52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Evaluation criteria consist of three (3) evaluation factors and two (2) subfactors.

Factor 1: Technical Capability Subfactor 1: Management/Staffing Plan Subfactor 2: Quality Control Plan (QCP) Factor 2: Price Factor 3: Past Performance

The Government will issue, if at all, a single FFP contract resulting from the solicitation to the responsible Offeror whose offer, conforming to the solicitation, provides the best value to the Government. The Government intends to make an award off of initial proposals; therefore, Offerors should provide their most competitive and complete proposal assuming there will not be a future opportunity to revise their proposal. However, after receipt of proposals the Government reserves the right to (with or without notice) negotiate with and, if desired, seek proposal revisions from as many or as few Offerors as it, in its discretion, deems appropriate.

Factor 1: Technical Capability

The Government’s technical evaluation team will evaluate responses to determine if they are either technically acceptable or technically unacceptable (price excluded). In order to be considered technically acceptable, the vendor shall provide a narrative that demonstrates the vendor clearly understands the requirements for Appliance Repair services. Failure to meet the technical criteria will render the response technically unacceptable and will not be considered further for award.

Technical Capability Statement

The narrative shall include as a minimum the following topics:

a. How the services will be managed to ensure successful execution of the work required in accordance with the Performance Work Statement (PWS).

b. A list of proposed labor categories and descriptions. The labor category descriptions shall articulate the qualifications, education levels, knowledge and expertise, background checks, clearances, and PWS tasks assigned.

Minimum standards for all necessary skill sets are included in PWS Section 4.2 special qualification details for key personnel.

Technical Subfactor 1: Management/Staffing Plan

1. The contractor shall provide a written Management/Staffing Plan IAW PWS that fully demonstrates how the contractor is going to meet and manage the PWS requirements, processes, and procedures. Including manpower structure that will be maintained including the number of personnel and labor categories.

1. The contractor shall demonstrate how they intend to address processes and procedures to include:

Phase-in Plan with milestones (personnel, equipment, vehicles in-place to start 01 September 2023, with an anticipated award date of 02 August 2023). Discuss start-up/transition and demonstrate the ability to be fully staffed and operational by the start date of the contract, to include contract manager requirements and personnel with the ability to obtain proper background checks.

1. For evaluation purposes only, utilize 01 September 2023 as the contract start date.

d. Plan shall identify the number of personnel, positions to be held and their demonstrated training, any certifications required, expertise, and experience IAW the PWS. Certifications for these services are not required, but may be included with the technical package.

e. Personnel Turnover Plan/Process that shows their capability to replace identified key personnel within 21 calendar days of vacancy.

1. Describe and demonstrate the approach for ensuring that the personnel obtained or hired and retained are qualified with the requisite knowledge, skills, and training to successfully execute the task areas set forth in the PWS.

2. Identify the personnel proposed and explain why they are best qualified to accomplish the PWS in addressing knowledge, skills, education, and experience requirements.

3. If the use of any incumbent personnel is part of the staffing approach, explain process/procedures to be used to successfully recruit incumbent personnel.

4. Discuss the procedures that will be used to establish and retain a workforce sufficient to satisfy the requirements of the PWS, over the entire period of performance.

5. Discuss how to accommodate fluctuating workloads, minimize turnover, and retain qualified personnel while demonstrating the capability to meet and sustain the personnel resources as needed to successfully perform the PWS, including the ability to backfill personnel within 2 weeks.

Acceptable
Based on the proposal, the Government determined the contractor is able to meet PWS requirements with the submitted Management Plan; technical subfactor 1 receives an acceptable rating.
Unacceptable
Based on the proposal, the Government determined the contractor did not demonstrate their ability to meet PWS requirements with the submitted Management Plan; technical subfactor 1 receives an unacceptable rating.

Technical Subfactor 2: Quality Control Plan

The contractor shall provide a written Quality Control Plan IAW PWS that fully demonstrates how the contractor is going to meet and manage the PWS requirements, processes, and procedures.

