dodprocurementtoolbox.com/sitepages/service-contract-reporting-scr).
7.0 Base Access
CURRENT CONTRACTORS
RAPIDGate/MCESS card holders will be required to transition to the Defense Biometric Identification System (DBIDS) credential in order to access MCB Camp Pendleton, MCAS Miramar, MCAS Yuma, MCRD San Diego, MCMWTC Bridgeport, MCAGCC 29 Palms and other controlled areas within the MCIWEST Region.
DBIDS credentials will be valid for the duration of your contract, not to exceed five years; however, re-vetting of individuals’ information will occur each year.
Contractors will be required to bring the following items:
Current RAPIDGate/MCESS credential Second form of government-issued photo identification (Real ID Act Compliant, driver license, passport, etc.)
Company Contract/Letter of Authorization (this should come from the COR or the Contracting Officer) SECNAV form 5512/1 (the sponsoring organization should complete block 28 of the SECNAV form).
New DBIDS credentials will be valid for the remainder of the contract (not to exceed 5 years), but individuals will be re-vetted each year.
Effective 1 October 2018, all contractors and venders must be in possession of a DBIDS credential that is authenticated for all MCIWEST and west coast Service-Level Training Installations (SLTI).
Access to MCB Camp Pendleton through Naval Weapon’s Station Seal Beach, Detachment Fallbrook is prohibited unless DBIDS credential is authenticated (I.E., work is also performed there).
NEW CONTRACTORS
New contractors requiring access to MCIWEST installations will be issued temporary passes for up to 60 days. .
If you are a new contractor seeking enrollment into DBIDS, please contact the Contracting Officer and/or Contract Specialist managing the contract awarded to your respective company.
COMMON ACCESS CARD (CAC)
(a) The Contractor shall provide proof that a National Agency Check with Inquiries (NACI) has been submitted to the Office of Personnel Management (OPM) for each employee requiring a CAC Card. During the period between the time that the request is submitted and the time that the investigation is returned, the Government may grant temporary access to the Contractor employee. Whether to grant temporary access is within the sole discretion of the Government, and a decision not to grant access shall not be grounds for a claim, request for an equitable adjustment or other contract modification, and shall not constitute an excuse for Contractor failure to perform. Such temporary access will not exceed 90 days.
(b) Upon the return of the Investigation Schedule Notice and Certificate of Investigation from OPM, the Contractor shall provide a copy to the security manager that has overall responsibility for the customer supported by the Contractor’s employees.
(c) "Report of Agency Adjudication Action" (form 79A) is sent when there are potential actionable issue(s) at the minor, moderate, or substantial level which may be disqualifying under suitability/security considerations. If the contractor receives an Agency Adjudication Action from OPM, the security manager shall be consulted before such adjudicative action is determined and returned to OPM.
(d) The Government will use the Adjudicative Guidelines (CNO ltr 5520 Ser 09N2/6U871220 of Sept 06) to guide determinations on whether access will be granted.
(e) The Contractor will be notified in writing if there is a disqualifying event that prevents the Contractor’s employee from obtaining a CAC. If temporary access was granted, it will immediately be revoked.

Base access requirements and procedures may change during the term of a contract. The contractor shall comply with all changes, and such compliance shall not be grounds for a request for an equitable adjustment or other contract modification.
ADDITIONAL REQUIREMENTS
(a) Photography is restricted on the Base. Clearance for photography shall be obtained in advance from appropriate Base personnel. When requested, all film or storage media must be turned over for processing and security inspection.
(b) Some areas of the Base may be inaccessible due to road conditions following heavy and/or prolonged rainfall. Adjustments to work schedules due to road/weather conditions shall be coordinated with the Contracting Officer. If your vehicles gets stuck or breaks down, military personnel cannot pull or tow your vehicle. Call MCRD San Diego PMO ((619)524-4202) who will refer you to a civilian wrecker service or information (411) for assistance.

