JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION For Actions Greater than the Simplified Acquisition Threshold and Acquisitions Pursuant to FAR 13.5 – Test Program for Certain Commercial Items

INCIDENT RESPONSE FORCE (IRF) FIELD TRAINING EXERCISE (FTX) – M2036415SU00041

1. Contracting Activity.

The Regional Contracting Office – National Capital Regional (RCO-NCR), Marine Corps Installations National Capital Region - Marine Corps Base, Quantico, VA (MCINCR-MCBQ).

2. Description of Action Being Approved.

This J&A authorizes and approves the award of a sole-source, firm-fixed price contract to the Guardian Centers, 600 Perry Parkway, Perry, GA 31069 to conduct an Incident Response Force (IRF) field training exercise (FTX) from 2 July – 31 August 2015.

3. Description of Supplies/Services.

CBIRF requires training operations in to conduct plausible, realistic, and safe Chemical Biological Radiological Nuclear and High Yield Explosive (CBRNE) response training that sustains CBIRF’s ability to operate major Marine Corps installation, sustains the Initial Response Force readiness, and enables the Installation Commanding Officer to evaluate the CBIRF during simulated extended operations in and around a CBRNE environment. The contractor will facilitate training and exercise delivery in order to provide a scenario-based environment in the area of consequence management. Services include venue development, the provision of classrooms, AV support, instructors, role players, mannequins, office space, sanitation, personal hygiene, and basic logistical support.

The total value of this procurement is $995,973.85.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. Section 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

5. Rationale Justifying Use of Cited Statutory Authority.

CBIRF will build on the command element and Initial Response Force training conducted during the third quarter by executing a realistic, scenario-based exercise that addresses the unit’s mission essential tasks. Today’s environment has created the need for flexible, modular units capable of conducting contingency management. CBIRF must sustain its ability to serve as a USMC O6 level headquarters during a period of staff turnover and the IRF must be stressed as it operates for a sustained period. This difficult and trying task must be tested in an environment that simulates the stresses that will be associated with a complex, hazardous environment.

Raytheon’s single source Indefinite Delivery, Indefinite Quantity (IDIQ) contract with the Program Executive Office of Simulation, Training and Instrumentation (PEO-STRI) was used last year to procure FTX services of this magnitude. Through Raytheon and PEO-STRI’s market research, they determined that the only venue capable of supporting the exercise within a reasonable distance of Indian Head was Guardian Centers. The use of a firm-fixed price contract to Guardian Centers would disenfranchise the use of an additional company filter funding through to Guardian Centers and would result in savings for the Government. An award to a different contractor would either result in substantial duplication of cost to the Government that cannot be recovered through competition.

Guardian Centers is a training venue that houses multiple training environments needed for the FTX. The vendor has a Dual Rail Mass Transit Subway System, a 75-Acre Urban Cityscape; Multi-story collapsed structures, classrooms, cadavers, a Command and Control Center and the ability to release a radiological stimulant into a controlled environment. This training environment, coupled with trained and knowledgeable staff members, creates realistic training for a large scale response scenario. This provides CBIRF with the tools necessary to respond to a devastated city environment with confidence and relatively moderate experience.

The unique and innovative capabilities of Guardian Center to provide this realistic training on such a large scale, along with their extensive experience in responding to CBRNE incidents and their available resources, provides CBIRF a training opportunity that cannot be replicated by any other known commercial sources in the restricted travel area. By conducting this training directly with Guardian Centers, CBIRF maintains their ability to conduct a response effort in the event of a CBRNE incident within the NCR, and through training, improves their response actions in support of United States Marine Corps operations in the United States.

The first part of the training evolution is that CBIRF is conducting a two-day road march that includes a stop in Fort Bragg, North Carolina. From Fort Bragg, North Carolina, CBIRF wishes to travel a minimum of six hours drive time and no more than seven hours drive time to a training facility in the state of Georgia or Tennessee. The actual training site requires a venue that allows for a controlled radiological release that creates a realistic training environment for CBIRF.

If the requirement was to be competitively solicited, it would result in unacceptable delays in training readiness on the necessary mission skills used to respond to a high-level effort created by an event or attack in the NCR and/or United States. Being the only rapid Chemical Biological Radiological Nuclear and High-yield Explosive (CBRNE) force in the Marine Corps, CBIRF has to maintain a constant high degree of readiness.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible This effort was synopsized under M2036415RFI0002 on 24 April 2015 in FEDBIZOPPS in accordance with the requirements of FAR 10. To date, two responses were received. Only one of the offers was able to meet the core requirement of providing IRF FTX. The other offeror stated that they are incapable of completing the requirement as stated in the Performance Work Statement, but was willing to participate in the capacity of a subcontractor.

7. Procurement History.

This requirement was previously satisfied by Raytheon under the Warrior Fighter Focus IDIQ Contract through the PEO-STRI. The contract numbers include:

8. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.

The fair and reasonableness of the price will be based on an analysis of the contractor’s price as compared to previous contracts completed by this office and PEO-STRI for similar or prior training events. It is anticipated this analysis will be conducted using experienced technical representatives, with direct knowledge of all disciplines being sought, and an experienced Contracting Officer, with direct knowledge and access to previous, competed contracts for similar training events. Proposed Cost was under the Independent Government Cost Estimate.

9. Actions to Remove Barriers to Future Competition.

CBIRF and the RCO intend to use competitive-based contracting actions in follow-on future contracts for the specific training covered by this J&A.
