ATT 1: PWS
PERFORMANCE WORK STATEMENT
2015 AIRSHOW BUS SERVICES
MARINE CORPS BASE HAWAII (MCBH)
1.0 SCOPE
Marine Corps Base Hawaii (MCBH) is hosting and Air Show on October 17th through the 18th 2015. The final of the show each day will be a performance by the Navy’s Blue Angels. Approximately 75,000 people per day are expected to attend.
1.1 CONTRACT OVERVIEW
The Contractor shall provide the supervision, labor, bus dispatcher(s), and equipment required to provide shuttle bus services for transporting both military and non-military personnel between designated parking areas and designated drop off and pick-up points aboard MCBH. The Contractor shall furnish (46) 46-passenger (adult) buses with qualified bus drivers, fuel, and incidentals; and (4) 13-passenger (adult) handicapped accessible buses with qualified bus drivers, fuel, and incidentals, and a bus dispatcher. The bus transportation services shall be within MCBH and take place between 0900 through 2400 on October 17th and take place between 0900 through 1900 on October 18th 2015. The contractor shall report no later than 0730 to MCBH Motor Pool, Bldg. 352 for initial route assignments, and security briefs. MCBH will grant access to the base on October 17th and 18th 2015. For both days, the buses will depart no later than 2400 on October 17th and 1900 on October 18th. The buses shall transport passengers between designated parking lots and designated drop off and pick-up points on MCBH (exact routes To Be Determined (TBD) and will be provided to the contractor at the post award briefing). The buses shall run continuously from 0900 to 2400 on Saturday October 17th a total of 15 hours, and from 0900 to 1900 Sunday, October 18th a total of 10 hours. The approximate on base route is 4 miles round trip. Bus dispatchers shall be on-site, and stationed at the MCBH Motor Pool, Bldg. 352 or other area(s) as designated by MCBH. Performance shall be in accordance with the standards contained herein.

3.0 PERFORMANCE REQUIREMENT/TASKING
3.1.1 Task 1: Vehicle Serviceability. The Contractor shall provide (46) 46-passenger (adult) buses with qualified drivers, fuel, and incidentals included and (4) 13-passenger (adult) handicapped accessible buses with qualified drivers, fuel, and incidentals included and must possess sufficient equipment to provide uninterrupted service under this contract and to furnish replacement buses while regular equipment is out of service. The Contractor may substitute a larger bus for a smaller bus. Vehicles must meet the standards required by local, state, or county laws and regulations, and meet the safety inspection requirements. Buses which, for any reason, do not meet minimum requirements specified shall be replaced immediately so that service will not be delayed or interrupted.
a. Buses shall not have any advertisements or endorsements on the exterior or passenger area.
b. The exterior of the buses shall be free of excessive rust, and shall be in good appearance.
c. Buses shall be free of excessive graffiti on the interior wall or seats.
d. Contractor shall ensure that there is no graffiti on the exterior of the busses.
e. The interior seats of the buses shall not be excessively worn or damaged.
3.2 Task 2: Contractor Personnel/Bus Drivers. The contractor shall provide personnel possessing the skills, knowledge, and training to satisfactorily perform the services required by this contract. Personnel performing work under this work statement shall remain an employee of the contractor, and will not be considered an employee of the Government. The contractor shall be responsible for all personnel, and insure all proper security clearances are obtained, and shall comply with all base rules and regulations in order to perform all tasks within this PWS.
a. The contractor shall be able to furnish proof that all bus drivers under this requirement possess the appropriate current Hawaii Driver’s license to operate the respective passenger bus in a safe environment.
b. The contractor shall abide by all federal, state, and local laws and regulations pertaining to OSHA, Department of Transportation standards, and Commercial Driver’s License standards, as well as any other documents pertaining to the operation of a commercial (46) PAX bus, and (4) PAX handicapped accessible vans .
c. All personnel employed by the contractor in the performance of this contract, or any representative of the contractor entering the Government installation shall abide by all security regulations of the installation and shall be subject to such checks as may be deemed necessary. The contractor and their employees shall comply with all Marine Corps Base Hawaii security regulations. Security regulations may be obtained by the base security office.
d. The contractor and their employees shall wear nametags or shirts that identify the contractor’s business name. In addition, any business pass issued to an employee shall be in the possession of the contractor and their employees at all times.
e. The Government reserves the right to refuse access to the installation to any contractor employee for reasons of misconduct or security reasons. Removal of contractor employees does not relieve the contractor from responsibility for total contract performance.
