Solicitation Number: M00264-14-R-0001 (Questions from Offerors)
1) How should we address our subs within our proposal? Where subs are proposed they should be identified as such.
2) Is this a new or follow on requirement? If it is a follow on, please let us know the current contract number and contract value? This is a follow-on requirement. Current contract# is M00264-13-C-0021. Contract is valued at $4,816,716.00.
3) Who is the incumbent? Is it still eligible to bid as a prime for this contract? The incumbent is Management Consulting Inc. The incumbent is not eligible to bid as the prime. This solicitation is 100% small business and the incumbent is not a small business.
4) What is the exact date to submit the proposal? All proposals must be received no later than 30 December 2013 at 10:00 a.m., EST.
5) Is the government considering how to handle subcontractors regarding identification/coding? Offeror codes are only used to reference the prime. Subcontractors can be referenced by name.
6) Is this a new contract or an existing one? See answer to question 2.
7) What is the name of the current contractor? See answer to question 3.
8) Please provide the option year prices for the contract. Option year pricing will not be provided by the Government for this solicitation.
9) The SF 1449 notes the due date for the solicitation is 1200, 12 Dec 2013. However, Paragraph L-3 indicates proposals must be received at the address listed below no later than 10 December 2013 at 2:00 p.m., EST. What is the correct due date? See answer to question 4.
10) Paragraph L-3 states the offeror must provide 5 Technical Volumes and 5 Business Volumes, however Paragraph L-4 states the offeror is required to provide 1 original and 5 redacted copies of each volume. Is there a requirement for offerors to submit both non-redacted and redacted Technical Volumes & Business Volumes? If so, how many total non-redacted Technical Volumes and Business Volumes shall the offeror submit? How many total redacted Technical Volumes and Business Volumes shall the offeror submit? The offeror is required to provide one (1) original (Non-redacted) and five (5) redacted copies of each volume without the names (i.e. company, company logo’s, key personnel , and any references to the company.
11) Paragraph L-4 states offerors are to email you to obtain an alpha numeric offeror code to be used throughout the proposal in lieu of the company name or logo. When teaming with other companies, how are offerors to address these companies throughout their proposal? Offeror codes are only used to reference the prime. Subcontractors can be referenced by name.
12) FAR 52.219-14 (Limitations on Subcontracting) stipulates "At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern." However, Section 1651 of the 2013 NDAA provides a new exception to the small business subcontracting cap, which restricts small businesses from subcontracting more than 50 percent of the amount paid under a services contract. Thus, the amount paid under any subcontract with a small business concern that has the same small business status as the prime contractor is excluded from the small business subcontracting cap.
Although FAR 52.219-14 is not Incorporated by Reference or By Full Text; What is the Contracting Office's guidance pertaining to the performance requirement of the small business prime concern? Is the requirement for the small business prime to employ 50% of the employees dedicated to support the contract, or 50% of the value of the contract adhering to FAR 52.219-14 or, Can the small business prime and "like" small business subcontractors collectively be counted towards performing 50% of the contract value adhering to the 2013 NDAA?
I'd like to request a brief meeting with your office to discuss the matter outlined herein.
FAR CLAUSE 52.219.14 has been incorporated by reference and is the only reference used as guidance pertaining to the performance requirement of small business prime concern. Due to time constraints, the Government will not be able to honor this request.
13) Paragraph M-4.3 Factor 3. Corporate Experience notes, “the Government will evaluate the extent to which corporate experience relates to the WWR requirement”. Paragraph M-4.4 Factor 4. Past Performance says, “the Government will evaluate this factor on the relevance of the Offerors corporate experience to this task”. This seems to indicate that corporate experience is evaluated twice – once in Factor 3 and once in Factor 4 as the quote from the solicitation suggests. Can you clearly articulate the different items the government is seeking to evaluate in Factor 3 versus Factor 4? Factor 3 will be evaluated based on how your corporate experience relates to the work outlined in the solicitation (PWS). Factor 4 will be evaluated based on your past work experience as well as the quality of your past performance on other contracts relative to the objectives of the requirment.
14) All Travel CLINS note that travel will be in accordance with PWS Paragraph 4.6. Paragraph 4.6.2 states, “The Government has provided a not to exceed amount for this travel in the CLINS.” In fact, this is not the case. Will the Government please provide the not to exceed amount for travel as noted in PWS Paragraph 4.6.2? Not to exceed amounts for the travel CLINS have been added to the solicitation.
15) Paragraph 6.2.3.1 notes the Deputy PM must have a Bachelor’s Degree in Business/Public Administration or related field that focuses on policy, planning, and program operations management. Clearly someone without a Bachelor’s Degree in Business/Public Administration or a related field can have expertise in policy, planning, and program operations management. For instance an Art Major may have 20 years’ experience as a Marine and a Master’s Degree in National Security Studies. Can experience be utilized in lieu of the Bachelor’s Degree requirement? Can a Master’s Degree be utilized in lieu of the Bachelor’s Degree requirement? No experience cannot be utilized in lieu of the Bacherlor’s Degree requirement. Yes a Master’s Degree can be utilized in lieu of the Bacherlor’s Degree.
