STATEMENT OF WORK

BACKUP GENERATOR MAINTENANCE FOR EMERGENCY GENERATORS AT MARINE CORPS

INSTALLATION WEST - MARINE CORPS BASE, CAMP PENDLETON

SECTION 1 – GENERAL:

1.1 LOCATION

The project is located at Marine Corps Installations West-Marine Corps Base, Camp Pendleton (MCIWEST-MCB

CAMPEN).

1.2 OBJECTIVE

The purpose of this contract is to perform backup generator preventive maintenance (PM) and inspections for 174 emergency standby generators.

1.3 BACKGROUND

The San Diego Air Pollution Control District (SDAPCD) performed an annual compliance inspection 10 Jan 2017 to 23 Mar 2017. A total of 203 permits were inspected of which 174 were backup generators. On 23 Mar 2017 the SDAPCD issued forty eight (48) Notices of violation (NOV). Forty two (42) of the NOVs involved one hundred eleven (111) backup generators. The NOVs cited Reference (1), SDAPCD Rule 69.4.1, noting that maintenance logs did not indicate completion of required annual maintenance.

The requirements to perform backup generator inspection and maintenance are listed in SDAPCD Rule 69.4.1 Section f(1) and f(2) where inspections are called for at least every six month and generator maintenance is required at least annually.

SECTION 2 – WORK ELEMENTS:

2.1 Work Element 1: Kickoff Meeting

The Contractor shall conduct a project “kickoff” meeting to develop a plan of action and milestones (POA&M) within ten (10) calendar days of the contract award. The Contractor shall provide the project manager with a detailed agenda two (2) calendar days prior to the kickoff meeting and shall revise this agenda as required by the project manager. The agenda of this meeting will include discussion of access to the activity, activity points of contact, scheduling and other issues related to the contract. The Contractor shall provide and distribute meeting minutes within five (5) calendar days after the kickoff meeting.

2.2 Work Element 2: Plans

2.2.1 Within 14-days after the kickoff meeting the Contractor shall perform an initial inspection and verify the inventory of equipment listed on the Generator List. The Contactor shall develop an Equipment Assessment Report detailing the condition and operability of the equipment. The updated inventory shall be electronically submitted to government.

2.2.2 Within 28 days after the kickoff meeting the Contractor shall develop and submit a detailed work plan for performing inspections and maintenance on 174 emergency generators. The work plan shall include a schedule that details inspections and PM for each location. The PM plan must demonstrate complete permit compliance with generator maintenance requirements. The PM plan shall be developed based on an economical approach, and in accordance with manufacturer’s recommended procedures, OEM standards, and maintenance required satisfying equipment warranties, where applicable.

2.3 Work Element 3: Performance of Generator Inspections and Maintenance

2.3.1 The Contractor shall perform one year of preventive maintenance (PM) and inspections on 174 backup emergency generator systems to ensure permit compliance, proper operation, minimization of breakdowns, and to maximize useful life. At a minimum each generator must be inspected every six months and PM shall be conducted on each backup generator at least once each calendar year.

2.3.2 Preventive maintenance includes but is not limited to changing fluids, lubricating, bearing inspection and replacement, replacement of small parts, belt adjustments and replacement, filter inspection and replacement and system testing and diagnostics.

2.3.3 During Inspections and PM the Contractor shall clean each backup generator and assure the generators are maintained in a clean, dust free working condition. The Contractor is responsible for assuring the backup generators are maintained in a clean working condition and will function properly during power outages. The Contractor shall perform necessary test and troubleshooting to identify generators that are not functioning properly and make recommendations for repair or replacement.

2.3.4 Filter Replacement – The Contractor is responsible for one filter replacement for each of the generators.

Filters must be identified, ordered, installed and documented as part of the preventive maintenance. Disposal of used filters is the responsibility of the Contractor.

2.3.5 If the Contractor encounters a required repair discovered PM, the Contractor shall secure, tag out or provide a temporary fix prior to leaving the work site and immediately notify the Contracting Officer Representative. The Contractor shall provide written documentation of unsatisfactory conditions and make recommendations for repairs.

2.3.6 Excessive or repeated service call requests for equipment breakdowns or deficiencies may indicate the need for the Contractor to adjust or modify its PM program. These adjustments shall be made at no additional cost to the Government.

2.3.7 As part of preventive maintenance the Contractor shall assure that all control devices are calibrated and functioning properly. The Contractor shall, when necessary, configure, operate, and maintain engine and control devices according to the manufacturer's emission-related written instructions. Contractor may change only those emission-related settings that are permitted by the manufacturer.