3.3 Task 3:
Shuttle Bus Service. The Contractor shall provide shuttle bus services to and from pick-up and drop-off sites as described in this specification, for the use of all military personnel, their dependents, and civilian personnel who are attending MCB Hawaii Kaneohe Bay Air Show. The contractor shall provide a quantity of (46) 46-passenger (adult) busses with qualified bus drivers and a quantity of (4) 13-passenger (adult) handicapped accessible buses with qualified drivers. Pricing shall include the rental of the buses, driver, fuel, and incidentals for the duration of 0900 through 2400 on Saturday 17 October 2015 a total of 15 hours, and 0900 through 1900 on Sunday 18 October 2015 a total of 10 hours. Any change in cost associated with pick-up period or route changes shall be subject to negotiation under the
"CHANGES" clause of this contract.
a. The contractor shall provide a bus dispatcher to act as a liaison between all bus drivers and the Government Transportation Coordination (see section 1.3), and be available on-site at MCBH Motor Pool, Bldg. 352 during the period of performance.
b. The contractor shall ensure that all buses and bus drivers obtain base clearances for operation on MCBH no later than Tuesday 13 October 2015. Buses turned away from MCBH due to the failure of a bus to obtain base clearance do not relieve the contractor from responsibility of total performance.
c. The contractor shall schedule an appointment with MCBH PMO office for base clearance. The MCBH PMO Office Point of Contact is: (TBD).
d. The contractor’s buses and drivers shall report to MCBH Motor Pool, Bldg. 352 no later than 0730 on 17 October for route assignments and updated information. Access to MCBH shall be given to the contractor from 0700. Contractor shall enter from the main gate at the end of the H-3 freeway. All buses will then be directed to MCBH Motor Pool. The Government prefers that all buses enter the main gate at the same time.
e. The contractor shall display Government provided signs in the front window and the 1st passenger seat on the right hand side, if provided.
f. The contractor’s employees shall report suspicious persons to the nearest Honolulu Police Department officer or MCBH PMO officer and the Government Transportation Coordinator for appropriate action. If on base, suspicious persons shall be reported to any Military Police officers. If off base, suspicious persons shall be reported to any Honolulu Police Department officer.
g. The contractor shall pick up passengers from an estimated eight (8) to fourteen (14) pick-up/drop-off locations on MCBH (map will be provided by the Government) continuously throughout the period of performance.
h. In the event of an emergency situation, the contractor shall follow the written SOP for emergency situations furnished by the Government.
I. The Government will not allow buses with coolers, backpacks, or other unauthorized items from the prohibited items list onto MCBH.
j. Contractor drivers shall ensure passengers do not board their buses with coolers, backpacks, and other unauthorized items from the prohibited items list provided by the Government. Buses turned away from MCBH due to the contractor’s lack of screening do not relieve the contractor from responsibility for total performance.
k. In the event of an accident or breakdown, the contractor shall be responsible for the transportation of the passengers to their destination.
l. An accident or breakdown does not relieve the contractual duties of the contractor. The contractor shall replace the down bus within one hour of the report of an accident or breakdown and notify MCBH Motor Pool representatives.
m. The contractor shall operate the buses between pick-up and drop-off points on MCBH (exact routes TBD and will be provided to the contractor at the post award briefing) for the fifteen (15) hour performance period on Saturday October 17th and the ten (10) hour performance period on Sunday October 18th.
n. The contractor bus dispatcher, and alternate bus dispatcher, and at least three other contractor representatives shall attend the mandatory Air Show briefing held on 13 or 14 October 2015 (actual date TBD). An outline of the brief will be provided by the Government upon award.