16) Paragraph C-12.2 (NMCI Seats) stipulates "The contractor is responsible for obtaining and funding NMCI workstations needed," however no ODC CLINs have been provided for the procurement and maintaining of these assets. Will CLINs be provided in the BY and OYs, as a cost reimbursable line item? Yes, there will be a separate ODC CLIN established in Amendment 0002, for the Base Year and Option Years.
17) Under L-5.4 Factor 4. Past Performance: Will the government change the last sentence of the first paragraph that currently reads "At least two (2) of the references must reflect past performance for contracts for which the Offeror has served as the prime contractor." to "At least two (2) of the references must reflect past performance for contracts for which the Offeror and or its team members have served as the prime contractor." Yes. Section L-5.4 has been updated in the PWS.
18) Section L L-5.4 Past Performance. 93 “. . .Past Performance Questionnaire to the same three (3) previous references. The references should email the form directly to the RCO-NCR at the address provided on the form on or before 12 December 2013, 2:00p.m. Request PPQ due date and time. Past Performance Questionnaires are to be provided to the RCO-NCR on or before 23 December 2013, 2:00 pm., EST.
19) Are you able to provide an explanation why there is a requirement for the small business to have two prime contracts for purposes of the past performance? Factor 4 in section L 5.4 eliminates most small businesses with these capabilities from competition. I am an SDVOSB that performs services in support of the USAR RCC program as well as Army Victims Advocacy program. Both contracts are very relevant although I am a sub to a large business and do not carry the prime contract credentials. Factor 4 will be amended to require that only one (1) reference must reflect past performance for contracts for which the offeror has served as the prime contractor.
20) Reference C-6.4. Mid-Level Support – Applications Programming and Report Management (Non-Key Personnel) and C-6.5. Mid-Level Support – Recovery Care Coordinator Support (Non-Key Personnel). The solicitation does not provide the number of FTE for these labor categories; however, the number of FTE is provided for the each of the Key Personnel labor categories. Is this an over site, or is the government depending upon industry to determine the number of these FTE for each location based upon case load percentage? Yes, offerors are required to determine the FTE per location based on case load percentage provided by the Government..
21) Reference C-13.1. Where it states, “All employees on a contract are also required to have a visitor request submitted by the contract company in JPAS prior to arrival.” Our company has been cleared for a Secret Facility Clearance, but no longer has an active DD 254; therefore, we do not have access to JPAS. All background investigations are currently conducted by each of the government agencies for which services are provided. Will a DD 254 be issued for this requirement? An active DD 254 will not b issued for this solicitation. A visitor request can be submitted either by JPAS or letter.
22) Please clarify the duration of this contract and all option periods. Reference L-1, where it states, “The government intends to issue a single award, FFP type contract for a base period of twelve (12) months, with two (2) one-year option periods and one six-month option periods.” This is a total of 42 months which differs from 52.217-9 sub paragraph (c) where it states, “The total duration of this contract, including the exercise of any options under this clause, shall not exceed 36 months.” The government intends to issue a single award, FFP type contract for a base period of twelve (12) months, with two (2) one-year option periods and one six-month option period only if FAR 52.217-8 , Option to Extend Services is invoked.
23) Reference L–5.1 Factor 1, sup-paragraphs 2.b. and 2.c. These paragraphs pertain to “non-key personnel”. They state, 2.b. The offeror must address the relevant background and experience of the non-key personnel in direct support of the PWS, showing experience, expertise, qualifications, and direct correlation to the PWS requirements. 2.c. The offeror shall provide any additional information that offeror feels will assist in the Government determining the eligibility and added value (if applicable) based on the individuals resume/position description/qualifications information. Please clarify the submission requirements of “non-key personnel”. Is it the government’s requirement that we are required to have identified each “non-key personnel” prior to the submission of the proposal and to submit each individual’s actual qualifications and experience with the proposal? No, each “non-key personnel” shall be identified at time of submission of the proposal.
24) (Reference Section C-4.6.3 & C-12.1) IAW Section C-12.1, contractors are required to provide off-site office spaces within 10 miles of the MCB Quantico front gate. The government will not provide any equipment, furniture and/or supplies for this off-site location. Section C-4.6.3. states that laptops, cellular phones and other items of convenience are not reimbursable as ODCs. These IT items are not incidental as they are required to support operations at the off-site location in Quantico vice items of convenience. Will the government authorize these items at the Quantico off-site as ODCs, incidentals in support of the contract? Section C-12.1 has been amended to say the following: “For WWR HQ, Quantico the contractor shall have off-site office spaces located 10 miles from Quantico vise “front gate” to house the remaining proposed contractor RCC’s supporting Quantico cases.” The government will authorize these items at the Quantico off-site as ODC, incidentals in support of the contract per section C-12.1
25) Section L-5.4 provides conflicting guidance regarding recent Past Performances to be submitted with the proposal. The first sentence defines recent as “within previous three (3) years”; later in the paragraph the relevant past performance is described as “within the last five (5) years”. Will the Government please clarify how recent the past performance must have been performed to be accepted? Section L-5.4 has been amended to say the relevant past performance must be within previous three years.
