Orders or BPAs Exceeding the Simplified Acquisition Threshold

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity.

The Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), on behalf of OCIO proposes to award an order pursuant to Federal Acquisition Regulation (FAR) 8.405-6(a), Limited Sources.

2. Nature and/or description of the action being approved.

(a) Type of Contract: Hybrid, Firm Fixed Price and with reimbursable travel.

(b) Amount the current J&A is justifying

(c) Estimated period of performance: 3/9/2020-3/8/2021

Brief Description: OAQ intends to procure, on a sole-source basis, continued use of cellular wireless managed services from the following company.

WidePoint Integration Solution

3. Description of Supplies/Services.

This requirement is for WidePoint Integrated Solution (WidePoint) to provide cellular wireless managed services, which is a mission critical means of communications throughout ICE. The required services and products include: Wireless Core Services, Cellular wireless management portal, Program Management, Performance Management and Accountability, Transition Out, Service Support Program, and Telecommunications Management Services.

Additionally, devices include but not limited to: Smart Phones, Air Cards, MiFi, Tablets, Data and Wireless Telecommunication Services as well as managing and tracking all devices. A customized web portal is also included as a tool for managing the wireless program.

ICE proposes to award a twelve (12) month Task Order under GSA Schedule Contract GS- 35F-0232N.

4. Authority and supporting rationale and a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

Authority:

Select only one of the following circumstances justifying limiting sources pursuant to FAR 8.405-6(a)(1)(i) below and demonstrate the proposed contractor’s unique qualifications to provide the required supply or service.

☐ 8.405-6(a)(1)(i)(A) An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays.

☒ 8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

☐ 8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

Supporting Rationale:

ICE enforces federal laws governing border control, customs, trade and immigration to promote homeland security and public safety. Created in 2003 through a merger of the investigative and interior enforcement elements of the former U.S. Customs Service and the Immigration and Naturalization Service, ICE now has more than 30,000 employees in more than 400 offices in the United States and 46 foreign countries. The agency has an annual budget of approximately $6 billion, primarily devoted to three operational directorates – Homeland Security Investigations (HSI), Enforcement and Removal Operations (ERO) and Office of the Principal Legal Advisor (OPLA). A fourth directorate – Management and Administration – supports the three operational directorates to advance the ICE mission.

ICE is dependent upon cellular managed services to fulfil its mission. The dynamic growth in workload and staffing has resulted in the expanded use of cellular managed services by ICE.

As business improvement requirements are identified by the Agency, the need to provide more secure, robust, reliable, responsiveness and available solutions and functionality for ICE becomes more essential to ensure effective support of the mission. Thus, cellular wireless managed services are a mission critical means of communications throughout ICE.

The aforementioned services are currently being provided under DHS HQ BPA Cellular Wireless Managed Services (CWMS) BPA # HSHQDC-13-A-00024. ICE’s BPA call will expire March 2020. Current DHS HQ guidance has stated their intent to competitively award a DHS-wide strategic sourcing vehicle in October 2020. ICE intends to compete a follow on task order—immediately following the DHS HQ award—per mandatory strategic sourcing policy. As a result, ICE must award this interim task order to avoid a break in services until the new strategic sourcing vehicle is awarded. Any disruption of these services would adversely affect the agency’s mission.

Only WidePoint possesses the immediate knowledge and security-cleared personnel to continue uninterrupted wireless services. They have no authorized resellers of their services.

Their customized services and systems are proprietary. They have the capability to operate the software ordering system and Intelligent Telecommunications Management Systems (ITMS) until ICE can award a task order is under DHS HQ’s strategic sourcing vehicle.

WidePoint is the only vendor who currently has the software ordering system that has all the required security features to protect Personally Identifiable Information (PII) data stored on ICE systems, is customized for ICE use and integrated with the required wireless carriers. To recompete this effort while the new DHS HQ vehicle is being re-competed would be a significant duplication of cost and effort. ICE would have to procure new software, software licenses, and maintenance at a cost far exceeding the cost of the current ordering system from WidePoint.

WidePoint has provided the required wireless services consistently and in a satisfactory manner for several years. To consider another contractor to manage all the required services, in the time required to prevent disruption of services is unrealistic. The time required for a new contractor to setup wireless management services may delay and result in an interruption in service and capabilities that could present significant safety and mission impacts. Accordingly, it is in the best interest of the Government to issue this short-term extension while DHS HQ finalizes the solicitation documents for a new contract award, issues a competitive solicitation, and makes a new contract award.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the anticipated prices for the wireless services will be fair and reasonable based on the contractor’s GSA Schedule Contract. A Hybrid Task Order is anticipated. GSA has already negotiated fair and reasonable prices for the supplies and services. Discounts have been requested. The quoted labor mix and level of effort will also be evaluated to ensure that they are commensurate with the requirement.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

ICE reviewed DHS’s strategic sourcing vehicles, but no alternate vehicles were determined capable of providing the required solution. ICE performed a search of the GSA IT Schedule 70 and found 22 vendors under the Wireless Services category. However, these vendors did
