Justification for Other than Full and Open Competition – FAR Part 13 Acquisitions under the SAT
V 1.3 (28 June 2018)
MEMORANDUM TO THE FILE
Subj: JUSTIFICATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION FOR A FAR PART 13 ACQUISITION UNDER
SIMPLIFIED ACQUISITION THRESHOLD.
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Two Garbage trucks for the ongoing refuse collection aboard MCRD Parris Island South Carolina.
III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):
A. ___ CURRENTLY THE ONLY RESPONSIBLE SOURCE (select all that apply):
1. ___ RESTRICTIVE RIGHTS.
2. ___ EXCLUSIVE LICENSING AGREEMENTS.
3. ___ OTHER REASONS.
B. ___ BRAND NAME
No brand name required, however the asset must be front end loader.
C. _x__URGENT AND COMPELLING.
The assets are of such unusual and compelling urgency that the Government would sustain serious back up of trash collection which would create an environmental hazard and and unsafe conditions around the installations.
Currently, Public Works Division, Road and Ground section aboard MCRD Parris Island is behind schedule for trash collection. Any further delays would be detrimental to their daily mission and operations.
Justification for Other than Full and Open Competition – FAR Part 13 Acquisitions under the SAT
V 1.3 (28 June 2018)
Currently, Road and Grounds section has two garbage trucks, and both are inoperable due to mechanical failures. Trash collection aboard MCRD Parris Island is a six (6) day a week task. It is critical to resume this task to avoid environmental and safety hazards and Department of Health and Enviornmental (DHEC) violations.
In the past, RDK, Inc. have provided lease trucks on a competitive basis and have proven to be fair, reasonable, and swifly responsive in providing garbage trucks to our organization.
1. Date on which the requirement was first identified: 15 Jan 2020
2. Required delivery date/period of performance: 21 Jan 2020
3. Explanation of why delivery/commencement of services by the date mentioned above is required: Refuse collection is a 6 day a week ongoing process aboard MCRD Parris Island. Trash cans will quickly overfill thereby attracting rodents and pests throughout the Depot. These unsanitary conditions also may subject the Command to fines associated with DHEC violation.
