STATEMENT OF WORK

CMSC Office and Mess Hall Supplies

1. Purpose. The purpose of this procurement is to seek contractors who may furnish a variety of office supplies to the Consolidated Material & Service Center (CMSC), Marine Corps Base (MCB) Camp Pendleton, California. The primary focus of this contract is the ability of the contractor to meet CMSC demands for a “just in time” inventory. To fulfill these requirements, the government intends to award a Firm-Fixed-Price, Requirements Contract for one (1) base year and one (1) option year.

The Consolidated Material Service Center intends to transition from contractor supported contracts, funded by the United States Marine Corps, to the General Services Administration (GSA) Garrison Retail Supply Chain (GRSC) to furnish office products. This transition is currently scheduled to occur sometime during late Fiscal Year 2015 or Fiscal Year 2016. If the GRSC transition does not occur as currently planned, the Government may exercise additional option periods.

2. General. The Consolidated Material Service Center (CMSC) is the designated Government activity for which all actual purchase requirements will be filled as discussed in FAR 16.503(a).

a. Ability One. The U.S. AbilityOne Commission maintains a Procurement List of products and services which have been placed in the AbilityOne Program, as referenced in FAR 8.002 and Subpart 8.7. Federal agencies must purchase supplies or services on the Procurement List, at prices established by the U.S. AbilityOne Commission, from designated nonprofit agencies as long as those supplies and services are available within the period required. While AbilityOne does not offer all supplies that are required by this contract, The complete Procurement List is available to view and download on the website of the U.S. AbilityOne Commission, which is www.abilityone.gov. Many AbilityOne common-use products included on the Procurement List are also clearly identified in the print and electronic catalogs of AbilityOne-authorized Federal and commercial distributors. Based on the guidance provided in the Federal Acquisiton Regulations, the contractor shall be an authorized distributor of Ability One products.

b. Definition of Consignment. A contractor is awarded a contract in which they are responsible for a defined product category. The products belong to the contractor, but are stocked on the Government’s shelves. When the shopper takes the products off the location and checks out via the point of sales, a transaction is generated by the point of sale system. The Government will use this transaction to bill the shopper and as supporting documentation to pay the contractor. The contractor is paid monthly. Under this system, the contractor is responsible for managing the inventory. Reimbursement for consigment items will be rendered only when the product is sold.

At the conclusion of the specified contract period, unused consignment items shall be returned to the Contractor without any liabilities or expenses charged to the Government. Upon expiration or termination of this contract, the Government may, at its option, elect to purchase all or any part of the Contractor’s stock by giving the Contractor written notice of its intent.

c. Consigned Inventory. Inventory will be maintained in a specified area located at the CMSC building 22105 aboard MCB Camp Pendleton. This space will be used for the storage and issuing of items furnished under this contract. The Government will maintain segregation between government owned items and Contractor owned items. The warehouse facility shall be used only to fulfill the requirements of this contract, and shall not be used for temporary storage in the case of overstocking. There are no warehousing costs charged to the Contractor. The Government will not provide telephone services. Government personnel will have total access to the specified warehouse areas during scheduled operating hours to conduct inspections, perform periodic stock checks, and conduct any other business as necessary to the administration of this contract.

d. Warehouse Hours of Operation: Currently, normal hours of operation are 8:00 AM to 4:00 PM, Monday through Friday.

c. The Government will provide information concerning items required to be stocked at CMSC under this contract, to include:

iv. Point of Sale System- iPASS will be used for point of sale, web-shopping, and in store tracking of inventory. The iPASS shall show all transactions and the total value of property held at all times. Customers have the ability to order supplies from CMSC’s iPASS on-line catalog. iPASS will store the following information. The database by no means is limited to the information below:

MCAS Yuma, Arizona; Marine Corps Ground Combat Center (MCAGCC), 29 Palms, California; Marine Corps Logistics Base (MCLB), Barstow, California;

and Marine Corps Mountain Warfare Training Center (MCMWTC), Bridgeport, California.