The plan shall include the contractor’s Quality Control Plan (QCP) that demonstrates that the contractor, not the Government, is responsible for management and quality control actions to meet the terms of the contract. The contractor is responsible for a comprehensive program of inspections and monitoring, measure, assess and control the quality of the work performed on all aspects of this contract. At a minimum, address each metric in the Performance Requirements Summary, and provide any metrics/measures specific to internal processes. The QCP shall also, include:

1. Approach and procedures for evaluating and ensuring quality in each of the service areas, communicating with the Government resolving deficiencies, and identifying potential improvements.

1. Internal review process including who will perform the review, the frequency, the method, and a listing of the services under review.

1. How inspection will be conducted, e.g., random, visual, customer complaint, etc.

d. Method of identifying deficiencies in the quality of services performed and taking corrective action before the level of performance becomes unsatisfactory.

Acceptable
Based on the proposal, the Government determined the contractor is able to meet PWS requirements with the submitted Quality Control Plan; technical subfactor 2 receives an acceptable rating.
Unacceptable
Based on the proposal, the Government determined the contractor did not demonstrate their ability to meet PWS requirements with the submitted Quality Control Plan; technical subfactor 2 receives an unacceptable rating.

Factor 2: Price

Only those contractors who receive a Technical Capability rating of acceptable will be considered for price evaluation.

1. Price should be provided on the Standard Form (SF)1449. All amounts shall be rounded to the nearest hundredth decimal place. The lowest total evaluated price quote acceptable for award will be evaluated based on the combined total of the base year and all option periods. If competitive quotes are not received, the Government reserves the right to utilize other methods identified in the FAR to determine price reasonableness. The Government intends to evaluate quotes and award without discussions; therefore, quotes should be the contractor’s best pricing. Regarding the calculation of pricing, please refer to FAR 52.212-2(b). The contractor’s price submission to include options will be evaluated. The contractor’s prices for the base period and all option years, to include the Option to Extend Services, 52.217-8 will be evaluated to include any discounts.

b. Options. The Government will evaluate offers for award purposes by adding the total cost for all options to the total cost for the basic requirement. The Government may determine that an offer is unacceptable if the option costs are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the contractor’s final option period prices to the contractor's total price. Thus, the contractor's total evaluated price (TEP) for the purpose of evaluation ONLY will include the base period, all option years and one-half of the price of the fourth option year. Contractors are required only to price the base period and four options.

Factor 3: Past Performance

Past performance will be evaluated for the responsive, technically acceptable quote with the lowest TEP and will be evaluated on an acceptable/unacceptable basis. The quote that receives an acceptable Past Performance rating will considered the best value to the Government. The Contractors Past Performance Assessment Reporting System (CPARS) will be utilized in making a determination of responsibility in accordance with FAR Part 9.

The past performance evaluation will determine if there is any unsatisfactory past performance for the type of services required under this acquisition. The past performance evaluation performed does not establish, create, or change the existing record and history of the contractor’s past performance. Past performance will be found either acceptable or unacceptable based on information obtained from CPARS (CPARS) for those services similar in size, scope, and complexity to this acquisition performed within the last five (5) years preceding the date this request for proposal (RFP) was initially issued. Any less than satisfactory rating may be cause for an unacceptable rating.

If a contractor does not have a record of relevant past performance history, the contractor will not be evaluated favorably or unfavorably for its past performance record. Please note that previous Government contract experience is not required.

Acceptable
Based on the contractor’s performance record, the Government has a reasonable expectation that the vendor will successfully perform the required effort, or the contractor’s performance record is unknown.
Unacceptable
Based on the contractor’s performance record, the Government does not have a reasonable expectation that the contractor will be able to successfully perform the required effort.

A written notice of award or acceptance of a contractor, mailed or otherwise furnished to the successful contractor within the time for acceptance specified in the contractor, shall result in a binding contract without further action by either party. Before the contractor’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received after award.
