LSJ – HRS/CMS/BDS Marketing and Business Development Support
LIMITED SOURCES JUSTIFICATION
In Accordance with Federal Acquisition Regulation (FAR) 8.405-6
4/27/2020
Contractor: TMP Government LLC (TMP)
Program: Human Resources Solutions (HRS) Center for Management Services (CMS) Business Development Services (BDS); Marketing and Business Development Support
1. Contracting Activity: U.S. Office of Personnel Management (OPM)
Office of Procurement Operations (OPO) 1900 E Street, Room 1342 Washington, D.C. 20415
2. Nature and Description of Action being approved:
The Human Resources Solutions (HRS), Center for Management Services (CMS), Business Development Services branch (BDS) provides a full range of marketing and business development services to HRS practice areas. This document provides justification for acquiring, on a sole source basis, contract support for marketing and business development support services. The request provides for continuation of services that were previously awarded on a competitive basis among contractors on the General Services Administration (GSA) Federal Supply Schedule (FSS) Professional Services Schedule (00CORP), pursuant to the authority of FAR Subpart 8.405-2. This procurement action will be generated by the Office of Personnel Management (OPM), Office of Procurement Operations (OPO) on behalf of Human Resource Solutions (HRS), Center for Management Services, Business Development Services branch (BDS). This Limited Sources Justification (LSJ) will result in a new task order using TMP Government’s (TMP) current GSA Professional Services (00CORP), Category 541-5 contract number 47QRAA18D00AR. The new task order will include a base period, plus three (3) one-year option periods.
The new task order will provide continuation of the required services that were awarded pursuant to HHS PSC task order 75P00119F80122, which was awarded by the Department of Health and Human Services (HHS) Product Support Center (PSC), through an Interagency Agreement (IAA) with OPM for assisted acquisition services. This new award is required as a result of HHS PSC’s notification they will no longer support or manage contracts outside HHS components and will terminate all contract support for outside-HHS contracts no later than September 30, 2020. In the interim, HHS PSC has also advised they will not perform any contract management functions, other than processing payments for current contracts. Under these circumstances, HRS finds itself with the need for a new OPM task order to fulfill its urgent need that HHS PSC will no longer support: to provide for continuation of services consistent with the current HHS PSC task order.
3. Description of Services required to meet the agency’s need:
The services in this new, OPM-awarded task order mirror the tasks in the PSC award and include, but are not limited to:
Business development consulting and support Production of marketing materials Event management and logistics An outreach campaign Planning and purchasing media placements General marketing support Planning and executing market research
The task order originally executed by HHS PSC was awarded in the total amount of $5,981,469 for a period of performance of five years (base year, plus four 1-year option periods). The base year funds of $1,196,293.80 will be fully expended to the extent practicable through the existing HHS PSC base year task order, ending on June 27, 2020. OPM’s task order will replicate the remaining one-year option periods of the HHS PSC task order, with a new base year commencing on June 28, 2020, followed by three (3) one-year option periods. The total amount of the award is $4,785,175.20, with the base year and each option year mirroring the amount of the HHS PSC task order pricing at $1,196,293.80 each. The IGCE included in this solicitation package outlines the proposed costs throughout the 48-month task order period of performance.
4. Authority Cited:
Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et.
Seq) and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by Federal Acquisition Regulation (FAR) 8.405-6 and substantiated by the following:
FAR 8.405-6(a)(1)(i)(C). In the interest of economy and efficiency, the work is a logical follow-on to an original FSS order provided that the original order was placed in accordance with applicable FSS ordering procedures. The original HHS PSC, task order number 75P00119F80122 was not previously issued under sole-source or limited-sources procedures.
5. Rationale for Authority Cited:
This sole source acquisition is being made in the best interest of the Government, given the criticality of continuous service, and the known capability, competence, experience, and performance of the incumbent contractor. These factors have been demonstrated through HHS PSC’s best value task order competition and TMP’s performance under the resultant task order since commencing work during the base period on 6/28/2019. This is the first time this authority is being utilized for this requirement.
