30 March 2015 Control No. 15-MCASCP10004

LIMITED SOURCE JUSTIFICATION AND APPROVAL

PURSUANT TO FAR SUBPART 8.405-6

Upon the basis of the following justification, I, as Contracting Officer, hereby approve the proposed sole source acquisition being conducted under the authority of the Multiple Award Schedule Program (FAR 8.401).

1. Contracting Activity. Cherry Point Satellite Contracting Office, Marine Corps Air Station, Cherry Point, NC.

2. Nature and/or description of the action: This justification authorizes issuance of a task order against a Federal Supply Schedule pursuant to FAR Subpart 8.4, when restricting consideration of schedule contractors to fewer than required in FAR Subpart 8.405-1. A firm fixed price task order will be used to minimize the risk to the Government.

3. Description of Supplies/Services. This requirement is to provide CATIA (Computer Aided Three-Dimensional Interactive Application) training for the period of 15 May 2015 through 30 September2015 as required by the Fleet Readiness Center East (FRCE), MCAS, Cherry Point, NC. CATIA is a multi-platform application that utilizes computer-aided drafting and design (CAD)/Computer-aided manufacturing (CAM) and Computer-aided engineering (CAE) software. This commercial software suite was developed by the French company Dassault Systems and is marketed in the United States solely by ImmixTechnology Inc. The total estimated value of this requirement is

4. Identification of the iustification rationale. The statutory authority permitting the limited restriction of competition is FAR 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services at the level of quality required because the supplies or services are unique or highly specialized.

5. Rationale Justifying Use of Cited Statutory Authority. FRCE Fleet Support Teams require training for the improvement of the processing of computer aided design work packages for aircraft and weapon systems using the software products for accessing digital data in the native CATIA V5 form state for the manufacture, maintenance, upgrade and repair of all critical aircraft components and systems. Therefore, all training has to be specialized for the existing software from the OEM. The lack of training on this software degrades the FRC’s ability to interface with, convert, exploit, share and output this digital data across the FRC Enterprise that is crucial to continue critical support to the War fighter and to existing and future Public/Private agreement with industry partners. The FRC community currently has workload that requires effective use of digital data and training is required to use the software to manage the work. This requirement will only increase as CH-53K, V-22, H-i and JSF workload comes into the FRC. Without this procurement, FRC East would have to continue translating/healing 3D models to manufacture parts via trial and error. Any translations from one CAD program to another CAD result in the loss of geometric and parametric data. This translation data loss then requires a healing process to make the model unusable. The complexity of the healing process can take up to 250 engineering hours on a complex part or longer without proper training. Procuring training on the CATIA software allows FRC East the capability to manufacture directly from the native 3D model. The result is 100% confidence that the manufactured part contains 100% of the OEM engineering analysis, testing, validation, and verification. The CATIA VS software training is the only training identified that will provide material and hands on training for use of the CATIA software resulting in error free translations and maximum compatibility in all aspects of form, fit and function. The overall requirement for the CATIA training is driven by private industry use and deliverables that must remain in an un translated/Native CATIA format and our need to have the ability to use all aspects of the software.

Dassault Systems, a French company, is the sole designer and developer of the CATIA V5 software and the only source qualified to provide training support and required training. The CATIA V5 software training is marketed in the United States solely by lmmix Technology Inc, distributor.

6. Determination of best value: An order under ImmixTechnology’s GSA contract is determined to provide the best value to the Government.

7. Description of Market Research: Market Research was conducted and CATIA training was found to be available under Federal Supply Schedule 70. No additional market research was conducted as Dassault Systems holds the proprietary data rights to this software and ImmixTechnology Inc, is the sole distributor for Dassault Systems

8. Determination of Fair and Reasonable Cost. A firm fixed price Task Order will be issued under ImmixTechnology Inc’s Federal Supply Schedule. In accordance with FAR 8.404(d), GSA has already determined the prices to be fair and reasonable. The government will request discount of the vendor’s GSA prices.

9. Actions to Remove Barriers to Future Competition. For the reasons set forth in Paragraph 5 above, there are no plans at this time to compete future contracts due to the proprietary nature of the required software.
