SOW

1.0 BACKGROUND

The purpose of this Blanket Purchase Agreement (BPA) contract shall outline the process of procurement and mounting of large and miniature medals and devices, and for the procurement of various uniform accessory items for Marine Barracks Washington (MBW). MBW has an immediate requirement for one or more delivery orders under this BPA.

1.1 Objective/Scope of Work

The objective of this requirement is to provide medals and various uniform accessories to the Marines of MBW in support of ceremonial events and parades. The contractor shall provide well trained, experienced personnel as well as tools, supplies, and equipment necessary to perform duties in accordance with established uniform regulations for the United States Marine Corps. The contractor shall not accept instructions issued by any person employed by the U. S. Government, other than: the Contracting Officer or the Marine Barracks Post Supply Office all acting within the limits of their authority.

1.2 Ordering Type

There is GFP associated with this project. The requesting unit will provide a “Medals Mounting Chit” with the Marine’s or Navy personnel’s name, rank, company, phone, medals, and devices.

1.5 Post-Award Conference

The contractor shall have a post-award conference with the requesting unit’s TPOC’s (listed in section 1.7) for the instrument case design. The meeting will take place at the Government facility within ten (10) days after award of contract. The contractor shall provide material samples and projected construction schedule for final review and approval by the TPOC prior to the start of production. The Government may call conferences/meetings from time to time, as deemed necessary, to discuss the results of the work. The location, duration, and number of participants shall be defined as the need for such a conference/meeting is determined.

The quoter shall use the following specifications in the design, production, and construction of the cases:

2.1.1 As specified per the BPA, the contractor shall furnish anodized medals (large and miniature), devices, and all other supplies necessary to complete the job requested. Contractor shall also ensure that bars and ribbons used to mount medals are strong enough to hold combined weight of medals.

2.1.2

The contractor shall, before performing any service, confirm any information provided that may deem to be ambiguous.

2.1.3

Upon completion of service, the contractor shall package each set of mounted medals separately with a copy of the Marine Barracks Medal Alteration Form, with Marine’s name facing outward.

2.1.4

The contractor shall not perform any work at the cost to the government without prior confirmation from the Regional Contracting Office, Northeast, Quantico, VA.

2.2 Critical Design Review (CDR)

During the life of this contract, the requesting unit and the contractor shall conduct a CDR any time the listed parts have been determined to have a design flaw that impairs the serviceability of the case. These reviews may be held at times agreed by both parties to determine proper action.

3.0 DELIVERY / SCHEDULE

3.1 Schedule

The delivery schedule shall be as follows:

3.2 Inspection and Acceptance

Inspections and acceptance shall be performed by the TPOC. A finished, technically acceptable product shall be provided for an inspection and must be in accordance with all specifications as instructed.

3.3 Packing, Marking, and Place of Delivery

3.3.1 Packaging

Upon completion of service, the contractor shall package each set of mounted medals separately with a copy of the Marine Barracks Medal Alteration Form, with Marine’s name facing outward.

3.3.2 Shipment and Marking

All shipments under this agreement shall be accompanied by delivery tickets or sales slips which shall contain the following minimum information:

(1) Name of Contractor

(2) Blanket Purchase Agreement Number

(3) Delivery Order Number

(4) Date of Purchase

(5) Itemized list of supplies or services furnished

(6) Amount of funds obligated

(7) Date of delivery

(8) Name of individual who placed the call

3.3.3 Place of Delivery

4.0 TRAVEL OR SPECIAL CONSIDERATIONS

4.1 Defects/Errors/Unsatisfactory Supply

Any damage that is the result of the contractor’s work, or damage resulting while in process of shipment shall be resolved by the contractor at no additional cost to the government.

4.2

No partial shipments will be accepted unless specifically authorized by the Contracting Officer prior to the order actually being placed. Failure to comply with delivery time or shipping instructions, on a repetitive basis, may result in the termination of this agreement.

4.3

If, for any reason, a vendor determines that they are unable to supply all the items on an individual call number within the required delivery time, he should immediately notify the individual who placed the call.

4.4

If, for any reason, the mounted medals and/or other items are no longer required and are in good condition, the government will return items to vendor and vendor shall provide a credit value for returned items.

4.5

For each delivery by UPS, USPS, and/or commercial carrier, the vendor must ensure that proof of receipt may be obtained from the carrier for the Government. For each activity pick-up, the vendor must ensure that the activity’s representative signs the vendor’s sales slip and takes one copy of it and the item(s) with him.

52.203-5 COVENANT AGAINST CONTINGENT FEES (MAY 2014)

(a) The Contractor warrants that no person or agency has been employed or retained to solicit or obtain this contract upon an agreement or understanding for a contingent fee, except a bona fide employee or agency. For breach or violation of this warranty, the Government shall have the right to annul this contract without liability or, to deduct from the contract price or consideration, or otherwise recover, the full amount of the contingent fee.

(b) "Bona fide agency," as used in this clause, means an established commercial or selling agency, maintained by a contractor for the purpose of securing business, that neither exerts nor proposes to exert improper influence to solicit or obtain Government contracts nor holds itself out as being able to obtain any Government contract or contracts through improper influence.

"Bona fide employee," as used in this clause, means a person, employed by a contractor and subject to the contractor's supervision and control as to time, place, and manner of performance, who neither exerts nor proposes to exert improper influence to solicit or obtain Government contracts nor holds out as being able to obtain any Government contract or contracts through improper influence.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items.