o. Contractor bus drivers shall be in continuous communication with the contractor’s bus dispatcher.
p. The contractor bus dispatcher shall be on-site at MCBH Motor Pool, Bldg. 352, or other area(s) as designated by MCBH representatives and be available in-person during the period of performance.
q. The contractor’s bus dispatcher shall be given the initial bus routes for each day’s period of performance during the staging time of 0730. The bus dispatcher is then responsible to dispatch the buses accordingly.
r. During the period of performance, the Government Transportation Coordinator will actively coordinate the arrival and departure scheduling of the buses at each drop-off/pick-up point. The contractor’s bus dispatcher shall then relay the updated arrival and departure schedule for each drop-off/pick-up point to the bus drivers.
s. The government reserves the right to actively reroute bus routes during the period of performance of the contract due to, but not limited to unforeseen route changes, traffic management, crowd (passenger) management, or emergency situations on an as needed basis. The Government Transportation Coordinator will notify the contractor’s bus dispatcher of any reroutes. The contractor shall immediately coordinate with its drivers of the route changes and make adjustments within 15 minutes for drivers within MCBH, as necessary.
t. Contractors shall continue to drop-off and pick-up passengers until the daily completion time of 2400 on Saturday October 17th and 1900 on Sunday October 18th. It at the completion time (2400 on Saturday October 17th and 1900 on Sunday October 18th), the contractor is enroute to a drop-off destination; the contractor shall finish the route to complete performance.
u. The contractor shall provide a finalized implementation plan by 28 September 2015.
3.4 Task 4: Vehicle Maintenance: The Contractor will provide all maintenance and repair services required to insure all vehicles are serviceable, mechanically safe, if required, and meet applicable state vehicle safety inspection requirements. All maintenance and repair is to be performed off-base. The vehicle operator's daily safety and maintenance checks may be performed in the designated on-base parking area.
a. The Contractor shall have qualified personnel inspect the vehicles used in the performance of this contract to insure vehicles are mechanically safe.
b. The Government reserves the right to periodically inspect the Contractor's vehicles and, if any vehicle is determined to be unsafe or unsatisfactory, to prohibit its use until such unsafe or unsatisfactory conditions have been corrected. In such event, the Contractor must provide replacement vehicles to maintain the schedule.
3.5 Task 5: Emergency Situations. In the event of an emergency situation, the contractor shall follow the written SOP covering emergencies (provided by the Government), and contact the Government Transportation Coordinator immediately for further direction. Depending on the seriousness of the situation, the Government Transportation Coordination will direct the contractor to take the appropriate action. A supplement to the written SOP for emergency situations covering code words and phrases will be passed out by the Government on the day of performance.
a. In the event that medical facilities are necessary, the contractor shall contact the Government Transportation Coordinator for further direction. Depending on the seriousness of the situation, the Government Transportation Coordinator will direct the contractor to a designated medical facility on base.

5.0 PERIOD OF PERFORMANCE
28 September 2015 - 18 October 2015
6.0 WORK HOURS/PERSONNEL, SHIFT SCHEDULES
6.1 The contractor bus dispatcher, and alternate bus dispatcher, and at least three other contractor representatives shall attend the mandatory Air Show briefing held on 13 or 14 October 2015 (actual date TBD)
6.2 The contractor’s buses and drivers shall report to MCBH Motor Pool, Bldg. 352 no later than 0730 on 17 October for route assignments and updated information.
6.3 Shuttle bus service for airshow related requirements is required from 0900 through 2400 on October 17th and 0900 through 1900 on October 18th 2015.
7.0 GOVERNMENT RESPONSIBILITIES
7.1 The Government will hold a post award conference with the contractor no later than 28 September 2015 in order to conduct a route reconnaissance effort, and to validate any security concerns. The meeting will cover any incidental information not covered in this statement of work, and any clarifications to the statement of work as requested.
7.2 The Government will provide the contractor a written SOP covering emergency situations, and base safety. To ensure the utmost confidentiality of emergency code words, the list of emergency words will be given in a supplement on the day of performance.