26) Para L5.4 states that references should email the forms directly to the RCO-NCR “on or before XX August 2012, 2:00 PM”. Will the Government please provide a due date for Past Performance Questionnaires? See answer to question # 18.
27) (Reference SF 1449, Block 10) M00264-14-R-0001 states that this procurement will be a Total Small Business Set Aside. The Limitation on Subcontracting requirement, as modified by the National Defense Authorization Act of 2013, states that at least 50% of the contract must be performed by the Small Business prime and any other “similarly situated entities”. Since this procurement is for a “Small Business”, will the Government please confirm that the contracted performance of ALL small businesses, when summed, can satisfy the small business performance minimum of greater than 50% of the amount paid to the small business concern under the contract per the NDAA of 2013. See answer to question #12. Adhere to FAR Clause 52.219-14 rather than 2013 NDAA.
28) (Reference SF 1449, Block 10) M00264-14-R-0001 states that this procurement will be a Total Small Business Set Aside. The Limitation on Subcontracting requirement, as modified by the National Defense Authorization Act of 2013, states that “a covered small business concern – in the case of a contract for services, may not expend on subcontractors more than 50% of the amount paid to the concern under the contract”. Will the Government please confirm that the required small business performance minimum of greater than 50% of the amount paid to the small business concern under the contract will be based on total contract value and funding per the NDAA of 2013? See answer to question #12. Adhere to FAR Clause 52.219-14 rather than 2013 NDAA.
29) : Para 5.4 states that “At least two (2) of the references must reflect past performance for contracts for which the Offeror has served as the prime contractor.” Will the Government accept past performance from a significant team member (subcontractor for this offering), for which the team member has served as the prime contractor? In accordance with FAR 15.305 the evaluation will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement.
30) (Reference Section I) FAR 52.222-49 Service Contract Act – Place of Performance Unknown. Is this contract subject to SCA? If so, it is requested that the appropriate wage determinations be provided for the locations specified in the PWS. Yes this contract is subject to SCA. Wage determination for Quantico, Virginia has been attached.
31) (Reference NDA) The Non-Disclosure Agreement (Attachment 1) refers to the role of the individual in the WWR Recovery Care Coordinator Program acquisition. While there are instructions for submitting Letters of Commitment, there are none regarding the NDA? When does the government intend the NDA to be submitted, and by whom should it be signed? Attachment One (1) NDA has been removed from the solicitation. Please disregard.
32) (Reference SF1449) Does the Government anticipate OCONUS requirements? If yes, how will OCONUS based costs such as Defense Base Act Insurance and uplifts be handled? No OCONUS requirement are anticipated.
33) Does the government have a particular individual in mind for the Program Manager position? The specific requirements prescribed for the Program Manager coupled with key personnel being the number 1 evaluation factor suggests this would be the case. The experience requirements, (“At least ten (10) years’ program management experience with the federal government; plus “Demonstrates knowledge of Marine Corps culture as a DOD Commander (Colonel or above) and/or GS 15 Level. Direct Marine Corps experience is preferred”; plus “Minimum of two (2) years’ experience in recovery care coordination”) narrows the possible candidates to only a couple of individuals when you consider the Wounded Warrior Regiment has only been in existence for just under seven years, with the Recover Care Coordinator part of the WWR being in existence right at five years. The later qualification, “Minimum of two (2) years’ experience in recovery care coordination” is the part when coupled with the high-level experience is what significantly limits the possible candidate pool suggesting a particular individual is in mind. If this is the case, it appears the company who produces the individual will be the company who is awarded the contract. This element reduces fair and open marked competition. I am sure a candidate who has at least ten (10) years’ program management experience with the federal government; plus demonstrated knowledge of Marine Corps culture as a DOD Commander (Colonel or above) and/or GS 15 Level with direct Marine Corps experience should be able to do a good job and bring fresh perspective. No, the government does not have a particular individual in mind for the Program Manager position. Section C-6.1.2.11 of the PWS has been amended to say the following: “Demonstrates knowledge of Marine Corps culture at a DOD (O6 or above) and/or GS 15 Level. Direct Marine Corps experience is preferred.”
34) Section L-3 indicates that five (5) Technical Volumes and five (5) Business Volumes should be submitted. Section L-4 indicates that one (1) original and five (5) redacted copies should be submitted. Please confirm the correct number of volumes to be submitted. See Answer to question 10.
35) Do you require both the technical and the business volume to be redacted? The Business Volume includes the completed SF1449, which would contain our company name, along with the Formal Offer Letter. Yes, see Answer to question 10.
36) Can you confirm that you will only accept Word and/or Excel documents in 2003 versions or earlier rather than later versions? Yes, to ensure the government is able to open and read the offeror Word and Excel documents they should be saved on a CD in 2003 version or earlier. Per Para L-3 Submission of Questions and Proposals, electronic proposals are not authorized for this solicitation and will not be considered. In addition to paper copies the Offeror shall submit all proposal information in electronic format on a CD. Text and graphics portions of the electronic copies shall be in a format readable by MS Word 2003 or earlier. Data submitted in spreadsheet format shall be readable by MS Excel 2003 or earlier.
