UNITED STATES MARINE CORPS

MARINE CORPS BASE

QUANTICO, VIRGINIA 22134-5001

IN REPLY REFER TO:

C-22

RCO-JA-14034

29 AUG 2014

JUSTIFICATION AND APPROVAL

FOR USE OF

OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The United States Marine Corps, Regional Contracting Office-National Capital Region (RCO- NCR), located at 2010 Henderson Road, Quantico, Virginia is the supporting Contracting Activity for the Headquarters Marine Corps (HQMC) Code Facilities and Services Division (LF) and Marine Corps Installations Command (MCICOM) Code Facilities Directorate (GF), which is the requiring activity.

2. Description of the Action Being Approved

This justification is to seek approval for a sole source bridge contract to be entered into with the incumbent, Booz Allen Hamilton, in order to maintain support of mission critical tasks since a competitive procurement cannot be processed in time to meet the required award date of 29 September 2014.

The contract will be solicited as a Sole Source Bridge Contract to ensure services continue without interruption. The current task order, N00178-04-D-4024-MUT7, was awarded by the Regional Contracting Office – National Capital Region and expires 29 September 2014.

Approval of this Justification and Approval (J&A) will allow time for a competitive contract to be awarded.

The bridge contract period of performance will be from 30 September 2014 through 28 December 2014, a three (3) month base period; and two (2) one month option periods ending 28 February 2015. The contract will be structured as a Firm Fixed Price (FFP) contract in the amount of $472,866.77.

3. Description of Supplies/Services

The HQMC (LF) / MCICOM (GF) has a requirement for non-personal services in the form of a full range of environmental services support to provide capabilities to HQMC(LF) / MCICOM(GF), to include policy and standards development and support; installation and regional support; environmental data management support; and support for program operations, management, training and communications.

These services consist of providing environmental support in areas such as, but not limited to:

• Environmental Sustainability;

• Environmental Compliance;

• Environmental Management Systems (EMS);

• Natural and Cultural Resources;

• Environmental Planning;

• Environmental Fiscal Resource Management;

• Environmental and Geospatial Information Technology and Systems;

• Strategic Risk Communications;

• Environmental Data Management, Planning, Analysis and Technical Support;

• Environmental Data Creation and Sustainment;

• Imagery Acquisition Consultation and Analysis; and

• Environmental and Geospatial Training and Education.

Work requirements under this effort are written as performance objectives that clearly delineate government objectives and contractor responsibilities in achieving these goals. The stated outcome of this procurement is to establish a USMC-wide environmental service model providing technical support for developing/maintaining policy standards; installation/regional environmental support; data collection, management and reporting; and coordination of program operations supporting enterprise initiatives with improved management, training, and communications support. Management objectives in the Performance Work Statement (PWS) are expressed as performance based requirements and are predicated upon use of program management best practices and quality assurance surveillance.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. Section 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Title 10, United States Code § 2304(d)(1)(B) and Federal Acquisition Regulation (FAR) 6.302- 1(a)(2)(iii) provide special authority for Department of Defense (DoD) regarding the justification of “only one responsible source” under 10 U.S.C. § 2304(c)(1). FAR 6.302-1(a)(2)(iii) provides:

“For DoD… services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in – (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B) Unacceptable delays in fulfilling the agency’s requirements.”

The services associated with this requirement have been determine to be “highly specialized” due to the qualitative learning curve associated with the tasks outlined in the PWS. Through the course of task order performance, the incumbent has established sound process efficiencies, personal skillset development and quality of support gained and/or demonstrated through repetition and familiarity with service task execution. This includes fully understanding collaborative relationships between HQMC (LF) / MCICOM (GF) customers and stakeholders within the Environmental community. Booz Allen Hamilton has invested in, grown and tailored a team of highly skilled professionals during their performance of the current task order.

Selection of any other source for the short duration bridge contract will eliminate strong team dynamics, reduce operational efficiencies and remove an effective and competent talent base.

HQMC (LF) / MCICOM (GF) estimates a new contractor will require a minimum of three (3) to six (6) months to achieve satisfactory performance of the PWS requirements.

The incumbent provides environmental support services to HQMC(LF)/MCICOM(GF) to include data management and reporting, technical preparation and review of documents, and fiscal support. Failure to provide continued environmental support services would negatively impact the ability to manage and report data to the Office of the Secretary of Defense and Congress and develop and review documents that support compliance with environmental laws and regulations and Presidential Executive Orders.

Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition at this time. It is estimated that it would take another contractor approximately three (3) to six (6) months to provide service at the incumbent’s current level. Accordingly, the estimated cost that would not be recovered is $272, 808 to $545,616 based on the current contract’s monthly rates over a three (3) to six (6) month period. It is anticipated that it will take the Government approximately six (6) months from the date of this document to process the follow-on requirement. At this time, the follow-on contract’s requirement package is pending approvals.

HQMC (LF) / MCICOM (GF) identified the follow-on support requirement to the RCO in May 2014, resulting in a Request for Information (RFI). Based on the results of the RFI and collaborative efforts with HQMC (LF) / MCICOM (GF), an Acquisition Strategy and Source Selection Plan has been drafted and is currently under review at the RCO. Given the time required to complete the multiple review cycles, obtain final approvals including soliciting the Request for Proposal/Solicitation and evaluation of proposals, the award action will extend beyond the current Period of Performance date of 29 September 2014.

Competing and awarding the requested bridge contract to any other source would result in a lapse in service support due to several factors, including: lead time required to complete the competitive solicitation process and unavoidable learning curve disruptions. By awarding this sole source bridge contract action, the Government will be forwarded the time needed to solicit the requirement on a full and open competitive basis without disruption of services.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible

This effort will be synopsized in Federal Business Opportunities (FEDBIZOPPS) in accordance with the requirements for FAR 5.2. Availability of the justification on the Government Point of Entry (GPE) will occur within 14 days after execution of the follow-on contract in accordance with FAR 6.305(a).

Intensive market research was conducted on the follow-on requirement to maximize interest and competition for the follow-on requirement.

7. Determination of Fair and Reasonable Cost

The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.

The fair and reasonableness of the price will be based on an analysis of the Contractor’s price proposal including backup information supporting the contractor’s labor rates.

8. Actions Taken to Remove/Overcome Barriers to Future Competition

A follow-on competitive based contract action is at RCO and currently pending the required approvals.
