EVALUATION

ADDENDUM TO 52.212-2 EVALUATION – COMMERCIAL ITEMS (JAN 1999)

BASIS OF AWARD

This acquisition will utilize the Lowest Price Technically Acceptable (LPTA) procedures. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made based on acceptability of the offeror’s lowest evaluated price; demonstrated responsibility in accordance with the Federal Acquisition Regulation; and proposal which conforms to the solicitation requirements. The solicitation requirements include all stated terms, conditions, representation and certification, and other information required by this solicitation. The Government reserves the right to award without discussions. Therefore, the initial proposal should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

TECHNICAL EVALUATION FACTORS:

The Contractor shall address the following factors:

Factor 1 – Technical Capability – Offeror shall clearly demonstrate its technical ability to meet the requirements of CLIN/line Items in section B based on meeting the requirements of the specifications in the Statement of Work (SOW) to include quantity; quality; and timeliness of delivery.

Factor 2 –Past Performance – Provide three (3) references supporting the ability to deliver the product on schedule and in quantities required. Offeror’s are to provide: Customer; Contract/Task Order number; Contract Type; Total Contract Value; Description of Work performed; relevancy pertaining to this requirement; Names; telephone number; and email address for Point of Contact.

Factor 3 - Price – The price factor will be evaluated for completeness and reasonableness. The Offeror shall complete Section B pricing for each CLIN as required and submit any supporting documentation applicable. The Offeror shall provide sufficient price information to allow the Contracting Officer to determine the completeness and reasonableness of the proposed prices. No ambiguities of inclusion, exclusion, or content shall be extended and lack of content or clarity with regard to pricing shall be considered as representing a “non-responsive” proposal.

Completeness. The Offeror must sign the solicitation, acknowledge all amendments if applicable, and include a compliance matrix and Table of Contents corresponding to their price submission. At a minimum, the following areas must be addressed:

Offer is valid for 60-days from Date of Submission

No exception to any Terms and Conditions has been taken;

Acknowledge any Amendments to the RFP

SAM validated/ NAICS compliant

Signed Offer of $XXXXXX provided

AWARD DECISION: The award decisions will be made as follows:

(1) Step One – Determine Technical Acceptability. The technical evaluation Factor 1 will assess the Offeror’s capability to satisfy the Government’s requirement. The Government will evaluate all technical capability proposals received by the required date/time. The Technical Capability factor will receive a rating of acceptable or unacceptable. If any factor is rated “unacceptable”, the entire proposal is rendered unacceptable, and the proposal will be removed from the competitive range. Only proposals deemed technically acceptable (either initially or as the result of discussions) will be considered for award.

The ratings are defined in the following paragraphs.

(a) Acceptable: The proposal clearly meets all the minimum mandatory requirements in the solicitation identified within the Technical Capability factor: Only those proposals determined acceptable, either initially or as a result of discussions, will be considered for award. Once deemed acceptable, all technical proposals are considered to be equal.

(b) Unacceptable: Fails to meet all the minimum mandatory requirements in the solicitation identified as factors within the Technical Evaluation Standards. Quotes with an unacceptable rating will not be considered for award.

Rating
Description
Acceptable
Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable
Proposal does not clearly meet the minimum requirements of the solicitation.

*Rating Scale for Technical capability

(2) Step Two – Evaluate Past Performance. The Offeror’s Past Performance will be evaluated, for award purposes, based on the offeror’s ability to demonstrate a sufficient and satisfactory performance history for recent comparable work. Factor 2, Past Performance will receive a rating of acceptable or unacceptable.

The past performance ratings are defined below:

Rating
Description
Acceptable
Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (see Note below).
Unacceptable
Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will successfully perform the required effort.

NOTE: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)- Proposal Evaluation). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.

(2) Step Three – Evaluate Price. The Offeror’s price proposal will be evaluated, for award purposes, based upon the total price (base year plus four option years) proposed as annotated under Factor Two (2) Price.

(3) Step Four – Award Decision. Award will be made to the lowest priced, technically acceptable proposal, subject to a positive responsibility determination in accordance with FAR Part 9 and conformance of the Offeror’s proposal to the terms and conditions of the proposal.