2.3.8 The Contractor shall report any control devise that cannot be calibrated or is not functioning properly.

2.3.9 The Contractor shall enter inspection and PM activities into an operating log in each emergency generator room or enclosure containing. Log entry shall include the following: (a) dates and times of engine operation; whether the operation was for maintenance and testing purposes or emergency use; and the nature of the emergency, if known; (b) records of any engine maintenance, PM, and repairs to include the date and a description of the maintenance that was performed; (c) hours of operation for all uses other than those specified above and identification of the nature of that use; (d) date and amount of fuel added; (e) meter and gauge readings and (f) legible name and signature of person performing work and/or making log entry.

2.3.10 The Contractor must possess and provide necessary tools and equipment to perform inspections, testing, PM and small repairs.

2.3.11 The Contractor personnel working on Emergency Generator Systems must be properly trained, qualified and possess applicable state and local licensing/certification requirements. The Contractor shall maintain an up to date record of employees with their qualifications and training. Mechanics performing PM must demonstrate appropriate PM experience, preferably with backup generators.

2.3.12 Reports – The Contractor shall submit monthly reports on inspections and preventive maintenance performed. The report shall document status of all activities with respect to approved workplan and schedule.

Monthly reports will include recommended repairs. The Contractor shall complete, sign and date a form for each time PM or an inspection is performed. One copy of the form is to remain on location with the logbook.

Each form will be submitted electronically as part of the monthly report. Form format and required information must be approved by the government project manager.

2.3.13 The Contractor is responsible for the proper disposal of all waste materials generated as part of performing work under this contract. The Contractor is responsible for properly identifying hazardous waste and making proper disposal.

2.3.14 The Contractor is required to obtain access to USMC MAX /MAXIMO to facilitate work order processing and data collection. Attachment A describes Contractor New Combined Access Card (CAC)

Process. The Contractor shall use Preventive Maintenance (PM) work orders generated by MAXIMO to satisfy contract requirements for planning and execution of services. Contractor shall document work completion by uploading PM field sheets with data, finding, repairs made and complete LOG Tab entries into MAXIMO. Contractor shall initiate a service request/work order in the event further repairs are required.

SECTION 3 – SPECIAL CONDITIONS:

3.1 The Contractor shall obtain approval from the installation POC prior to obtaining photography records, still or motion picture and/or aerial or ground photographs, in accordance with Public Law: 18 U.S. Code 795 and applicable installation regulations. The government may provide a representative to act in an advisory capacity to prevent unauthorized disclosure of classified information.

3.2 Regarding public affairs, the Contractor shall not make available to the news media, or make public disclosure of, any data resulting from actions in this contract. The Contractor shall refer all press or public contacts to the installation POC and shall notify the project manager of their actions. The Contractor may not distribute reports or data to any other source, unless specifically authorized by the installation or Navy Public Affairs Officer. In the event that photographs are required for this contract or pictures are taken to record work progress, the government shall retain final possession of any photographic negatives via the final reports and deliverables or electronic files.

3.3 Any oral directions, instructions, explanations, commitments, and/or acceptance given by any government employee to the Contractor or his personnel, shall not be construed by the Contractor as a change in SOW. Any change in SOW must be issued to the Contractor, in writing, by the Contracting Officer to be binding on the government.

3.4 The Contractor shall communicate regularly with the project manager and the installation POC by phone or electronic mail as to the progress and status of field operations.

3.5 The Contractor shall provide copies of all correspondence to the project manager and the contracting specialist.

3.6 Deliverables shall be submitted with a responsive summary, indicating how each government/regulatory comment was addressed.

3.7 The Contractor shall not incorporate the responses to government comments into any final report unless the project manager has indicated that the Contractor’s response appropriately addresses the government’s review comments.

3.8 The Contractor shall not proceed to the next deliverable without receiving written government approval of the preceding deliverable.

3.9 Deliverables. All deliverables shall be submitted in accordance with the schedule matrix. Deliverables shall use MS-Windows compatible systems on electronic media including word processing language in Microsoft Word, spreadsheet information in Microsoft Excel, and other data (maps, charts) compatible with Adobe Acrobat Reader.

3.10 The Contractor shall provide all personnel, supplies, material, and equipment necessary to complete all work required in this contract.

3.11 Health and safety. The Contractor shall develop and adhere to a site-specific health and safety plan to protect Contractor and government personnel. The Contractor is responsible for the health, safety and well-being of all employees performing work under this contract.

3.12 Data generated. Copies of all laboratory analyses, calculations, reports, etc., generated for the execution of this contract shall become the property of the government and shall not be released or discussed with any other agency or individual without the prior approval of the government project manager.

3.13 Regulatory agencies. Any contact with regulatory agencies by the Contractor related to this contract shall be coordinated by the Installation POC.