7.3 The Government will provide a map of the bus routes and drop-off and pick-up points for MCBH.
7.4 The Government will provide a staging area at MCBH Motor Pool, Bldg. 352 or other designated area(s) to the contractor.
7.5 Upon the contractor’s request, the Government will provide an overnight parking area for the buses.
7.6 The Government may provide the contractor signs to be placed on each bus.
7.7 The Government Transportation Coordinator will be available on-site to the contractor during the period of performance.
7.8 During the period of performance, the Government Transportation Coordinator will provide direction to the contractor’s bus dispatcher including but not limited to arrival and departure scheduling, unforeseen route changes, traffic management, crowd management, or emergency situations on an as-needed basis.
7.9 The Government will not provide any fueling areas or fuel for the buses.
8.0 PLACE OF PERFORMANCE

9.0 WORK ENVIRONMENT AND PHYSICAL DEMANDS
Work will involve extended periods of driving buses along designated routes to transport airshow spectators between bus stops located at various locations aboard MBC Hawaii Kaneohe Bay and the airfield.
10.0 Contract Security Requirement
In all cases, each contractor employee shall comply with the HSPD-12 E-Verify Federal Acquisition Regulations FAR Clause 52.222-54, Employment Eligibility Verification.
In all cases, each contractor employee shall comply with all applicable DOD security regulations and procedures during the performance of this task order. Contractor shall not disclose and shall safeguard procurement sensitive information, computer systems and data, privacy act data, For Official Use Only (FOUO) information, and all government personnel work products that are obtained or generated in the performance of this task order. The contractor employee shall take all lawful steps available to ensure that information provided or generated pursuant to this arrangement is protected from further disclosure unless the agency provides written consent to such disclosure.
All contract personnel will be sponsored by their COR for a Base Access Pass issued through PMO’s Pass and ID Section – the contractor will be subjected to local and national records checks; a favorable review of these checks is a condition of Base access and employment.
11.0 GOVERNMENT FURNISHED PROPERTY
Government Furnished Material. The Government may provide signage to the contractor to be placed on each bus. The signs are deemed consumables, and may be properly disposed of by the Contractor.
12.0 CONTRACTOR IDENTIFICATION
Contracting personnel shall identify themselves as "contractors" when attending meetings, answering Government telephones, or working in situations where their actions could be construed as official government acts. The Contractor shall ensure that their employee(s) display(s) his or her name and the name of the company while in the work area, and include the company's name in his or her email display.
13.0 SAFETY
The contractor is solely responsible for compliance of all safety regulations of employees while working on government owned facilities. All accidents which may arise out of, or in connection with, performance of services required hereunder which result in injury, death, or property damage, shall be reported in writing to the Contracting Officer and cognizant Contracting Officer's Representative (COR) within twenty-four hours of such occurrence.
Reports shall provide full details of the accident, including statements from witnesses. The fore-going procedures shall also apply to any claim made by a third party against the contractor as a result of any accident that occurs in connection with performance under this contract.
14.0 SMOKING/DRUG/ALCOHOL POLICY
14.1 Smoking/Alcohol Policy: The contractor shall comply with local command smoking policies and workforce requirements. The contractor shall also comply with all Federal drug-free workplace and work force requirements and local command policies. Copies of the applicable policy will be provided to the contractor by the local command Administrative Officer (AO) at performance start date.
14.2 Drug Policy: The contractor shall comply with all applicable Federal statutes, laws, and regulations to implement a Drug Free Workplace Program (DFWP).
15.0 EMPLOYMENT OF FEDERAL EMPLOYEES: The contractor shall not employ or enter into a contract with any person to perform work under this contract who is an employee of the United States Government, either military or civilian, unless such person receives approval IAW applicable Federal, Navy and DOD
Regulations.
16.0 LANGUAGE REQUIREMENTS: All contractor personnel shall be sufficiently competent in reading, writing, speaking, and understanding English to perform the work.
