J&A No. 13-MCASCP10003
JUSTIFICATION AND APPROVAL FOR
USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. Cherry Point Satellite Contracting Office, MCAS Cherry Point, NC.
2. Description of Action Being Approved. This J&A authorizes and approves the award of a sole-source, firm-fixed price, contract to Timken Gears & Services Incorporated (Philadelphia Gear), 901 East 8th Ave. STE. 100, King Of Prussia PA, 19406 for the Remanufacture/Overhaul of the H-53 Main Gearbox Test Stand Input Shaft and related components as required by the Fleet Readiness Center (FRC) East, MCAS Cherry Point, NC
3. Description of Supplies/Services. This requirement is for the Remanufacture/Overhaul of the H-53 Main Gearbox Test Stand Input Shaft and related components (Philadelphia Gear Model AFT 22BI), which sustained catastrophic failure inside the gearbox of the test stand in October of 2012. In November 2012, a purchase order was issued to Philadelphia Gear for evaluation of the input shaft and provision of a quote for the remanufacture/overhaul of the shaft and related components. As a result of the evaluation, a quote was provided by Philadelphia Gear in the amount of $299,690. The Government’s total estimated dollar value of this requirement is $398,820.
4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 U.S.C. Section 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority. Philadelphia Gear is the sole designer, developer, and integrator of the H-53 Main Gearbox Test Stand Input Shaft and related components. As a result, Philadelphia Gear is uniquely qualified to remanufacture/overhaul the shaft and related components. Philadelphia Gear is also the only known firm that possesses the technical data, drawings, and specifications necessary to fulfill the Government’s requirements. Given Philadelphia Gear’s involvement with the design, development, qualification, manufacturing, and continuing improvements of the H-53 Main Gearbox Test Stand and the input shaft component, Philadelphia Gear has the original design intent, original engineering drawings, and the most recent design changes to the H-53 Main Gearbox Test Stand and the input shaft component readily available to them. In addition, much of the technical data, material, and manufacturing processes required to perform remanufacture/overhaul of the shaft were developed by Philadelphia Gear. This privately developed data, along with the corporate expertise, are the sole property of Philadelphia Gear.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible For the reasons stated herein, no attempts have been made to compete this requirement. However, a notice of the government’s intent to sole source this requirement will be posted in accordance with the requirements for FAR 5.2. All responses received will be evaluated prior to award of the contract.
7. Determination of Fair and Reasonable Cost. The Contracting Officer will determine the proposed cost to the Government of the supplies/services covered by this J&A to be fair and reasonable. The fair and reasonableness of the cost/price will be based on an analysis of the contractor’s cost/price proposal, which will include Information Other Than Cost or Pricing Data in accordance with FAR 15.403-3. It is anticipated this analysis will be conducted using experienced technical representative and knowledge of the contract specialists.
8. Actions to Remove Barriers to Future Competition. For the reasons set forth in Paragraph 5 above, the Marine Corps has no plans at this time to compete future contracts for the types of supplies/services covered by this J&A. If another potential source emerges, the Marine Corps will assess whether competition for future requirements is feasible.