3.14 Regulations. The Contractor shall comply with all applicable laws and regulation in connection with the performance of the work under this contract. The Contractor is responsible for understanding and complying with Base regulations. The Contractor shall be solely liable for all damages to persons or property that occurs as a result of work under this contract. The Contractor shall take proper precautions to protect the public as well as government and public property.

3.15 Security and Site Access. The Contractor shall obtain all necessary personnel identification cards and vehicle passes requirements as necessary to meet the installation’s security requirements. Base access will be coordinated through the Client Representative. Notify the project manager prior to starting field work in order to coordinate access. The Contractor shall provide a list of all personnel who will be performing no later than five (5) days prior to commencing the field work. All contract personnel performing work on site on this task must possess a U.S.

citizenship or a Permanent Residence Status.

3.16 Notification of field work. The Contractor shall be responsible for the timely notification to the project manager of the dates and times that the Contractor will be on the installation.

ATTACHMENT A

USMC MAXIMO SYSTEM ACCESS PROCEDURES

Contractor (CTR) New Combined Access Card (CAC) Process

RCO will provide names of New CTR’s requiring a CAC and the contract name to either the Training Coordinator or the Customer Service Supervisor.

The Training Coordinator is located in the Facilities Maintenance Division (FMD) Customer Service Section in Bldg. 2291, Rm 24 and can be reached via telephone at 760-725-4981.

The following steps must be followed for a new Contract Employee to obtain his or her CAC:

1) New CTR must create a Marine Net account in order to access required Cyber C Annual Information Assurance (IA) Training. This training is required to obtain a CAC. Marine Net requires a government sponsor. Provide them with the following POC:

2. Once Marine Net receives confirmation of sponsorship they will activate the CTR’s Marine Net account at which time the CTR can begin their training.

3. The new CTR will then log in to Marine Net and complete the CyberC course which consists of 2 online courses (Cyber Awareness Challenge and PII). Marine Net can be accessed at the base library (Bldg 1146) or on a private computer with internet access. Once the 2 courses are complete Marine Net will auto generate the CyberC certification (3rd certificate).

4. Complete a SAAR Form, DD Form 2875, Aug 2009. If the Contracting Company does not have a copy of this form it can be obtained through FSC or the Training Coordinator. The SAAR form MUST be completed electronically (if ink is used it will be returned to the Training Coordinator).

5. Upon completion, the CTR or CTR Representative will return all three documents (SAAR, CYBER C Cert and PII Cert) electronically to the Training Coordinator.

6. The Training Coordinator will verify the accuracy of the documents and route the SAAR electronically for the appropriate signatures. Once the Training Coordinator has obtained all signatures the SAAR form will then be forwarded to Base Security so they can start the CTR’s Background Investigation. The CTR is required to provide Base Security their Social Security Number.

7. Once the background investigation is completed, Base Security will email the SAAR form back to the Training Coordinator who will do the appropriate paperwork and send a ticket to FMD’s IT Staff. FMD IT will obtain an official email address. Once obtained, electronic documentation will be emailed to the Training Coordinator.

8. Finally at this point the Training Coordinator will make contact with the CTR either via telephone or email. The Training Coordinator will request a meeting with the CTR so the CTR’s information can be entered into the CVS computer system and then the CTR will be directed to Pass and ID. They must present 2 forms of ID to obtain their

CAC.

9. Once the CTR has the CAC in hand they need to call FMD IT Personnel to determine a good time for the CTR to digitally sign their SAAR form. The USMCmax Support team can be reached via telephone at 760-763-9890 or 760-763-9891 and is located at Bldg. 2291, Room 18A. Once the CTR has their CAC in hand they can go to Bldg.

2291 to the USMCmax Support office and request a Maximo account. USMCmax Support personnel will have the CTR complete a form and either give them a Maximo Training date and time right then or they may need to call them with the scheduling information. Maximo training is required for anyone that will be obtaining a Maximo account.

52.212-1 ADDENDUM

1. SUBMISSION OF QUOTATIONS: Quotations must be received no later than the date and time specified in block #8, page #1 – Pacific Daylight Time (PDT). Quotes shall be submitted via email. Please respond to luong.phan@usmc.mil directly with quotation.

2. QUESTIONS: Questions shall be submitted by email no later than 2 days after issuance of the solicitation to the email address listed below. No phone questions will be accepted. The deadline is necessary to ensure timely award and the Government may, in its sole discretion, choose not to respond to questions received after the deadline. All questions will be reviewed and responded to by an amendment to the solicitation. Email questions to luong.phan@usmc.mil.

3. PERIOD OF ACCEPTANCE OF OFFERORS: The pricing terms and conditions of the proposal shall be valid for 90 days unless a longer time is stated otherwise in the quote.

