OPOAM 3008.405-6(a)(2) Limited-Sources Justification (LSJ)

- 1 -

LSJ No.: FY16-0004

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. §§ 3102 et seq. and 40 U.S.C. § 501, Services for Executive Agencies.

1. Agency and Contracting Activity. Identification of the agency, contracting activity, and specific identification of the document as a "Limited-Sources Justification."

The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), DOAD proposes to award an order pursuant to FAR 8.405-6(a), Limiting Sources.

2. Nature and/or description of the action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).

DHS/OPO intends to limit the number of sources solicited pursuant to FAR Part 8.405- 6(a) for the procurement of Professional Support Services to Proposed Contractor: Brown Construction Services, Inc., 7202 Evergreen Lane #F, Annandale, VA.

3. Description of Supplies/Services. Describe the supplies or services to be acquired.

Provide the estimated total value (including options, if any).

The requirement is to provide design and limited construction efforts, building management, space planning, move services, furnishings, occupancy and lease services for the DHS Headquarters, including related scheduling, estimating, budgeting and cost management. The Contractor will provide (7) personnel to support, assist and address challenges related to space acquisition, building upkeep, reconfiguration, design and limited construction, outfitting, logistics, furniture and general management of DHS's facilities at a total cost of approximately $103,145.28/month.

Period Total Base Period (3 months) $304,524.16 Option period (1 month) $108,056.96

Total $412,581.12

4. Authority and supporting rationale.

Pursuant to FAR 8.405-6(a)(1)(i)(B) - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

Brown Construction was the incumbent on the previous contract and can best provide these services due to the fact that they can pick up where the work finished without going through a learning curve, they have all necessary clearances in place since the work was being performed via HSHQDC-12-F-00125 which just ended and they can provide a continueal flow in services to the mission. See Section 7 of this document for additional facts.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that issuing the proposed Task Order to Brown Construction Services Inc., represents the best value, considering price and administrative costs, to meet the Government's needs. This order is placed in accordance with FAR 8.404, "Use of Federal Supply Schedules." The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. The Contractor's labor mix and level of effort was also compared to the Independent Government Cost Estimate (IGCE).

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market Research was not conducted for this bridge task order due to the time constraints of having to put this task order in place.

7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.

Solicitation HSHQDC-15-Q-00378 for similar services received 4 quotes and award was made to Brown Construction Services, Inc. on September 22, 2015 based on the best value to the Government.

The award decision resulted in a GAO filed protest and work stopped on the awarded contract. The services required by the stopped contract are an ongoing requirement. It is vital that the required services are performed while the protest is remedied; therefore, this Task Order serves as the bridge contract while the protest is resolved. Only the incumbent (Brown Construction Services on HSHQDC-12-F-00125) has the capability to immediately perform the services due to the facts that Brown Construction Services already has security clearances in place, there is a short period of performance, the transition is needed from the original Task Order to the potential new Task Order, and thus prevent a large lapse in services provided.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition).

This action is to permit DHS time to take corrective action on a competitively awarded Task Order for the same services. DHS will continue to competively award the requirement in future acquistions.

9. DHS intends to post this requirement on Fedbizopps pursuant to FAR 8.405-6(a)(2)(i).

Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government's minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.

Christopher Goldsmith Date Technical Representative/COR
