LIMITED SOURCE JUSTIFICATION

PURSUANT TO FAR 8.405-6

This acquisition is conducted under the authority of the Multiple Award Schedule Program (MAS) in accordance with FAR 8.405-6(a)(1)(i)(C).

1. Identification of Agency and Contracting Activity

The United States Marine Corps, Regional Contracting Office-National Capital Region (RCO-NCR), located at 2010 Henderson Road, Quantico, Virginia is the supporting Contracting Activity in support of Marine Corps Intelligence Activity (MCIA) located at 2033 Barnett Ave, Quantico VA 22134, which is the requiring activity.

2. Nature and/or Description of Action

This requirement is for a logical sole source follow-on “bridge” to an original order placed to the incumbent contractor Consumer Management Solutions (CMS). This requirement is in support of the Marine Corps Intelligence Activity in support of technical systems engineering and administrative services in Special Security, Information Assurance, Program/Financial Management, SharePoint Software Development and Geospatial Operations Management and Geospatial Systems Engineering.

The incumbent contractor, CMS, current competitively awarded contract M00264-10-F-0193, was issued by Regional Contracting Officer (RCO) and expires July 15, 2013. It has been determined CMS, will be awarded a Firm-Fixed Price (FFP) contract as a logical follow on “bridge” contract. This logical follow-on order shall serve as a “bridge” until the requirements for a new competitive procurement can be defined and a new long term contract issued.

MCIA’s Command Element support was first awarded July 14, 2010 and sustained through a multi-year contract through CMS. The placement of this sole source contract to CMS, will allow the necessary time for the RCO Quantico to compete and award a contract after full and open competition is conducted. The total estimated value of this “bridge” contract is: $603,793.90 and covers a period of performance of five (5) months.

3. Description of Supplies/Services

Marine Corp Intelligence Activity (MCIA) has a requirement to obtain the necessary labor, and facilities to provide continuing technical, systems engineering and administrative support services in Special Security, Information Assurance, Program/Financial Management, SharePoint Software Development and Geospatial Operations Management and Geospatial Systems Engineering.

The Performance Work Statement (PWS) for this requirement defines the non-personal programmatic, technical and engineering support services required by the Marine Corps Intelligence Activity Command Element (MCIA CE). This task specifies for support in the following three functional areas: MCIA CE Special Security Office (SSO), Information Assurance (IA) and Financial and Logistical Program Management (FLPMO) support.

The period of performance for this work will consist of five (5) months beginning July 15, 2013 – December 15, 2013.

The overall estimated value of the contract is: $603,793.90.00. FY13 funds in the amount of $603,793.90.00 are available to fund the contract. The independent Government estimate was derived from current FY pricing being paid on contract M00264-10-F-0193. Due to the requested period of performance, no escalation was supplied.

4. Statutory Authority Permitting Other Than Full and Open Competition.

This acquisition will be conducted pursuant to Federal Acquisition Regulation (FAR) subsection 8.405- 6(a)(c), in the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule (FSS), which was placed in accordance with the FSS ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures.

5. Identification of Justification Rationale

Reason for Authority Cited:

The task order is being issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under contract M00264-10-F-0193. This sole source “bridge” acquisition represents the best solution to meet the short turnaround time for continued support services.

The current contract expires July 14, 2013. And it is in the best interest of the government to award a follow on “bridge” task order to CMS. The award to CMS will allow time for the procurement of a long term contract solution to provide these services.

The services requested provide MCIA with support service operations and maintenance of the the Sensitive compartmented information Enterprise Office (SEO) and concurrent Joint World Wide Intelligence Communication System (JWICS) and National Security Agency Network (NSANet)t functions. With potential sequestration, continuing resolution, POM14 budgeting and POM15 programming actions, continued contract support is vital to day-to-day operational readiness in the CE functions of geospatial engineering support, financial and logistical program management support, and informational and personnel security support. Failure to execute this “bridge” contract would result in a stop in service which would be detrimental to MICA operations, specifically the operations of Marine Corps Intelligence Surveillance.

The proposed sole source contractor is CMS. CMS has provided contracted support services since 2010, which provided technical support to MCIA and its JWICS users worldwide. The required services are deemed to be available only from the original source for the continued provision of these highly specialized services because it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition, and unacceptable delays in fulfilling the agency's requirements.

6. Description of Market Research

An analysis was performed to determine if the required services could continue to be provided through commercial resources, and specifically by a small business concern. A review of firms with capabilities in the current NAICS code (561110) was conducted using GSA Advantage, which validated that there were multiple firms that could fulfill the Marine Corps’ needs on and adequate and efficient basis. Based on the results of the market research it was determined that this requirement should be set aside for small business, with a further preference for SDVOSB concerns.

7. Other Factors Supporting the Justification

CMS has provided services since 2010 and has already worked through the learning curve and has established a system for tracking and providing staff that works well. Another contractor at this point would require a complete change in current staff, resulting in increased costs to the government associated with learning curve and transition of duties and staff. The lack of a transition plan in the current contract further increases the likelihood of additional costs and performance delays if another contractor besides CMS is utilized.

8. Determination of Fair and Reasonable Cost

The Contracting Officer anticipates the prices of the effort will be fair and reasonable and will ensure this by using the GSA FSS Price List as reflected in CMS’s current GSA Schedule Contract.

9. Actions Taken to Remove/Overcome Barriers to Future Competition

MCIA in conjunction with the Marine Corps Base Quantico’s RCO has commenced efforts to develop a full and open competition for this requirement. All efforts will be made to ensure maximum competition will be achieved for the planned competitive acquisition.
