Control #LSJ-20-0021 (>SAT), DJA-20-AOST-PR-0075, Page 2 of 3

DOJ has an initiative called PayCheck8, mandating all of its components to use this new state-of-the-art system to record time and attendance for its employees; so far only the Drug Enforcement Administration has tested it. Since this initiative is not ready for deployment and support will decrease for the current version of WebTA soon, ATF needs to upgrade WebTA so it can continue managing the time, attendance, leave, and pay operations of its employees while meeting mandatory-security requirements. These include: DOJ Order 9004, Cybersecurity Program, DOJ Cybersecurity Standard, DOJ Security and Privacy Assessment and Authorization Handbook, DOJ Configuration Management Plan, DOJ Vulnerability Management Plan, DOJ Strong Authentication Plan, Rules of Behavior, DISA STIGS, NIST 800 series requirements, and OMB requirements.

Furthermore, the WebTA solution is proprietary, and Immix/Kronos (I/K) is already familiar with all functionality and operations of the various modules because I/K developed and provided implementation consulting to ATF when it delievered WebTA initially. I/K is the only source capable of the following: 1) providing the skilled resources and required support to perform the upgrade; and 2) ensuring the application operates at its peak performance and the test and production environments continue to meet mandatory-security requirements. It would be wasteful to have a new system implemented since DOJ’s initiative is under way.

5. Determination by the Ordering Activity’s Contracting Officer (CO) that the order represents the Best Value consistent with FAR 8.404(d).

GSA has already determined the prices of supplies and fixed-price services under schedule contracts to be fair and reasonable. While the CO is not required to make a separate determination, she compared Immix’s rates to those on www.CALC.GSA.gov and found them to be much higher (on average by $106 and ~89%). Per FAR 8.405-4, the CO sought a price reduction since this requirement is over the simplified acquisition threshold (SAT), but Kronos could not offer such per the email dated 7/29/2020.

6. Description of the Market Research conducted among Schedule Holders and the Results or a Statement of the reason such was not conducted.

OST did not conduct any market research because I/K is the original application developer, designer and installer of the proprietary WebTA system.

When the CO searched the internet for WebTA upgrade, the only vendor that appeared was Kronos; and when she searched “WebTA” via GSA’s Advantage site, only ImmixTechnology appeared. When she searched “WebTA” via GSA’s eLibrary site, nothing appeared; however, when she searched “Kronos” there, only ImmixTechnology appeared. Although both Kronos and ImmixTechnology are contractors on the National Aeronautics and Space Administration’s Solutions for Enterprise-Wide Procurement site, neither appeared when the CO searched “WebTA” there. Also, when the CO searched “WebTA” via the Interagency Contract Directory, it only showed 3 obligations, all under ImmixTechnology’s GSA Schedule #. Out of the six (6)