4. SAM. Offerors must be registered in the System for Award Management (SAM) database. Information in SAM should be current, if not – completion of the attached FAR Provision 52.212-3, Certifications and Representations is required with quotation. Information on registering in SAM may be obtained from www.sam.gov or calling 866- 606-8220. Registration in SAM is free.

5. WIDE-AREA WORKFLOW – RECEIPT AND ACCEPTANCE. As a condition of receipt of any resulting order, the Contractor agrees to implement the Department of Defense (DOD) web-based application. Information on registering in WAWF/iRAPT may be obtained from https://wawf.eb.mil/xhtml/unauth/registration/notice.xhtml or calling 866-618-5988. Registration in WAWF/iRAPT is free.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical capability that meets the needs of the Government; and

(ii) Price

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-2 ADDENDUM

Regional Contracting Office, Camp Pendleton, CA, is issuing Request For Quotation (RFQ) to procure Standby Generator Maintenance services. This procurement is conducted in accordance with FAR Part 12 (Acquisition of Commercial Items) utilizing FAR Part 13 (Simplified Acquistion Procedures).

Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-06, effective May 6, 2020 and DFARS Change Notice (DCN) 20200605, effective June 5, 2020.

BASIS FOR AWARD. Award will be made on the lowest price technically acceptable (LPTA). The resulting award will be a Firm-Fixed Priced purchase order, all or none, to provide Standby Generator Maintenance services.

EVALUATION. The Government intends to make a single Firm Fixed Price award to satisfy this requirement.

Award will be made on the initial evaluation of quotes received in response to this RFQ. Therefore, quoters are cautioned to ensure that initial quotes contain your best terms from a technical and price standpoint. The following factors will be used to evaluate quotes:

1. TECHNICAL: Minimum specifications:

Provide a Capability Statement that outlines how generator maintenance will be accomplished under the terms of the Statement of Work.

Provide sufficient information to support the implementation of the tasks outlined within the Statement of Work, paragraph 2.3 (2.3.1 – 2.3.13).

Rating will be in accordance with: RATING

DESCRIPTION

ACCEPTABLE Quotation meets the requirements of the solicitation.

UNACCEPTABLE Quotation does not meet the requirements of the solicitation.

(Sufficient information shall be provided to support capability to meet the required brand name products and services requested, to include but not limited to, product literature, product number, authorized service provider letter, etc…)

2. PERIOD OF PERFORMANCE: 24 September 2020 to 23 September 2021.

3. PRICE: All quotes must be the Contractor’s Best Pricing. Price analysis shall be used to verify that the overall price offered is fair and reasonable. The Offeror shall input the unit price and total in all the line items present in the SF1449. The total evaluated price is calculated using the prices proposed for all line items.

4. EVALUATION PROCESS: The evaluation will proceed as follows:

a) Quotes will be ranked in order from lowest to highest based on the price. The lowest priced quotation will then be evaluated and receive a rating of Acceptable or Unacceptable based on the technical criteria above.

In order to be rated as Acceptable, the technical quote must meet the Government’s minimum requirements as described in the solicitation. Quotes deemed Unacceptable are those that fail to meet the Government’s minimum requirements.

b) If the lowest quoter’s technical quote is rated Acceptable, the Government will then evaluate that quoter’s pricing to determine fair and reasonableness IAW FAR 15.404-1(b)(2). If the lowest priced quotation is evaluated to have an Acceptable technical quote and fair and reasonable prices the Government will complete a responsibility determination IAW the criteria specified in FAR 9.104-1. If found responsible, the Government may stop the evaluation process at this point as that quote represents the best value to the Government. Award shall be made to that quoter without further consideration of any other quotes.

c) If the lowest priced quotation is assigned an Unacceptable rating, or if the price is determined not fair and reasonable, or if the quoter is found to be non-responsible, the next lowest priced quote will be evaluated.

This process will continue (in ascending order) until a quoter is evaluated to have an Acceptable technical rating, fair and reasonable prices, and the quoter is deemed responsible. The government reserves the right to evaluate all quotes. The award will be made to the quoter whose quotation represents the best value to the Government on a LPTA basis.

The Government reserves the right to award no contract, depending on the quality of the quotes submitted and availability of funds for the requirement. The Government intends to evaluate quotes and award a single contract without requesting or accepting revised quotes. Therefore, the Offerors will be advised that their initial quote should contain the most favorable terms and reflect it’s best possible performance potential. The Government does reserve the right to clarify aspects of the quotes and hold discussions.

CLAUSES INCORPORATED BY FULL TEXT

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUN 2020)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision --

“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.

The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

“Veteran-owned small business concern” means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern--
