Justification for other than full and open competition, Sole Source Justification

Description of Action:

This justification is prepared in accordance with the requirements of FAR 6.303 and/or 13.106 to support the recommendation that the Department of Justice (DOJ) use other than full and open competition for the acquisition of the following item:

Lumen – OCDETF Fusion Center (OFC) Network Circuit

Period of Performance: 1 year

Total Estimated Value $42,000

Negotiations will be conducted with Lumen on a noncompetitive basis under the statutory authority of 41 U.S.C. 253(c)(1), only one responsible source, as implemented in FAR 6.302-1 and/or 13.106.

Description of Requirement:

The proposed acquisition will continue the network circuit services Lumen provides to OCDETF, on a firm, fixed price basis.

Lumen provides secure Internet services to the OCDETF Fusion Center (OFC) through which several OCDETF member agencies contribute data as per their agency memoranda of understanding (MOUs).

Technical Justification:

This FY25 procurement request is for the Lumen network circuit used to exchange data between OCDETF member agencies outside of the Department of Justice and the OCDETF Fusion Center. OCDETF member agencies provide critical law enforcement case and intelligence information to the OFC.

Unique Qualifications of the Acquisition:

Lumen currently provides secure networking to the OCDETF Fusion Center (OFC) for both unclassified and classified networks, with the data drops and “dark fiber” ring servicing the Merrifield facility and data center for both OCDETF and for other federal tenants in the same facility (e.g. DEA). This service supports ongoing national security operations.

Any disruption or lapse of the Lumen network circuit will pose a significant operational issue for the OFC and for OCDETF operations nationwide. A disruption or lapse would impact both our availability of OCDETF member agency data, our contractors’ ability to work, and the OFC analysts’ day-to-day jobs doing open source & commercial data research.

Price Determination:

A price evaluation will be conducted based on previously purchased network services along with other relevant information to determine that the price is fair and reasonable.