37) Section L.5.2.a indicates that the offeror should provide at a minimum a job description and qualifications for non-key personnel and relevant background and experience on the non-key personnel in direct support of the PWS. Do you prefer that the offeror also submit resumes for non-key personnel? See section L.5.1.2.c. The offeror shall provide any additional information that offeror feels will assist in the Government determining the eligibility and added value (if applicable) based on the individuals resume/position description/qualifications information.
38) Please clarify what is required for the Standard Operating Procedures. Wouldn’t the SOP’s be developed during the Transition Plan in conjunction with the Government and the outgoing incumbent contractor? Yes the SOP’s will be developed during the Transition Plan in conjunction with the Government and the outgoing incumbent contractor.
39) Will the government please provide an estimate of the number of NMCI seats required? Approx. 55.
40) Will the government please provide the procedures for obtaining NMCI seats? Information will be provided upon award.
41) The Personnel Replacement Plan requires offerors to contact the Government a minimum of 5 business days prior to replacing any contractor employees being utilized in support of the requirement for Government review to ensure replacement meets minimum contract requirements. Does this mean Offerors can substitute/replace Key Personnel with five days’ notice to the government? Please see amendment to the solicitation Section H regarding substiution of key personnel.
42) Section L-3 states that the offeror should provide five (5) Technical Volumes and five (5) Business Volumes, a total of five (5) copies of each volume. Section L-4 states that offerors are required to submit one (1) original and five (5) copies of the proposal, a total of six (6) copies. Could the government please clarify? See answer to question 10.
43) The solicitation does not contain CLINS for caseload changes. Will the government consider amending the solicitation to include CLINS for caseload fluctuation during the period of performance? No.
44) Reference Section C-4.6.3, the solicitation states that the government has provided a not to exceed amount for non-local travel in the CLINS. The CLINS in pages 3-9 do not contain an amount. Could the government please clarify? See answer to question 14.
45) Reference Section C-13, are the security clearances the same for all sites and access to government IT systems such as email and databases? Background checks will be conducted instead of security clearances. The background checks will be the same for all sites and access to government IT systems such as email and databases?
46) Given that Key Personnel is a primary evaluation factor, suggest that 48 CFR 1552.237-72, Key Personnel Clause, be incorporated into the solicitation. Additionally, since the Key Personnel is such an important evaluation factor, recommend that fully executed contingent letters of commitment be required from proposed Key Personnel and included in the proposal submission. Yes, offerors shall submit contingent letters of commitment for all Key Personnel who are not current employees.
47) Reference Section L-4, Should the original copy be redacted? No, the original should not be redacted.
48) Reference Section L-4, Should the documents provided in electronic format be redacted or un-redacted? No, the single electronic copy should not be redacted.
49) Reference Section L-5.4 “Past Performance Questionnaires”, Section L.5.4 Past Performance states references should email the form directly to RCO-NCR at the address provided on the form on or before XX August 2012, 2:00 p.m. Can the Government please confirm the date and time that past performance questionnaires are to be submitted to the contracting office? See answer to question #18.
50) Page 1, SF 1449 and Page 90, Section L-3: The SF 1449 states that proposals are due at 12:00 am on 12 December 2013. Section L-3 states proposals are due at 2:00 pm on 10 December 2013. Could the government please confirm the correct proposal due date and time? See answer to question #4.
51) C-3.5 states that historically the Marine Corps manages a maintained caseload of approximately 1100 cases at any given time and although caseloads may vary with location and type, each RCC caseload is averaged at 25 at any given point. The solicitation also states that in accordance with the Department of Defense Instruction 1300.24 Recovery Coordination Program the Marine Corps provides assistance to WII Marines. DODI 1300.24 states that RCCs can maintain a maximum caseload of 40 each. Do the Marine Corps require an average of 25 per RCC or 40? Yes, 25 is the average minimum ratio with a maximun caseload of 40 per RCC.
52) Page 11, Section C-4.6.1: The solicitation states that local travel may be required. Can the government please provide an estimate, by location, of the amount of monthly local travel required to support the contract to be used in preparing contract pricing? See answer to question #18.
53) Page 11, Section C-4.6.2: Regarding local travel, will the government consider providing a not-to-exceed amount for local travel to include as part of an ODC CLIN? No. Contractors are required to pay for their own local travel. Local travel will not be reimbursed by the Government.
54) Page 12, Section C-4.8.1 and C-4.8.2: The solicitation states a requirement for contract support for cases during evenings, weekends and holidays. Please confirm this is accurate. In accordance with Para C-4.8.1, core hours of operation are 0900 to 1530, Monday through Friday, except for Federal holidays. Daily work schedules shall be arranged to be flexible in order to meet the scheduled needs.
55) Page 32, Section C-11 and Page 13, Section C-4.9: The solicitation indicates a requirement for contractor personnel to be located VA facilities. Will the government provide computers, Internet access, government email, and appropriate system/database access at these locations? It is not clear what is meant by “VA”. The Government will be providing equipment support for Veteran Affairs and all other locations except WWR HQ, Quantico, Virginia.
56) Page 32, Section C-11.1: The solicitation states that the government will provide workspaces at designated location. At locations where the government provides space, will the government provide copiers, faxes and other standard office equipment and office supplies? Section C-11.1 has been amended to say the following: The Government will provide office space, furniture, desktop telephones, and copiers at the government sites.
