4. Authority Permitting Other Than Full and Open Competition
The authority permitting other than full and open competition is FAR 8.405-6(a)(1)(i)(C) Limited Sources. In the interest of the economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order, and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures
5. Rationale Justifying Use of Cited Statutory Authority.
Due to the highly specialized nature of the services, Vickers & Nolan Enterprises is the only source capable of providing the services at the level of quality required without a transition period. There is significant performance risk if awarded to another contractor without a proper transition period between contractors. The lack of a transition period does not allow a new contractor time to grasp the significant learning curve associated with the requirement. A change in vendor would negatively impact IWID’s participation in the POM-21 USMC Capability Based Assessment, which starts early third quarter FY18. In consideration of these facts awarding to Vickers & Nolan Enterprises represents the best option to the Government reducing performance risk and representing a cost savings based on Vickers & Nolan Enterprise’s familiarity with the requirement. The original requirement, contract # M00264-15-F-0131, was competitively awarded IAW the applicable Federal Supply Schedule procedures to Vickers & Nolan Enterprises and was not issued on a sole source basis.
The most recent contract in support of this requirement was under M00264-15-F-0131 set aside and competed amongst small business. The requirement was competitively awarded to Vickers & Nolan Enterprises on 28 September 2015 and would eventually result in an overall 30-month period of performance valued at $1,853,598.00. The contract with Vickers & Nolan Enterprises filled a gap in services after the CDD BPA expired 10 August 2015 a follow-on vehicle was unable to be awarded due to delays in the review and approval process of the Procurement Request package.
It is the Government’s intent to have the CDD Indefinite Delivery Indefinite Quantity (IDIQ) long term contract vehicle in place by no later than 15 August 2018. Thus, it is in the best interest of the Government and Vickers & Nolan Enterprises, LLC, a service-disabled veteran-owned small business, to not compete a 9-month requirement. The Government will do a logical follow-on direct award to Vickers & Nolan Enterprises for a period of 9-months with 3 additional 1-month options should award of the CDD IDIQ be delayed. Vickers & Nolan Enterprise’s GSA pricing will be utilized and shall include preferred customer pricing and discounts requested by the Government.
6. Description of Market Research Conducted Among Schedule Holders
No offer will be solicited from other sources for the reasons described herein. Notices required in FAR Part 5 are not required for FAR 8.4 procurements. Due to the unique and extensive experience by Vickers & Nolan Enterprises with the technical expertise and knowledge of the Joint Capabilities Integration Development System (JCIDs) process, no other Contractor can reasonably complete the efforts required without extensive duplication of effort and unacceptable delays to the Government. The Contracting Officer determined that limiting sources to the current contractor in accordance with FAR 8.405-6(a)(1)(i)(C) is necessary to avoid further delay of already pending actions and increased risk of additional incurred cost to the contract.
7. Determination of Fair and Reasonable Cost
Vickers & Nolan Enterprise’s pricing under M00264-15-F-0131 has been determined fair and reasonable based on competitive procedures. The procurement was originally competed via GSA e-buy under solicitation M00264-15-T-1091. Vickers & Nolan Enterprises submitted a quote in response to M00264-15-T-1091 and utilized pricing under their GSA Schedule GS02F0087Y. The contracting officer used adequate price competition among GSA schedule holders was used to determine pricing fair and reasonable.
The Contracting Officer will ensure that all pricing is at or below the established GSA pricing and may seek additional discounts before placing an order. Therefore, it is the Contracting Officer’s determination that the anticipated cost to the Government will be fair and reasonable and that the order represents the best value.
7. Actions Taken to Remove Barriers to Future Competition
These support services will be competed under the CDD IDIQ providing fair opportunity to the awardees. The estimated end date for the pending contract will be December 2018 (exclusive of options) while the targeted award date for the follow-on task order is November 2018. Options to this contract may be exercised to ensure a 30 day transition. This contract will provide adequate time for the Government to successfully complete the POM-21 USMC Capability Based Assessment.