17.0 PERSONNEL CONDUCT: The selection, assignment, reassignment, transfer, supervision, management, and control of contractor personnel employed to perform tasks specified herein shall be the responsibility of the contractor. The contractor shall be responsible for the performance and conduct of contractor and subcontractor employees at all times. Personnel employed by the contractor in the performance of this contract, or any representative of the contractor entering the installation shall abide by the security regulations listed in the contract and shall be subject to such checks by the Government as deemed necessary. The contractor shall not employ for performance under this contract any person whose employment would result in a conflict of interest with the Government’s standards of conduct.
18.0 PERSONNEL COMPLIANCE: The contractor shall ensure that contractor employees observe and comply with all local and higher authority policies, regulations, and procedures concerning fire, safety, environmental protection, sanitation, security, traffic, parking, energy conservation, flag courtesy, “off limits” areas, and possession of firearms or other lethal weapons. When two or more directives or instructions apply, the Contractor shall comply with the more stringent of the directives or instructions.
19.0 PERSONNEL REMOVAL: Government rules, regulations, laws, directives, and requirements that are issued during the term of the performance period relating to law and order, installation administration, and security shall be applicable to all contractor employees and representatives who enter the installation. Violation of such rules, regulations, laws, directives, or requirements shall be grounds for removal (permanently or temporarily as the Government determines) from the work site or installation. Removal of employees does not relieve the contractor from the responsibility for the work defined in this contract. The contractor is expected to provide support services despite personnel removal or other unforeseen condition.
19.1 Removal by Commanding Officer, MCB Hawaii The Commanding Officer, MCB Hawaii may, at his discretion, bar an individual from the installation under the authority of 18 USC 1382 (1972), for conduct that is determined to be contrary to unfavorable determination, discipline, or installation security and safety.
19.2 Removal Requested by Contracting Officer (KO): The KO may require the contractor to remove an employee working under this contract for reasons of misconduct or security violations. Contractor employees shall be subject to dismissal from the premises upon determination by the KO that such action is necessary in the interest of the Government.
19.3 Removal by Military Police: Contractor employees may be denied entry to or may be removed from the installation by Military Police if it is determined that the employee’s presence on the installation may be contrary to discipline, or installation security and safety.
20.0 PERSONAL APPEARANCE:
Contractor personnel shall comply with local military commander’s published dress codes.
21.0 MEETINGS AND BRIEFINGS (If applicable)
21.1 Requested Meetings: When requested by the designated government representative (DGR), the contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings.
21.5 Management and Administration: The Contracting Officer (KO) has ultimate authority for administration of this contract. The KO may delegate authority through various appointed representatives, including, but not limited to, the COR, technical assistants, one or more technical monitors, and other Government representatives associated with specific functions.
22.0 INTERACTION WITH OTHER ACTIVITIES:
Government Personnel: Government and contractor personnel will be working in common areas. Contractor performance shall not interfere with Government work in the area where service or maintenance work is being performed. In the event the contractor believes that Government and other contractor personnel are interfering with the performance of the tasks described in this PWS, the contractor shall notify the DGR immediately. The contractor is obligated to continue performance of the effort described in this task order unless there is authorization from the KO or DGR/COR to stop work. Failure by the contractor to notify the DGR and receive necessary instructions could result in denial of any additional costs incurred in performance of the contract under such conditions.
23.0 VEHICLE AND EQUIPMENT OPERATION
23.1Privately-Owned Vehicle (POV) Permits: Contractor personnel using POVs on DOD installations shall have proper permits for entry onto the installations. All vehicles, private or contractor-owned, shall comply with the vehicle operation regulations that govern installations. All vehicles are subject to search while on DOD installations. Only licensed contractor personnel shall operate vehicles on DOD installations. Vehicles shall be operated IAW local and state laws as well as installation specific traffic regulations.
23.2Privately-Owned Vehicle (POV) Parking: The contractor shall utilize on-station POV parking in authorized areas. The Government reserves the right to change parking arrangements at any time.