57) Page 32, Section C-12: Will contractor owned/supplied computers have access to government printers/copiers/faxes at government sites? No. However purchased NMCI seats will have internet access without access to printers/copiers/faxes at government sites.
58) Page 33, Section C-12.2 and Page 11, Section C-4.6.3: The government states in C-11.1 that it will provide laptop computers at government sites. Paragraph C-12.2 states that the contractor is responsible for obtaining NMCI seats. Are these laptops non-NMCI computers? If so, then does the government provide the equipment will the government also provide Internet access? See answer to question 56. C-11.1 has been amended to remove the reference to the Government providing laptops at the government sites.
59) Page 33, Section C-13: ANACIs are intended for government civilian personnel. Does the government intend for contractors to possess this background investigation? Yes
60) Page 33, Section C-13: Is this an unclassified contract? The security paragraph does not indicate if this is a Secret, Top Secret or unclassified contract. Yes, UNCLASSIFIED.
61) Page 33, Section C-13: Which government office will initiate a National Agency Check and Inquiries (NACI) for personnel who do not currently have a security clearance or NACI? Contractor responsibility.
62) Page 33, Section C-13.2 and Page 9, Section C-3.4: Paragraph C-3.4 and subsequent personnel requirements indicate that the government desires veteran/retired Marines, spouses, family members or those with a close ties and understanding of the Marine Corps. C-13.2 states that all personnel must meet the requirements for ANACI prior to assignment. Since an ANACI is only for government civilian personnel, candidates such as spouses and family members of Marines who do not have a prior background check are ineligible for this contract. Please confirm that ANACI is the governments intent. Yes, ANACI is Government intent that all contractor personnel possess this backround investigation.
63) Page 45, Clauses Incorporated by Reference: Clauses Incorporated by Reference, includes 52.222-49, Place of Performance Unknown, which includes the text, “This contract is subject to the Service Contract Act, and the place of performance was unknown when the solicitation was issued.” However, the solicitation does not include 52.222-43, Fair Labor Standards Act and Service Contract Act—Price Adjustment (Multiple Year and Option Contracts). Additionally, the solicitation in Section C-4.9, Table 1, provides the name and location of RCC Support Locations. If the solicitation is subject to the Service Contract Act, could the government please incorporate the solicitation the appropriate Wage Determination Schedule for each support location? Far Clause 52.222-43 has been added to the solicitation. The Wage Determination has been added as an attachment to the RFP for each RCC Support Location.
64) Page 91, Section L-4, Proposal Format: Can font in the headers and footers be smaller than Arial 11 point font? No
65) Pages 90-91, Section L-4 states the offeror is required to provide one (1) original and five (5) redacted copies of each volume without the names (i.e. company, company logo’s, key personnel, and any references to the company). However, in the bullet list of the same section it states, “Headers/Footers – ensure the company name and RFP number is included on each page”. Please clarify. The original non-redacted copy should include the Headers/Footers ensuring the company name and RFP number is included on each page. The 5 redacted copies should not have headers/footers including the company name and RFP.
66) Page 91, Section L-4.2, Business Volume: The solicitation indicates that the Business Volume shall contain a formal offer letter. Could the government please clarify what information should be included in the formal offer letter? The formal offer letter shall be a cover letter to the Business Volume. The offer letter shall be on letter head with a brief introductory statement along with a brief summary of the proposal included in the Business Volume.
67) In Section C-4.6.2, the Government states a NTE Travel amount has been provided in the CLINS. However, the CLINS as shown in Section SF 1449 continuation sheet do not have an estimate included. Will the Government please provide a NTE travel estimate for the travel CLINS? See answer to question #14.
68) Section C-9.1 states the QASP would be provided in Attachment 1. However, it appears the QASP has been included in Section E. Will the Government clarify the QASP as shown in Section E is the complete QASP for the contract? The QASP as shown in Section E is the complete QASP that will be incorporated as part of the contract.
69) Section C-15.1, Transition-In Period states phase-in support shall be provided by the Contractor for up to thirty (30) days. Is it the Government’s intent offerors propose a no-cost transition-in period and the transition-in period will actually commence at the start of the period of performance and be included as part of the overall performance period of the contract? No. A draft Transition-In Plan shall be delivered at the time of proposal. Any incurred cost shall be included in the price proposal.
70) Section L-3 states proposals are due 10 Dec but the SF 1449 states 12 Dec. Will the Government please clarify the submittal date and time of proposals? See answer to question #4.
71) Section L-5.4 states Past performances are due xx August 2012. Will the Government provide the actual date that Past performances are due for the solicitation? See answer to question #18.