Under its guidance, HRS has found the use of contractor support for its marketing and business development activity to be extraordinarily effective. Through careful contract management and oversight, HRS’ CMS Business Development Services branch has helped the organization increase lead generation by more than 1,800% and lead-to-sales conversion has grown from about 30% to 60% during the last six years. The program also has led to coordination, collaboration, and cross pollination of leads across all HRS practice areas. The cross pollination of leads was a major goal of the program and, therefore, a major determining factor in choosing a contractor uniquely qualified to provide greater intra-company transparency and cross-selling techniques, advice, and counsel.
The incumbent contractor is currently fully staffed and operational and enables the Government to receive continued critical services seamlessly, avoiding the potential interruption resulting from a transition. This action affords HRS the availability of the contractor’s support through the full base year performance period of the competitively awarded HHS PSC task order. The purpose of this award is to replicate the remaining performance periods (3 one-year option periods through 6/27/2024) of the existing HHS PSC task order, awarded against GS-23F-0076J.
The new OPM task order will be awarded pursuant to TMP’s new GSA 00CORP contract number 47QRAA18D00AR, which replaced GS-23F-0076J that expired 7/11/2019.
6. Best Value Determination/Fair and Reasonable Cost:
The ordering activity’s Contracting Officer’s Best Value/Fair and Reasonable Cost Determination follows the Technical Certification. Based on the nature of the requirement, the solicitation will be issued to a single source, TMP, under its GSA schedule contract GS-23F- 0076J. Competition will not be sought. To determine that the anticipated order will represent the best value, the Contracting Officer (CO) and requesting activity will review historic pricing, as well as pricing data gained through market research conducted in support of the current competitive acquisition. Additionally, TMP will be requested to provide pricing no greater than the rates and prices of the existing HHS PSC task order, as well as any further discounts available beyond their published GSA prices. Per FAR 8.404(d), pricing provided for services as hourly rates on the FSS is already determined to be fair and reasonable except for the price evaluation as required by FAR 8.405-2(d).
The Independent Government Estimate (IGE) was prepared using the existing HHS PSC task order prices, which were determined fair and reasonable, based on GSA schedule rates and adequate price competition among schedule holders. TMP will be advised that OPM is seeking award of a new task order at the same rates and pricing of the HHS PSC task order.
Additionally, the Contracting Officer will review the proposed prices for this sole source task order to ensure that resulting award prices are fair and reasonable.
7. Market Research:
Market research was conducted in support of the original HHS PSC task order award.
Recent market research validated that market conditions have not changed and that no other offeror is capable of immediately performing all the services required without significant impact to continued critical services. This new award will afford HRS the benefit of the contractor building upon the work already accomplished and applying the technical experience and knowledge gained during the base period.
Market research will be performed for future continuation of these services with the object of award on a competitive basis.
8. Other Facts:
HRS has already invested heavily in its marketing and business development operations, including more than six years and millions of dollars. That investment has paid off handsomely with new opportunities to provide HRS products and services to many more Federal agencies.
These ongoing new relationships and engagements would be seriously undermined should HRS be forced into another full and open competition just months after awarding a competitively solicited task order.
Our business development operation routinely accounts for 10-15% of all sales volume across the enterprise, which is only made possible through the knowledge and expertise brought by our outside contractor support. Furthermore, HRS operational strategy was and is to reduce long term internal costs – particularly for full time equivalent employees – in favor of purchasing needed expertise from industry’s finest marketing and business development experts.
Conservatively, starting a new task order from scratch would reduce HRS sales by at least 10%, costing the organization – and OPM – a projected $50M in FY20 and potentially a like amount in FY21.
9. Actions to Remove or Overcome Barriers to Competition:
The Government will continue to conduct on-going market research as required by FAR Part 10 for the services described in this justification for future procurements.
10. Technical or Requirements Certification:
