LIMITED SOURCES JUSTIFICATION

1. CONTRACTING ACTIVITY: National Guard Bureau, Operational Contracting Division (NGB-AQ-C), 111 South George Mason Dr., Arlington, VA 22204-1382

2. DESCRIPTION OF ACTION: This action is an extension to a BPA Call to provide continuity of services for the incoming contractor to provide them sufficient time to ramp up their workforce and allow for a seamless transition. NGB intends to extend the Period of Performance of this call from 16 May 2018 – 15 November 2018. Total estimated cost of this action is $ .

3. DESCRIPTION OF SERVICES: The services provided under this effort are a continuation of the current Aviation Simulator Instructor/Operator Support which includes instruction to Army National Guard Aviators using simulators that are specific to Army Aviation platforms. This is a critical service to ensure that the currency and proficiency of rated Army aviators is conducted in order to meet semi-annual and yearly requirement mandated by Headquarters, Department of the Army (HQDA). Contracted services currently satisfy HQDA directed aviation training and student throughput for multiple National Guard units in the 54 states and territories as well as Active Duty, Foreign Military, and Army Reserve personnel. The Contractor provides Instructors/ Operators (I/O) who operate a fleet that currently includes: four Longbow Crew Trainers (LCT), one UH- 60A/L Synthetic Flight Training Simulator (SFTS), three UH-60M Transportable Blackhawk Operational Simulator (TBOS), three CH-47F Transportable Flight Proficiency Simulator (TFPS) Regional flight simulators, two UH-72A Synthetic Flight Training Simulators (SFTS), 11 Aviation Combined Arms Tactical Trainers (AVCATTs) and 12 Non-Rated Crew Member Manned Modules (NCM3). The contractor also provides one AVCATT/NCM3 contract Scheduler and one Quality Assurance Contractor who coordinates with WFF personnel and PEO STRI to improve usage and the quality of essential collective training provided by the AVCATTs and NCM3s.

4. AUTHORITY CITED: 10 U.S.C 2304(d)(1)(B) as implemented by FAR Part 8.405-6(a) (1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

5. REASON FOR AUTHORITY CITED: Army National Guard (ARNG) aviators must continue to receive the best training available in order to maintain/obtain Readiness Level 1 and currency in their primary aircraft. Ultimately individual readiness equates to the readiness and relevance of ARNG Aviation units. Simulator training is required by the regulations and essential to the readiness of our aviation units. The reduction of available flying hours further increases the importance of utilizing simulator training for training and proficiency. Without highly qualified contractor I/O’s operating the multi-million dollar ARNG flight simulators, the necessary training will not be effective in providing aviator progression and readiness support. These service are currently performed at 13 sites across the United States. The Government requires the continued performance of these services in order to minimize unacceptable delays in

fulfilling the agency’s needs until the new competitively awarded Single Award Indefinite Delivery/Indefinite Quantity (IDIQ) Contract is awarded in the 1st Quarter (QTR) of FY 2019. Upon award, a new task order will be issued to satisfy these requirements. These services are currently being performed by Systems Studies & Simulation, Inc. (S3) under BPA W9133L-12- A-0006 and are currently the only company that can continue services without loss or degradation of training which allow aircrews to maintain aviator minimums mandated by HQDA. While NGB operational contracting intends to award the IDIQ in 1st QTR FY 2019, a lapse in service of six months for the competition and selection of another qualified vender is not feasible. Competition for a separate contract will still create a loss in continuity and decrease the readiness of aviation aircrews.

Transition to a new contractor at this time will result in a break in service and disruption in aviation training due to an anticipated ramp-up time for new personnel of approximately 30-45 days. This time-frame is estimated based on the Army National Guard Aviation and Safety Division’s historical experience with bringing contractor records up to the standards required by AR 95-20 (also known as DCMA INST 8210.1C). Any new personnel would require a verification of flight records and flight physicals. The incumbent currently employs certified contractors to conduct HQDA directed training missions at the multiple locations. This Limited Sources Justification ensures the continuity of these services without the delays associated with ramp up, training certification, and costs that would be associated with the issuance of another contract. IAW FAR 8.404(d), this contract represents the best value to the government as it results in the lowest overall cost alternative to meet the Government’s needs.

6. EFFORTS TO OBTAIN COMPETITION: The Aviation Training Services and Operations Support (ATSOS) solicitation (W9133L-17-R-0008) was issued 6 April 2017 under fbo.gov amongst Service Disabled Veteran Owned Small Businesses (SDVOSBs). This strategy was based on market research that showed this to be the socioeconomic category with the most interested vendors.

Adequate competition was received for the follow on contract, but due to a protest and subsequent corrective action, a sole source extension to the existing contract is necessary to ensure continuity of essential services necessary to maintain readiness. As stated above, the competitive follow-on will be fulfilled as a Task Order under the IDIQ.

7. ACTIONS TO INCREASE COMPETITION: The follow-on requirement was awarded and received a protest. NGB chose to take Corrective Action by allowing the contractors within Competitive Range to resubmit their proposals. Proposals are due 14 May 2018 and the Government requires ample time to evaluate, prepare the award documentation, and allow for transition.

8. MARKET RESEARCH: Market Research was conducted from April 2017 – June 2017, by employing the following Market Research Techniques: issuance of an RFI, a review of historical information, contacting other Government Agencies with similar requirements and review of GSA and searches on the internet. Market Research confirmed that several SDVOSBs were interested and were capable of providing these services at a satisfactory level and that there were no current contracts available to procure these services under.

9. INTERESTED SOURCES: Several offerors submitted proposals for the competitive effort under solicitation W9133L-17-R-0008.