72) Section C-6.1.2.3 states the PM must have initiative and leadership ability as demonstrated by sustained, successful performance in positions of increased responsibility. We understand the Government’s desire for the Contractor to provide a Program Manager with sufficient depth and breadth of experience within the Marine Corps environment. Requiring the PM to be a retired Colonel or GS-15 seems to bypass other viable candidates. A field grade officer (O-4 to O-6) has in-depth knowledge of the Marine Corps and sufficient management experience to oversee a program of this scope and scale—field grade officers have the “initiative and leadership ability as demonstrated by sustained, successful performance in positions of increased responsibility.” Would the Government explain the unique rationale that justifies the PM requirements that can only be filled by a retired Colonel or GS-15? A retired Colonel or GS-15 is not required. As stated in section C-6.1.2.11, the Government anticipates one (1) full-time contract employee that “demonstrates knowledge of Marine Corps culture at a DOD (O-6 or above) and/ or GS-15 level”. Direct Marine Corps experience is preferred.
73) Section C-6.1.2.11 states the PM demonstrate knowledge of Marine Corps culture at a DOD Commander (Colonel or above) and/or GS 15 level. Requiring the PM to be a retired Colonel or GS-15 seems to bypass or limit the Government’s access to a broader range of other viable candidates. A field grade officer (O-4 to O-6) has in-depth knowledge of the Marine Corps, sufficient management experience to oversee a program of this scope and scale, and experience at various levels of command and staff—field grade officers have the “initiative and leadership ability as demonstrated by sustained, successful performance in positions of increased responsibility.” Will the Government consider a field grade officer as having sufficient depth and breadth of experience within the Marine Corps culture? See answer to question #72.
74) In section C-6.1.2 (Executive Level Support – Program Management (Key Personnel)), state requirements for the PM. Broadening the PM requirements to permit a more complete range of qualified candidates with skills based upon bona fide occupational qualifications would be in the Government’s best interests. Requiring the PM to be a retired Colonel or GS-15 bypassed or limits other viable candidates who meet the other listed criteria. For example, Navy officers are routinely assigned to Marine Corps units and function as an integral part of the Marine Corps team. Would the Government take a reasonable approach and include Navy officers who may have similar responsibilities within Marine Corps organizations? Yes, see answer to #72.
75) In section C-6.1.2.15 it requires a minimum of two years of recovery care coordination experience. The 2008 National Defense Authorization Act (Subtitle A—Policy on Improvements to Care, Management, and Transition of Recovering Service Members, Section 1611), identifies specific qualifications that must be met by all Recovery Care Coordinators working within DOD. Based upon the RCC standards established by DOD, does two years of RCC experience gained supporting another uniformed Service under DOD guidelines meet the Government’s requirements for RCC experience? Yes
76) In section C-6.1.2.15 it requires a minimum of two years of recovery care coordination experience. The 2008 National Defense Authorization Act (Subtitle A—Policy on Improvements to Care, Management, and Transition of Recovering Service Members, Section 1611), identifies specific qualifications that must be met by all Recovery Care Coordinators working within DOD. Similar job qualifications have been established within the Department of Veterans Affairs, within Non-Governmental Organizations (NGO), Private Volunteer Organizations (PVO), and the private sector. Based upon the RCC standards established by DOD, does two years of experience gained supporting another organization providing similar wounded warrior services meet the Government’s requirements for RCC experience? All proposals will be evaluated in accordance with the solicitation..
77) For the positions that the Government has stipulated the requirement as being full time, is it the Government’s intent that offerors propose pricing for full time positions using 1920 hours per full time position? Yes.
78) In section C-5.1.2 it states the required training for the RCCs. Is it the government’s intent the contractor has fully trained DOD staff in addition to the required FTEs available to fill in the position while permanent replacements are being trained? Someone in the contractors organization must meet DOD requirements to fill in as needed.
79) In section C-12.2 it states that the Contractor shall be responsible for providing internet access for both on and off-site locations…including being responsible for obtaining and funding NMCI workstations. And the Contractor will be responsible for providing air cards, PKI certification, printers etc. This seems to contradict section C-4.6.3. Other Direct Cost Management which states that Laptops, cellular phones and other items of convenience are not reimbursable as ODCs. Is it the government’s intent the contractor provide internet access for government onsite locations? Yes
80) Table 1 “RCC Support Locations” indicates the facility will be within 10 miles of the front gate of Quantico will be the hub for the RCC Program. Is there a requirement for the PM, Assistant PM or the Program Analyst to be physically located at this facility? Yes.
81) Section C4.6.1 indicates the government will not reimburse local travel but that local travel may be required. So we can capture this cost in our bid, could the government estimate the amount of non-reimbursed local travel that is required annually? No, please use the NTE amount for travel as indicated in the amendment.
82) Section C.4.3.2 indicates, “as a minimum, SOPs shall provide an outline of the content to be covered, results to be achieved, and duties to be performed.” Section L-5.2, 1.d indicates evaluated factors are “SOPs that detail how the contractor will operate their responsibilities in the day-to-day operation of this program.” Could the government clarify whether an outline of SOPs as indicated in C.4.3.2 is sufficient? Yes, sufficient
83) Section C4.9 lists the locations for the RCCs. Could the government clarify if it is providing space at facilities at those locations? Will the government provide any GFE at these locations? See section C-11 of the PWS. The Government shall provide all work spaces for each location except WWR HQ (see 12.1 of PWS). One (1) office space with a maximum capacity of three contractor employees will be available for contractor use at WWR HQ, Quantico, VA (see 12.1 of the PWS). The Government will provide office space, furniture, desktop telephones and copiers at the government sites except WWR HQ, Quantico, Virginia.
