LIMITED SOURCE JUSTIFICATION

1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, is the contracting activity.

2. This justification is for the purchase of additional hardware and software for an existing

FujiFilm Medical Systems U.S.A. (FUJI) Picture Archive and Communication System (PACS) on a sole source basis.

3. This requirement has three parts which include a mid-life cycle PACS technical hardware refresh, a software update to Windows 8 (vs Windows XP), and additional system capability (including 3D, mobility and cardiovascular PACS applications) for an existing FUJI system installed at the Naval Health Clinic Oak Harbor. It is available on FUJI’s DINPACS contract SPM2D1-11-D-8307 which expires April 10, 2015. The total estimated dollar value of this requirement is $407,138.00.

4. The authority under the Multiple-Award Schedule Program waiving competition requirements is FAR 8.405-6(a)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. The current FUJI PACS installed at the Naval Health Clinic Oak Harbor was purchased as a result of a competitive solicitation under DLA Troop Support DINPACS II contract program on January 21, 2010. The original acquisition was solicited based on pricing for a 6 year lifecycle (1 year warranty and post-warranty maintenance cost for 5 years). The hardware associated with a PACS (servers, workstations and monitors) has a 3-5 year lifecycle. Thus, a technical refresh of the existing system is required in order to maintain the system at peak performance. The hardware refresh must be compatible with the existing FUJI PACS infrastructure; thus, only FUJI is capable of providing the refreshed hardware.

Additionally, FUJI’s PACS software is being updated to a Windows 8 version and applications are being added to expand the current system capabilities. Since the software and applications need to be compatible with the current system, only FUJI is capable of providing these updates and add-ons.

5. DLA Troop Support has already determined the price of the individual components that comprise the technical refresh, upgrades and add-ons to be fair and reasonable based upon the pricing evaluated at the time of award of FUJI’s current DINPACS III contract and subsequent modifications.

6. Market research confirmed that no other vendors can offer the proposed hardware refresh, upgrades and add-ons and ensure integration into the FUJI PACS currently installed.

7. There are no additional facts supporting this justification.

8. DINPACS vendors have the opportunity to add products that fall within the scope of the DINPACS contract at any time; however, currently there are no other known DINPACS vendors that would be able to offer this hardware refresh for an existing FUJI PACS.

9. As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
