LIMITED SOURCES JUSTIFICATION
FOR AN ORDER / BPA EXCEEDING
THE SIMPLIFIED ACQUISITION THRESHOLD
(AUTHORITY: FAR 8.405-6)
Contract / Task Order Number: GS02F156AA / 73351020F0149
This acquisition is conducted under the authority of the Multiple Award Schedule Program.
1. Agency and contracting activity. U.S. Small Business Administration (SBA), Office of the Chief Financial Officer (OCFO), Acquisitions Division, in support of the Office of Disaster Assistance
(ODA).
2. Nature and/or description of the action being approved.
This limited source justification is for a modification to increase an existing labor hour Task Order, issued in response to the novel Coronavirus (COVID-19) national emergency, for Human Resources (HR) support services.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).
The HR support services are required to assist the SBA’s ODA with the onboarding of 2,000+ personnel hired to support the surge of ODA COVID-19 requirements. The total period of performance will be extended from 5 May 2020 through 18 July 2020 to 5 May 2020 through 18 September 2020. The total price of the Task Order will be increased from $609,211.22 to $1,300,679.06.
4. Authority and supporting rationale. The following circumstance justifies limiting the source as supported below:
Urgent and Compelling under the authority of FAR 8.405-6 (a)(1)(i)(A) - An urgent and compelling need exists and following the procedures would result in unacceptable delays.
This requirement is essential to ensure ODA is able to meet their mission to provide low-interest disaster loans to businesses of all sizes, private non-profit organizations, homeowners, and renters to repair or replace real estate, personal property, machinery & equipment, inventory and business assets that have been damaged or destroyed in a declared disaster. Failure to quickly onboard additional personnel to support these efforts will put ODA at significant risk of not meeting their mission and small businesses nationwide experiencing unacceptable delays in gaining access to SBA resources that can provide economic relief during these unprecedented times.
5. Determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined the revised price quote is fair and reasonable and results in the lowest overall cost alternative to meet the Government’s needs. The proposed labor rates are discounted from the Contractor’s GSA Schedule rates and the total price is lower than the Government’s Independent Cost Estimate (IGCE).
OCFO-A 008 V1 2 05/03/2019
6. Market research conducted among schedule holders (or reason market research was not conducted).
Market research among schedule holders was performed prior to the establishment of the Base award, less than three months ago. Additional market research has not been performed since the SBA has an existing award for the required services.
7. Any other facts supporting the justification.
None.
8. Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for supplies and services is made.
The SBA does not anticipate an additional surge in the number of on-boarding personnel, however, ODA will continue to gauge the on-boarding timeline and will seek competition of future acquisition of these services if it is found other market capabilities exist and time permits.