84) Sectbharrision L-5.4 lists the due date for the Past Performance Questionnaires as “XX August 2012”. Can the Government provide the due date for the Past Performance Questionnaires? See answer to question #18.
85) Section L-5.4 defines recent past performance as “within previous three (3) years” in the first sentence, but references “within the last five (5) years” later in the paragraph. Can the Government please clarify the time frame that will be used to define “recent” past performance? L-5.4 has been amended to say the following: The Offeror will provide at least three (3) references demonstrating relevant past performance involving the quality of performing the same or similar services within the last three (3) years.
86) Section L-3 asks that offerors provide “five (5) Technical Volumes and five (5) Business Volumes” as part of their submission, however L-4 references that offerors should provide “one (1) original and five (5) redacted copies of each volume”. Should offerors provide 5 total copies of each volume (as indicated in L-3) or 6 total copies (as indicated in L-4)? See answer to question #10.
87) The solicitation contains DFARS 252.225-7040, which covers rules when contractor personnel have to accompany troops deployed to war zones; however no reference is made to the possibility of deployment in the PWS. Can the Government confirm that contractor personnel will not be required to deploy as part of this contract? No deployment requirement.
88) Is this a new requirement or is there an incumbent? If there is an incumbent, would you please provide the billable hourly rate and total contract value? See answers to questions 2 & 3.
89) If there is an incumbent, is the incumbent contractor eligible to bid as a prime contractor? See answer to question #3.
90) Can the government provide the SCA Occupation Codes to be used for each position? See answer to question #30.
91) Performance Work Statement. 4.10 Govt Furnished Information. We request a current version of MCO 6320.2. MCO 6320.2F is not available on the internet. Version E is current version.
92) Performance Work Statement. C-5.1.2 and C-5.1.2.1 RCC Training. Para C-5.1.2 states DoD training will be provided by the Government within 4 months of award, with caveat for each “non-DOD trained RCC” to be able to “reach back” to a trained contractor prior to training completion. However, paragraph C-5.1.2.1 states RCCs may not assume RCC duties until training is complete. Please clarify what training an RCC has to complete before assuming duties. Government provided Training specifics will be made available upon award.
93) Performance Work Statement. C-6.4. LOE is provided for Key Personnel, Lead RCC, and RCCS. LOE is not privided for Applications Programming and Report Management. Does the government anticipate this being a 1.0 FTE? Yes
94) Performance Work Statement. Table 2 and referenced paragraphs within the Table.
The following inconsistencies were found in Table 2:
· 2nd row, 3rd column – Paragraph listed (C-5.1.3.2) for deliverable #0001 does not exist. This should read C-5.1.2.2. PWS has been changed to read C-5.1.2.2.
· 4th row, 3rd column – Paragraph C-5.1.4 does not mark paragraph as deliverable #0003. PWS has been updated.
· 5th row, 3rd column – Paragraphs C-5.1.5 and C-6.1.1.3 label ad hoc reporting as deliverable #0003, the table labels ad hoc reporting as #0004. PWS has been updated.
· 6th row, 3rd column – Paragraph C-6.4.1.9 does not exist. This should read C-6.5.1.9, however C-6.5.1.9 describes the Summary of Services Report as deliverable #0004, not #0005. References to deliverable #0005 do not exist in the text (other than the Table itself) PWS has been updated and table 2 has been changed to read C-6.5.1.9.
· The Comprehensive Recovery Plan described in paragraph 6.1.1.10 is referenced as deliverable #0003, but is not in the Table anywhere, and if it is deliverable #0003, the deliverables are incorrectly numbered. PWS has been updated. 6.1.1.10 is not included on Table 2.
· In paragraph 6.4.1.1 the Daily Disability Evaluation Report is discussed. Assuming that the Government wants to ensure these reports are delivered within the RCC program daily, and would want daily notification of such, consideration should be given to making this report a deliverable as well.
Please confirm the below list contains all deliverables: Yes, confirmed
· Service Specific Training Curriculum and training materials
· Monthly Status Report
· Summary of Services Report
· Semi-annual RCC Location Optimization Review
· Ad hoc reports as required
· Daily Disability Evaluation Report Other deliverables as required
95) Performance Work Statement. C-9.1 QASP. The end of paragraph C-9.1 references Attachment 1 QASP. Section E is labled QASP and Attachment 1 is the NDA form. Recommend administrative correction. See answer to question #68.
96) Performance Work Statement. C-9 Table 3, Staffing Target Standard.
Table states “subcontractor staffing pulls.”
1. Please clarify subcontractor staffing pulls
1. Please clarify why backfill for unscheduled staff departures must be filled in 14 days, while new hires allow for 30 days.
Recommend this standard be considered for deletion with the understanding that privity of contract for performance rests between the government and the prime contractor. The following target standard in Table 3 of section C has been removed: “Subcontractor staffing pulls <10- days from notification of vacancy”. Please disregard.
97) Performance Work Statement. C-12.2 NMCI Seats. What is the government process for configuration of a wireless solution and the estimated timeframe to accomplish? This information will help contractors plan for transition activities. Wireless has not implemented yet. The timeframe is unknown.
