(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

FAR 8.405-6(b): Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is:

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: These prices are validated by GSA which has determined the prices of supplies under schedule contracts to be fair and reasonable.

(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. The Product Service Code (PSC) R430 is classified as NON-IT and does not require a FITARA approval.

Market research was performed using the following techniques/methods to identify potential sources: Vendor Information Pages (VIP). Request For Information (RFI) posted at https://beta.sam.gov. Searched GSA eLibrary at www.gsa.gov. Searched Federal Procurement Data System (FPDS) website at https://www.fpds.gov/fpdsng and SBA DSBS system at https:// web.sba.gov/pro-net/search/dsp_dsbs.cfm. Communication by email to manufacturer for letter attestation for authorized resellers. The proprietary letter of the sole manufacturer SoloProtect US, LLC is available upon request. The methods used were suitable to locate capable SDVOSB’s/ VOSB’s to support the need of JAHVH and Orlando HCS.

A Request for Information (RFI) was issued on 11/3/2022 to https://beta.sam.gov yielded 2 large businesses: GME Cargo LLC and Kalo Development LLC. Both suggested an interest in providing these services. Attempts were made to obtain the large businesses capabilities statements and authorized reseller letters, but neither GME Cargo LLC nor Kalo Development LLC provided these items, thus concluding a lack of confidence that the large businesses would provide an actual quote.

A determination that the use of a sole-source contract is in the best interest of the James A. Haley Veterans’ Hospital and the Orlando VA. No other actions were taken for competition. Market research strategies include reviewing industry websites and email communications with the manufacturer. Market research validates SoloProtect US, LLC, as sole proprietary manufacturer provider, and reveals SoloProtect US, LLC has an existing contractual vehicle under General Services Administration (GSA) Federal Supply Schedule (FSS) 47QSWA19D007T, which will be utilized for procuring badges and service support. In light of market research and vendor letter attestation, there's a high degree of confidence that no other qualified sources exist.

(7) Any Other Facts Supporting the Justification: This procurement is necessary to address the increase in safety events which include assaults, battery and aggressive animal attacks on home care staff. Home Care and Community Workers are required to travel frequently throughout the community which increases the risk of encountering situations that places them at risk for harm (Bussing & Hoge, 2004). Civil unrest, violence in a home environment or entering environments where other VA staff or police are not present increases the likelihood of delayed awareness when a staff member is harmed or in danger. The SoloProtect device allows staff to push button on device which is located on lanyard or on a badge holder on the outside of their shirt. The silent alarm does not emit an audible signal which prevents others from being aware that help was activated and does not further escalate the situation. The monitoring company will listen in and call for help when signs of struggles, distress or silence is detected.

Currently, the staff is dependent on the ability to grab a VA-issued smartphone, unlock the phone and then dial 911 while trying to flee from an unsafe situation. After reviewing industry websites, I found there were similar alert badges. However, they did not provide the following characteristics essential to safety standards which include but are not limited to the following features Check- in/ Check-out, Incapacitation/Man-Down detection notification to VHA, GPS/GNS dual signal detection and reporting, safety device operating on a charge, and 24/7/365 monitoring service.

(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: None

(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
