INSTRUCTIONS TO OFFERORS

1. The Government may evaluate quotes and award a contract without discussions. Therefore, the initial quote should contain the Quoter’s best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

The Government intends to award a single Firm-Fixed-Price (FFP) purchase order for a base year and four one-year option periods, as a result of this solicitation. Each Quoter shall submit a quote that clearly and concisely describes their response to the requirements of this solicitation. Use of general or vague statements such as “standard procedures will be used” will not satisfy this requirement. Unnecessary elaboration or presentations beyond that sufficient to present a complete and effective quote are not desired and may be construed as an indication of the Quoter’s lack of understanding. Elaborate artwork and expensive visual or other presentation aids are discouraged.

1.1 Quotes must be prepared in accordance with these instructions. Failure to do so may result in the Quoter’s submission being determined to be unacceptable and ineligible for award. Each Quoter’s submission shall be screened by the Contracting Officer or a designee upon receipt to ensure completeness and compliance with the instructions contained in the RFQ. Elimination of a Quoter is at the sole discretion of the Contracting Officer.

1.2 Proprietary information submitted in response to this solicitation will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C. 423) (hereinafter referred to as "the Act") as implemented in the FAR. Contractor personnel assisting in the quote evaluation are procurement officials within the meaning of the Act, and will take all necessary action to preclude unauthorized use or disclosure of a competing Contractor's proprietary data.

1.3 The Government's obligation under this contract is contingent upon the availability of funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. The Government reserves the right to phase the project based upon funds available. The phases will be based on the successful Quoter's price quote submitted in accordance with the section herein.

1.4 QUESTIONS: Offerors may submit questions requesting clarification of solicitation requirements. All questions must be received by Thursday, March 21, 2013 at 12:00 P.M (EST). All questions must be submitted via electronic mail to the Contracting Specialist at george.bozadjian@usmc.mil. It is at the government’s discretion to respond to questions received after the closing date/time. For quotation purposes, the estimated date of contract award is anticipated with a period of performance start date of Monday, April 29, 2013 in order to incorporate a transitional period of no more than 30 days with the incumbent. If this transition period is deemed not required by the offeror, the period of performance may begin earlier. The Offeror will address the Period of Performance in their proposal and rationalize why they will or will not require a transition period.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

15 years of experience in piano maintenance; and

Evaluation Factor Two: Past Performance – In this section, the Offeror must include three references (customers) for whom like or similar products and services have been performed within the past two years.

The Offeror must provide the following information for each reference:

Company Name and Address;

Contract Number;

Evaluation Factor Three: Price – the Offeror must provide the price per job for their typical piano maintenance parts and services for the base year and additional four (4) option years. Pricing shall be that of an Open Market and detail the discounts offered, and other pricing opportunities. The Offeror shall provide sufficient price information to allow the Contracting Officer to determine the completeness and reasonableness of the quoted prices. It is highly encouraged for the Offeror to provide the best price for its products and services. Offeror shall complete the CLIN schedule for all CLINS and state unit and extended pricing (to include travel).

The Government will evaluate Offerors proposed prices, but this factor will not be given an adjectival rating.

Evaluation of the proposed prices for the services will be based on a comparison of proposed prices received in response to the solicitation and may also be based on a comparison to the IGCE along with any other relevant price analysis techniques. All option period pricing to include the extension of services in accordance with FAR 52.217-8 will be considered in the evaluation.

The Offeror is advised to submit an offer that represents the best-value to the Government. Price fairness and reasonableness will be evaluated in accordance with FAR 13.106-2(b). Technical Capability is more important than Past Performance. Past Performance is more important that Price. All evaluation factors other than price, when combined, are significantly more important than Price. Price will still contribute to the fairness and reasonableness of the award.

(b) Technical Capability will be evaluated as follows:

Rating Description Outstanding Offer meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.

Good Offer meets requirements and indicates a thorough approach and understanding of the requirements. Offer contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.

Acceptable Offer meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.

Marginal Offer does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The offer has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.

Unacceptable Offer does not meet requirements and contains one or more deficiencies. Offer is unawardable.

(c) Past Performance will be assessed based upon the citations provided by the Offeror and feedback provided by customer references. There are two (2) aspects to the past performance evaluation.

The first is to evaluate the Offeror’s Past Performance to determine how relevant a recent effort accomplished by the Offeror is to the effort to be acquired through the source selection.

The following table reflects the Past Performance Relevancy Ratings:

Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The second aspect of the past performance evaluation is to determine how well the Contractor performed on the contracts.

The following table reflects the Past Performance Confidence Assessments:

Rating Definition Substantial Confidence Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.

Unknown Confidence (Neutral)

No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

(d) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(e) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