98) Performance Work Statement. C-13.1 Security and Access. Will the government provide a list of the US Marine Corps communications regulations pertaining to network activities? No
99) Performance Work Statement. C-13.2 Security and Access. Will the government provide an electronic copy of the WWRO 12400.01? The WWRO 12400.01 will be provided as an attachment.
100) H.1. Notification of Potential Organizational Conflict(s) of Interest. “… Of primary concern are those existing contractual arrangements in which a Contractor provides support to programs, operations or related activities for Marine Corps Systems Command Product Group 10.” H.1 has been amended replacing the “Command Product Group 10” with the “Wounded Warrior Regiment”.
101) 52.207-3-Right of First Refusal of Employment - MAY 2006. Please confirm that this clause is N/A to this RFP as it relates to Federal Employees only. Clause is N/A and has been removed from the RFP.
102) 52.222-49 Service Contract Act-Place of Performance Unknown.
After a close review of the PWS and the tasks to be performed it is our determination that none of the labor required falls under the Service Contract Act. We respectfully request that this clause be deleted.
If the government decides that the SCA still applies, and since places of performance are defined under this fixed price contract, the following clauses should be included:
· 52.222-41, Service Contract Act of 1965 (Nov 2007) (41 U.S.C. 351, et seq.)
· 52.222-43, Fair Labor Standards Act and Service Contract Act—Price Adjustment (Multiple Year and Option Contracts) (Sept 2009) (29 U.S.C. 206 AND 41 u.s.c 351, et seq.).
52.222-44, Fair Labor Standards Act and Service Contract Act—Price Adjustment (Sep 2009) (29 U.S.C. 206 AND 41 u.s.c 351, et seq.).
SCA applies for Northern Virginia . The following clauses have been added:
52.222-41 Service Contract Act of 1965 52.222-43 Fair Labor Standards Act and Service Contract Act-Price Adjustment (Multiple Year and Option Contracts).
103) Information Regarding Responsibility Matters. Page 47. Where does the Government want the certifications such as “Information Regarding Responsibility Matters” to be included? If it is in Volume II – Business Volume, request that these be excluded from the page count. Information Regarding Responsibility matters shall be submitted in Volume II and will not be counted toward the 25 page limit for that volume.
104) L Section L – Instructions, Conditions and Notices to Offerors. L-4. Proposal Format. “The offeror is required to provide one (1) original and five (5) redacted copies of each volume without the names (i.e. company, company logo’s, key personnel, and any references to the company).” Please clarify whether the original volumes are to be redacted as well as the copies. See answer to question #10.
105) Section L – Instructions, Conditions and Notices to Offerors. L-4. Proposal Format. The offeror is required to provide one (1) original and five (5) redacted copies of each volume without the names (i.e. company, company logo’s, key personnel, and any references to the company).” However bullet 6 on the next page states, “Headers/Footers – ensure the company name and RFP number is included on each page” Please clarify. See answer to question #10.
106) Section L – Instructions, Conditions and Notices to Offerors. L-6.1 Facter 5. Price. Second paragraph states: “Offerors shall use the not-to-exceed amounts provided in Section B, CLIN 0002, 1002 and 2002, of the solicitation for Travel” Section B does not provide the NTE amounts. See answer to question #14.
107) Section L – Instructions, Conditions and Notices to Offerors. L-5.4 Factor 4: Past Performance. Section L-4 instructs offeror to submit proposals with no company or key personnel identification. Section L-5.4, Past Performance, requires identification of Key Staff involved who will be assigned to the RCC program. Request that this requirement be deleted as it is considered to be identifying information. Section L-4 is referring to the proposal format where it requires the offeror to provide one (1) original and five (5) redacted copies of each volume without the names (i.e. company, company logo’s, key personnel, and any references to the company). Section L-5.4 refers to past performance and the data that is required in the Past Performance Questionnaire.
108) Section L – Instructions, Conditions and Notices to Offerors. L-5.4 Past Performance. “… Past Performance Questionnaire to the same three (3) previous references. The references should email the form directly to the RCO-NCR at the address provided on the form on or before XX August 2012, 2:00p.m. Reqeust PPQ due date and time. See answer to question #18.
109) Section M-Evaluation Factors. M-6 completeness and Accuracy. Are we correct in our understanding that the “B-Table” referenced are the Section B CLINs? If not, what is the “B-Table”? The price proposal will be checked for mathematical correctness to include checking arithmetic in all pricing table computations. Section M-6 of the PWS has been updated. Please disregard the reference to the “B-Table”.
110) Section M-Evaluation Factors. Since this contract primarily supports wounded, ill and injured Marines, and to assist the agency with achieving socioeconomic small business goals we recommend that the contracting officer consider providing evaluation credit to Service Disabled Veteran-owned Small Businesses. This credit could be applied per the Veteran Affairs Policy “E.3 VAAR 852.215-70 Service Disabled Veteran-owned Small Business and Veteran-Owned Small Business Evaluation Factors (2009)” Which is applied per this extract: “Eligible service-disabled veteran-owned contractors will receive full credit, and contractors qualifying as veteran-owned small businesses will receive partial credit…” This is not the Veterans…