23.3Traffic Accident Report Requirements: The contractor shall report to Base Security, within one hour, any traffic accident involving contractor personnel that occurs on base, whether in the performance of this PWS or commuting in their POVs, IAW OPNAVINST 5102.1 series, OPNAVINST 5100.23 series, and other applicable local instructions. The contractor shall supply a copy of any on-base traffic accident report to the DGR within five workdays after each occurrence. The contractor shall also provide the DGR a copy of any report of an off-base traffic accident that involves contractor personnel in the performance of this PWS within five workdays after each occurrence.
23.4 Fines, Fees, Point Assessment and Other Costs: The contractor shall pay all fines, fees, point assessment, and other costs associated with traffic violations or accidents that occur in the performance of work under this contract.
23.5 Accidents: The contractor is solely responsible for compliance of all safety regulations of employees while working on government own facilities. All accidents which may arise out of, or in connection with, performance of services required hereunder which result in injury, death, or property damage, shall be reported in writing to the Contracting Officer and cognizant COR within twenty-four hours of such occurrence. Reports shall provide full details of the accident, including statements from witnesses. The fore-going procedures shall also apply to any claim made by a third party against the contractor as a result of any accident that occurs in connection with performance under this contract.
24.0 NON-PERSONAL SERVICE STATEMENT
Contractor employees performing services under this order will be controlled, directed, and supervised at all times by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the performance work statement. Contractor employees will perform their duties independent of, and without the supervision of, any Government official or other Defense Contractor. The tasks, duties, and responsibilities set forth in the task order may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.
25.0 GOVERNMENT MANAGEMENT OVERSIGHT
Government management will provide general instructions on limitations and deadlines. Additional instructions shall be provided for any unusual assignments or those that vary from established procedures. The contractor’s employees will independently carry out the assignments. Completed work shall spot-checked by Government management for adherence to procedures, accuracy, and completeness.

The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for MARFORPAC G-6, Marine Corps Base Camp Smith Hawaii, via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/ Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2014. (a) RFQ – M00318-15-T-0045. A completed and signed copy of the solicitation indicating agreement to the provisions and clauses therein. Each offeror shall also provide a price breakdown of the proposed price for the services required based on the Performance Work Statement (and all Exhibits).
(b) A completed Offeror Representations and Certifications (52.212-3). An offeror shall complete only paragraph (j) of FAR 52.212-3 Offeror Representations and Certifications – Commercial Items Alternate I if the offeror has completed the annual representations and certifications electronically at http://www.sam.gov. If an offeror has not completed the annual representations and certificates electronically at the SAM website, the offeror shall complete only paragraphs (b) through (i) of this provision.
(c) Technical Approach in accordance with the Performance Work Statement (PWS) Describe in detail your company's approach to meeting all of the tasks required by the PWS. In particular, give specific examples of your company's prior experience in fulfilling similar tasks. Elaborate on any processes, procedures, or systems used in supporting similar tasks required by this PWS. Offerors should submit an approach that is sound, and reflects a thorough understanding of the PWS. Offerors shall submit a draft implimentation plan in sufficient detail which demonstrates how you will staff your operation with sufficient personnel possessing the training and qualifications required in the PWS to ensure contract requirements are met.

HEALTH & WELFARE: (Hawaii): $1.69 per hour, or $67.60 per week, or $292.93 per month hour for all employees on whose behalf the contractor provides health care benefits pursuant to the Hawaii prepaid Health Care Act. For those employees who are not receiving health care benefits mandated by the Hawaii prepaid Health Care
Act, the new health and welfare benefit rate will be $4.27 per hour.
VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor; 3 weeks after 10 years, and 4 after 15 years. Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. 1) COMPUTER EMPLOYEES: Under the SCA at section 8(b), this wage determination does not apply to any employee who individually qualifies as a bona fide executive, administrative, or professional employee as defined in 29 C.F.R. Part 541. Because most Computer System Analysts and Computer Programmers who are compensated at a rate not less than $27.63 (or on a salary or fee basis at a rate not less than $455 per week) an hour would likely qualify as exempt computer professionals, (29 C.F.R. 541.
400) wage rates may not be listed on this wage determination for all occupations within those job families. In addition, because this wage determination may not list a wage rate for some or all occupations within those job families if the survey data indicates that the prevailing wage rate for the occupation equals or exceeds
$27.63 per hour conformances may be necessary for certain nonexempt employees. For example, if an individual employee is nonexempt but nevertheless performs duties within the scope of one of the Computer Systems Analyst or Computer Programmer occupations for which this wage determination does not specify an SCA wage rate, then the wage rate for that employee must be conformed in accordance with the conformance procedures described in the conformance note included on this wage determination.
Additionally, because job titles vary widely and change quickly in the computer industry, job titles are not determinative of the application of the computer professional exemption. Therefore, the exemption applies only to computer employees who satisfy the compensation requirements and whose primary duty consists of:
(1) The application of systems analysis techniques and procedures, including consulting with users, to determine hardware, software or system functional specifications;
(2) The design, development, documentation, analysis, creation, testing or modification of computer systems or programs, including prototypes, based on and related to user or system design specifications;
(3) The design, documentation, testing, creation or modification of computer programs related to machine operating systems; or
(4) A combination of the aforementioned duties, the performance of which requires the same level of skills. (29 C.F.R. 541.400).
2) AIR TRAFFIC CONTROLLERS AND WEATHER OBSERVERS - NIGHT PAY & SUNDAY PAY: If you work at night as part of a regular tour of duty, you will earn a night differential and receive an additional 10% of basic pay for any hours worked between 6pm and 6am.
If you are a full-time employed (40 hours a week) and Sunday is part of your regularly scheduled workweek, you are paid at your rate of basic pay plus a Sunday premium of 25% of your basic rate for each hour of Sunday work which is not overtime
(i.e. occasional work on Sunday outside the normal tour of duty is considered overtime work).
HAZARDOUS PAY DIFFERENTIAL: An 8 percent differential is applicable to employees employed in a position that represents a high degree of hazard when working with or in close proximity to ordinance, explosives, and incendiary materials. This includes work such as screening, blending, dying, mixing, and pressing of sensitive ordance, explosives, and pyrotechnic compositions such as lead azide, black powder and photoflash powder. All dry-house activities involving propellants or explosives.
Demilitarization, modification, renovation, demolition, and maintenance operations on sensitive ordnance, explosives and incendiary materials. All operations involving regrading and cleaning of artillery ranges.
A 4 percent differential is applicable to employees employed in a position that represents a low degree of hazard when working with, or in close proximity to ordance, (or employees possibly adjacent to) explosives and incendiary materials which involves potential injury such as laceration of hands, face, or arms of the employee engaged in the operation, irritation of the skin, minor burns and the like; minimal damage to immediate or adjacent work area or equipment being used.
All operations involving, unloading, storage, and hauling of ordance, explosive, and incendiary ordnance material other than small arms ammunition. These differentials are only applicable to work that has been specifically designated by the agency for ordance, explosives, and incendiary material differential pay.
** UNIFORM ALLOWANCE **
If employees are required to wear uniforms in the performance of this contract
(either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:
The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE {Standard Form

Conformance Process:
The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined. Such conforming process shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees. The conformed classification, wage rate, and/or fringe benefits shall be retroactive to the commencement date of the contract. {See Section 4.6 (C)(vi)}
When multiple wage determinations are included in a contract, a separate SF 1444 should be prepared for each wage determination to which a class(es) is to be conformed.
The process for preparing a conformance request is as follows:
1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).
2) After contract award, the contractor prepares a written report listing in order proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.
3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor, for review. (See section 4.6(b)(2) of Regulations 29 CFR Part 4).
4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.
5) The contracting officer transmits the Wage and Hour decision to the contractor.
6) The contractor informs the affected employees.
Information required by the Regulations must be submitted on SF 1444 or bond paper.
When preparing a conformance request, the "Service Contract Act Directory of
Occupations" (the Directory) should be used to compare job definitions to insure that duties requested are not performed by a classification already listed in the wage determination. Remember, it is not the job title, but the required tasks that determine whether a class is included in an established wage determination.
Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination.
