Template for a Federal Supply Schedule (FSS) Limited-Sources Justification
Completion Instructions: HHS has established a standard template for the preparation of a Limited-Sources Justification (LSJ) pursuant to FAR Subpart 8.4. This template is for use with orders issued under the Federal Supply Schedule (FSS) program where the value exceeds simplified acquisition threshold and competition is restricted: (1) to fewer schedule contractors than required in FAR 8.405-1 or 8.405-2, or (2) to an item peculiar to one manufacturer. See FAR Subpart 8.4 for additional guidance. This template is not for use with acquisitions other than those under FAR Subpart 8.4.
Tailor all aspects of this template to the individual acquisition. Consult FAR 8.405-6 for guidance.
Delete the highlighted portions of this document prior to signature. Do not include these instructions in the final document or contract file.

| TextField8: Rental, Service, Support and Maintenance Agreement for ScriptPro products. This is intended to be a bridge contract to maintain services during a competitive solicitation and transition period. Performance shall begin March 1, 2021. |
| TextField8: A open competition solicitation has been prepared. A bridge contract is being utilized to prevent interruption of patient care and safety, as well as compliance with accreditation standards and DEA reporting requirements during the solicitation, selection, award and transition period. Otherwise the IHS would need to revert to hand counting, packaging and labeling thousands of prescriptions. This would increase wait times from hours to weeks. It has been estimated that the IHS would need to hire over 16,000 Pharmacists and Pharmacy Technicians to make up for the loss of use of the automated systems. The urgency is based on the current support agreement expiring on 12/31/20, and the need to not have a gap in coverage, and has been exacerbated by the lack of a passed budget. The reliance on limited time/limited budget Continuing Resolutions has adversely impacted the ability to advertise the required competitive solicitation. In the interim a 2-month task order has been implemented. |