9.0 Questions & Answers asked on previous solicitation by contractors:
1. Question: Do you require (3) Trolleys and (3) Hoists as well?
Answer: YES
2. Question: Even with meeting the max Clear Span of 13'6", the overall system width is only 15'7" which is less than your minimum 'Foot Span' of 17'. Can you clarify these dimension requirements?
Answer: -We want to keep the dimensions as requested so that the Hoist can fit under our recently purchased Big Tops.
3. Question: Please clarify what system dimension the 'Wheel Tread' refers to. Would this be the width of the gantry crane when viewed from the side? Our solution would be structurally sound at less than the minimum 9'7" required.
Answer: The Minimum requirement we submitted it to fit the needs of our day to day mission.
4. Question: In Amendment 001 Question 1 you said you wanted hoist and trolleys. Please provide the specifications for these items.
Answer: What specifications are you talking about? We already gave the specs (attached). Is there anything else besides what we sent?
5. Question: We are assuming the new gantry and hoists will need to meet P-307. Please identify what items in P- 307 we must meet.
Answer: P-307 is a weight handling program. The Marine Corps’ weight handling program is reference in MCO 11262.2B. The gantry and trolleys that we are trying to procure will fall within this order. The senior staff at MTM is certify to conduct any and all weight handling requirements. We do not required anything outside of the reference.
6. Question: Trolley’s and hoists are rated at one capacity. Are you asking for a 7 Ton trolley hoist?
Answer: We want a 5-ton hoist. Because it was asked to provide a minimum and maximum, we said we need it between 5-ton through 7-ton. I would prefer to get 5-ton hoists, but 7-ton hoists will work as well.
7. Question: What voltage for the trolley hoists?
Answer: 110v
8. Question: Who will provide the floor disconnect and where should it be mounted. Any drawings to show this?
Answer: No need. We are asking for mobile gantries and do not need them locked to the floor.
9. Question: How will the gantries get power from the disconnect, mounted on the facility to the gantry?
Answer: We will run power to them from our building or use generators, if need be.
10. Question: The gantry is supposed to have wheel brakes, will it require swivel locks?
Answer: Yes.
11. Question: We are assuming installation and load testing will be accomplished by the Government?
Answer: The installation needs to be conducted by the company that is contracted. The only thing we need is the manufacture load test and the government will take care of anything beyond that.
12. Question: The current requested delivery does not seem possible currently. Due to covid many suppliers have much longer deliveries. Should we just quote our best delivery?
Answer: Understand the issues with the delivery date. Please make it for as soon as possible.
13. Questions: Will the gantries be used indoor or outdoor? Need NEMA rating of enclosures.
Answer: They will be used outdoors. NEMA rating is not required since we will not be using them indoors.
14. Question: Do they want manual or electric hoists?
Answer: One electronic and two manuals.
15. Questions: If manual do they want geared or push trolleys?
Answer: Push trolleys.
16. Question: If electric do they want motorized trolleys or push trolleys?
Answer: Push trolleys.
17. Question: If electric what voltage do they require?
Answer: 110v
18. Question: If electric, we would need the voltage. Do you want a 5T or a 7.5T?
Answer: 5-ton.

1. SUBMISSION OF QUOTATIONS: Quotations must be received no later than 04-Aug-2021 10:00 AM Pacific Daylight Time (PDT). Quotation shall be submitted via email. Please respond to Sgt Alvarez Luis.

2. QUESTIONS: Questions shall be submitted by email no later than 2 days after issuance of the solicitation to the email address listed below. No phone questions will be accepted. The deadline is necessary to ensure timely award and the Government may, in its sole discretion, choose not to respond to questions received after the deadline. All questions will be reviewed and responded to by an amendment to the solicitation. Email questions to Sgt Alvarez Luis. Luis.alvarez2@usmc.mil.
3. PERIOD OF ACCEPTANCE OF OFFERORS: The pricing terms and conditions of the proposal shall be valid for 90 days unless a longer time is stated otherwise in the quote.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(Contracting Officer shall insert the significant evaluation factors, such as (i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) past performance (see FAR 15.304); and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.)

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (FEB 2021)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision --
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except--https://www.sam.gov/

(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Reasonable inquiry” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
“Sensitive technology”--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
"Small business concern"--
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned--
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.
The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
“Veteran-owned small business concern” means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern--
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127)”, means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