2. Currently, Marine Corps installations within MCIWest use different supply models/supply chains to manage their intermediate level or retail inventories.

The only installations, which have a brick and mortar store within the region are MCAS Yuma, MCB Camp Pendleton; MCAGCC 29 Palms; and MCLB Barstow. The remaining installations either shop at the aforementioned installations or use other means (i.e. GCPC, DoD Emall) to procure their supplies. The CSMC at MCB Camp Pendleton uses commercial vendors referred to as Vendor Managed Invetories (VMI) or consignment inventories to manage the majority of their inventory. MCAGCC at 29 Palms uses the GSA business model and MCLB Barstow uses the VMI business model and also manages some of their own inventory and will be converting to GSA in the near future.

j. Ability One Products

i. Pursuant to the Javits-Wagner O’Day Act, production facilities of the Ability One program are mandatory sources for some supplies that will be offered under this contract.

In accordance with FAR 52.208-9, Contractor use of Mandatory Sources of Supply, the contractor shall comply with all provisions of the Javits-Wagner O’Day Act.

ii. The Contractor shall stock and distribute items contained on the Procurement List maintained by the Committee for the assignment to non-profit agencies for production.

During the term of the contract, items may be added to or deleted from the Procurement List and addition or deletion of items shall not constitute cause for equitable adjustment or claim. The Committee maintains a Procurement List of products and services which have been placed in the Ability One Program as referenced in FAR Subparts 8.0 and 8.7.

The link to the Ability One/NIB/NISH procurement list can be folund on the following website: http://www.abilityone.org/

iii. The Contractor shall ensure that no item which is essentially the same as an Ability One item be sold to a Government customer. The Contractor will be given blanket authority to purchase all Ability One items for sale and distribution to Government customers upon meeting the Ability One criteria where applicable. The Contractor shall stock or make available only Ability One items if it offers that items for sale. Ability One items shall be included and fully integrated with other commercial items throughout the Contractor’s print or electronic catalogs for Government customers and shall be identified/highlighted with a unique symbol.

iv. Items added by the AbilityOne program shall be available from the Contractor within 90 days of the item availabililty date. The Ability One Program will notify the Contractor of price changes and their effective dates. After the effective date of a price change, any subsequent orders to NIB/NISH will be at the new price.

v. For all categories of Ability One items, the Contractor may provide mark-ups rather than discounts. Contract mark-ups include shipping from the Ability One/NIB/NISH facility to the vendor’s facility and shipping from the vendor facility to the Government.

vi. Offerors shall address how Ability One items will be shown and marketed to Federal Customers in their proposals but at a minimum, the Ability One items shall be included in marketing materials in a manner consistent with the commercial items.

1. If the Contractor distributes a print catalog to government customers, the Ability One program encourages, but does not require a fully integrated, Government unique print catalog. A commercial print catalog with an Ability One insert in lieu of an integrated catalog would be acceptable, but must have appropriate blocking of Essentially the Same items, and should integrate Ability One items into the index (unless otherwise negotiated with the Ability One Staff)

2. If electronic catalogs are used, all items, terms and conditions not accepted by the Government including the items ETS as Ability One products must be deleted on the Government site/area. At the same time, the Ability One product http://www.abilityone.org/ line must be integrated in a manner consistent with commercial items.

Electronic or on-line catalogs shall integrate Ability One items into all search features as well as other pages where applicable. A separate button for Government customers and/or Ability One items is welcome, but not in lieu of integration into the remaining areas of the catalog. Removal of ETS items is required.

10. DLA Products

a. The contractor shall not propose any commercial items from their product catalog that are available through the Defense Logistics Agency (DLA).

11. Pricing.

a. Contract pricing is based upon current commercial catalog pricing. Discount rates shall be applied to commercial items and markup rates shall be applied to Ability One items to obtain the final sale price to the Government for all items under this contract. The discount and markup rates are binding for this contract. Any changes in pricing are submitted to the COR and the QAE accomplishes any price changes in the iPASS system.

CLAUSES INCORPORATED BY FULL TEXT

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (APR 2014)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
